FINDINGS OF FACT AND DECISION
STATE OF VERMONT

Re: Findings of Fact, final plat application of David Dubrul for a boundary line adjustment between lots
three and four at 1001, Dorset Street (Old Dorset). The applicant has built a single family house
foundation in the side yard setback on lot four without permit and seeks approval to move the east west
boundary line between the developed lot and an undeveloped lot, lot three, to legitimize the foundation.
On the 15th of August, 2000, the South Burlington Development Review Board approved the final
plat application of David Dubrul under Section 204 of the South Burlington Subdivision Regulations
based on the following findings:
1. This project consists of a boundary line adjustment between lots three and four at 1001, Dorset Street
(Old Dorset). The applicant has built a single family house foundation in the side yard setback on
lot four without permit and seeks approval to move the east west boundary line between the
developed lot and an undeveloped lot, lot three, to legitimize the foundation.
2. The owner of record of this particular property is David Dubrul.
Boundary Line Adjustment: The proposed boundary line adjustment will move the east to west
boundary line between lot three and lot four. The previously approved boundary line was 231.28
feet in length. The new boundary line will be 236.04 feet in length. The rear, or western, boundary
line for lot three will increase from 48.30 feet to 65.76 feet. The rear, or western, boundary line of
lot four will decrease from 80 feet to 62.54 feet as a result of the proposed changes.
4. Lot size/Frontage: The proposed boundary line adjustment will result in the same acreage as
previously approved. Lot three will have 19,438 square feet and lot four will have 22,015 square feet
(minimum lot size for single family houses is 19,000 square feet). Frontages will not change.
5. Setbacks: The building has been delineated on the plans and meets the side yard setback
requirement.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves
the final plat application #SD-00-44 of David DuBrul to amend a previously approved seven (7)
lot subdivision. The amendment consists of a boundary line adjustment between lots #3 and 4,
941 and 961 Dorset Street, as depicted on a plat entitled "Final Plat Seven Lot Subdivision
Old Dorset Owned by: David Dubrul 1001 Dorset Street So. Burlington, Vermont,"
prepared by Vermont Land Surveyors, dated August 5, 1990, last revised 7/20/00,
with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2. Any change to the final plat plan shall require approval by the South Burlington
Development Review Board.
3. The final plat plan shall be recorded in the land records within 90 days or this approval is null
and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to
recording the final plat plan, the applicant shall submit a copy of the survey plat in digital
format. The format of the digital information shall require approval of the Director of Planning
& Zoning.
