HomeMy WebLinkAboutSD-06-06 - Decision - 1530 Dorset StreetCITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING DORSET STREET ASSOCIATES, LLC - PLANNED UNIT DEVELOPMENT FINAL PLAT APPLICATION #SD-06-06 FINDINGS OF FACT AND DECISION Dorset Street Associates LLC, hereafter referred to as the applicant, is requesting final approval to amend a Planned Unit Development consisting of: 1) 59 single-family lots, 2) 90 multi -family units in 45 buildings, 3) 6 common lots, and 4) 1 reserved lot. The amendment consists of: 1) relocating utility easement, 2) relocating street lights, 3) revising duplex footprints, and 4) adding landscaping around utility cabinets, 1580 Dorset Street. The Development Review Board held a public hearing on February 21, 2006. Paul O'Leary represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is requesting final approval to amend a Planned Unit Development consisting of: 1) 59 single-family lots, 2) 90 multi -family units in 45 buildings, 3) 6 common lots, and 4) 1 reserved lot. The amendment consists of: 1) relocating utility easement, 2) relocating street lights, 3) revising duplex footprints, and 4) adding landscaping around utility cabinets, 1580 Dorset Street. 2. The subject property is located in the Southeast Quadrant (SEQ) Zoning District. 3. The owner of record of the subject property is Dorset Street Associates, LLC. 4. The plans submitted with this application consist of an 18 page set of plans, page one (1) entitled, "The Cider Mill South Burlington Vermont Site Plan `A"', prepared by O'Leary -Burke Civil Associates, PLC, dated 7/5/05, last revised on 1 / 18/06. ZONING DISTRICT & DIMENSIONAL REQUIREMENTS There are no changes to the dimensional requirements as part of this application. However, please note the comments included in the proposed amendments to duplex building envelopes section below. - 1 - PROPOSED AMENDMENTS TO UTILITY EASEMENTS The South Burlington Water Department reviewed the amended plans and has no additional comments. The City Engineer is reviewing the p►ans and should have comments prior to the hearing. PROPOSED AMENDMENTS TO LIGHT FIXTURE TYPE AND LOCATIONS These amendments are acceptable. The newly proposed light fixtures are shielded and downcast in accordance with the South Burlington Land Development Regulations. PROPOSED AMENDMENTS TO DUPLEX BUILDING ENVELOPES The applicant is proposing to adjust the condominium footprints to include porches and decks. This is acceptable. The applicant has stated that the overall building coverage for the site shall be approximately 8%. The amount of impervious surface on the site, including driveways and roads, will be 7.4%, for total site coverage of 15.4%. This is well below the coverage limitation in the Southeast Quadrant of 30%. Additionally, the Administrative Officer will further review the setback and coverage statistics when the single family homes are presented for zoning permit application. The duplex sites meet these requirements provided they stay within the approved building envelopes. PROPOSED ADDITION OF LANDSCAPING AROUND UTILITY CABINETS SIGNS In accordance with Section 13.18 of the South Burlington Land Development Regulations, "there shall be suitable fencing to protect the public and sufficient landscaping evergreens of sufficient height and density to screen effectively the facility from surrounding property." The proposed landscaping around the utility cabinets is not adequate. The applicant is proposing only four plants around the cabinet. They are not entirely evergreen. The plans shall be revised to depict greater screening of the utility cabinets and include a planting schedule and budget for the utility cabinet screening. More trees or shrubs shall be used. These shall be evergreens and shall be of a sufficient height to screen the cabinets. Furthermore, the applicant shall submit a revised landscaping budget which depicts the value of the revised site landscaping. Signs shall be reviewed separate from this process by the Code Officer. -2- DECISION Motion byy���-� Ou106V/ , seconded by WX 6#,IqA#4410 to approve Final Plat Application ##SD-06-06 of Dorset Street Associates, LLC., subject to the following conditions: 1) All previous approvals and stipulations shall remain in full effect, except as amended herein. 2) This project shall be completed as shown on the plat submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3) The plans shall be revised to show the changes below and shall require approval of the Administrative Officer. Four (4) copies of the approved revised plans must be submitted to the Administrative Officer prior to recording: a) The plans shall be revised to utilize more landscaping and thus greater screening of the utility cabinets. These shall be evergreens and shall be of a sufficient height to screen the cabinets b) The plans shall be revised to remove any references to the signs as part of this application. 4) The applicant shall submit a revised budget which depicts the value of site landscaping to include the value of the utility cabinet screening. 5) Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. 6) The final plat plans (survey plats 1-4) shall be recorded in the land records within 180 days or this approval is null and void. The plans shall be signed by the Board Chair or Clerk prior to recording.
