FINAL PLAT APPLICATION #SD-07-22
FINDINGS OF FACT AND DECISION
Dorset Street Associates LLC, hereafter referred to as the applicant, is requesting final
plat approval to amend a previously approved planned unit development consisting of: 1;
59 single family lots, and 2) 90 single family dwellings. The amendment consists of a
request to increase the allowable maximum building coverage from 15% to 20% on lots
#1-7, 10-20, and 22-59, 1580 Dorset Street. The Development Review Board held a
public hearing on Tuesday, April 17, 2007. Gerry Milot and Lance Llewellyn represented
the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following.
FINDINGS OF FACT
The applicant is requesting final plat approval to amend a previously approved
planned unit development consisting of: 1) 59 single family lots, and 2) 90 single
family dwellings. The amendment consists of a request to increase the allowable
maximum building coverage from 15% to 20% on lots #1-7, 10-20, and 22-59,
1580 Dorset Street. The Development Review Board held a public hearing on
Tuesday, April 17, 2007.
2. The owner of record of the subject property is Dorset Street Associates, LLC.
3. The subject property lies within the Southeast Quadrant Zoning District.
4. The plan submitted consists of a four (4) page set of plans, page one (1) entitled,
"The Cider Mill South Burlington Vermont Overall Subdivision Plat", prepared by
Button Professional Land Surveyors, PC, dated 4/23/03, last revised on 11/7/03.
ZONING DISTRICT & DIMENSIONAL REQUIREMENTS
The applicant is proposing to increase the allowable maximum building coverage from 15%
to 20% on the single family lots, labeled as #1-7, 10-20, and 22-59 on the plans.
The maximum allowable building coverage in the Southeast Quadrant zoning district was
20% prior to the zoning revisions in 2003. Furthermore, an amendment to the South

Burlington Land Development Regulations in January 2007 allows for a maximum building
coverage of 20% for single-family residences existing as of May 24, 2006. While the Board
finds that the subject PUD does not meet the above standard, the Board does find that 20%
coverage will be consistent with the development that has occurred and will occur in the
Southeast Quadrant.
The Development Review Board has the ability to waive coverage limitations in a Planned
Unit Development. The maximum overall building coverage of the entire PUD shall remain
at or below 15%.
DECISION

to approve Final lat Application #SD-07-22 of Dorset treet Associates, LLC, subject to
the following conditions:
1) All previous approvals and stipulations, which are not superseded by this approval,
shall remain in effect.
2) This project shall be completed as shown on the plan submitted by the applicant and
on file in the South Burlington Department of Planning and Zoning.
3) The Board approves a maximum of 20% building coverage for lots #1-7, 10-20, and
22-59. All other coverage limitations shall remain in effect and be subjected to the
standards of the South Burlington Land Development Regulations.
4) The plat shall be revised to show the changes below and shall require approval of
the Administrative Officer. Three (3) copies of the approved revised plat shall be
submitted prior to recording.
a) The plat shall be revised to note that the building coverage for lots #1-7, 10-20,
and 22-59 is increased to a maximum of 20%.
5) Any changes to the final plat plan shall require approval of the South Burlington
Development Review Board.
6) The final plat plan (survey plat sheets 1-4) shall be recorded in the land records
within 180 days or this approval is null and void. The plan shall be signed by the
Board Chair or Clerk prior to recording.
