Request for variance 1227 Dorset Street Findings of Fact, Conclusions of Law & Order This matter came before the South Burlington Zoning Board of Adjustment on January 25, 1999 by application of John Magnus, JAM Golf, Inc., for a variance to construct two (2) chimneys at a height of forty two feet six inches and a cupola at a height of forty-five feet (45) feet at the Vermont National Country Club, 1227 Dorset Street according to plans submitted. Dave Marshall and Steve Selin were in attendance for this appeal. The Board of Adjustment finds as follows: 1) Section 25.113 allows a maximum height of forty (40) feet for pitched -roof structures, base being average pre -construction grade. 2) Grades were adjusted in order to establish a minimum impact from the front yard along the street line. 3) Mechanical systems can not be treated for aesthetics without a variance. 4) Variance supports and enhances the appearance of the structure and for the neighborhood. 5) Irregular topography, height from the front portion of the structure is less than thirty-five (35) feet. 6) Other structures which are pre-existing exceed a height of forty-five (45) feet. 7) This structure will be lower than pre-existing structures.
