HomeMy WebLinkAboutMS-89-0000 - Decision - 1435 Dorset StreetCity Council City of South Burlington This matter before the City Council is in pursuant to provisions setforth under 24 V.S.A. Section 4410(d) on the application of Charles and Patricia Shea to construct improvements within the City of South Burlington which fail to comply with the "Interim Zoning Regulations" adopted April 17, 1989. A public hearing was held on Monday, November 6, 1989. The applicant was present at the hearing and was represented by Michael Dugan of Essex Junction, Vermont. Based on the evidence submitted at this hearing, the City Council renders the following decision on this application: Findings of Fact 1) Charles and Patricia Shea are the owners of the property in question. 2) The property located on the westerly side of Dorset Street contains 10 acres with access off a 60 foot right-of-way. 3) The right-of-way is a planned east/west connector road deeded to the City. 4) The structure is a single-family dwelling unit occupied by the Shea's. 5) By their application the Shea's are seeking approval to construct two enclosed porches (141 x 55" and 22' x 2211) plus an attached 451 x 501 carriage house with finish living area in loft of carriage house. 6) The Shea's submitted plans prepared by Michael Dugan, archi- tect located at 25 Pinecrest Drive, Essex Junction, Vermont dated October 2, 1989. These plans are part of the perma- nent record on file at City Hall. Conclusions The following information was submitted in support of this re- quest., that: a) The project should have little if any impact on the City facilities, services and land. The existing residence and proposed additions are to be served by the existing well and septic system, the access to the site will not be hindered in any way due to the placement of the new addi- tions (re: fire fighting, ambulance). b) The project is located on a 10 acre parcel of land, more than adequate on a land to building ratio. c) The proposed project is in keeping with the surrounding neighborhood. There are presently projects in progress in the immediate area along with existing farms and out build- ings along Dorset Street. d) The lot coverage on this site is 1.4% of the entire land area. 1 e) The natural woodlands to the south and west will not be disturbed in any way. f) This project is in compliance with all dimensional require- ments, use and coverage setforth with the City's bylaws. Decision The request of Charles and Patricia Shea to construct porches and a carriage house pursuant to 24 V.S.A. Section 4410 is hereby approved, subject to the following conditions: That the proposed guest rooms located in the loft of the carriage house are to be occupied by immediate family members and short term guest.. No rental of the rooms will be permitted. That this condition will be binding on any future owners of the property. Dated at South Burlington, Vermont this 6th day of November, 1989.
