FINDINGS OF FACT & DECISION
STATE OF VERMONT

CITY OF SOUTH BURLINGTON
Re: Findings of Fact, application of A&G Investments to change
four (4) buildings containing 22 units (buildings 10-13) into three
(3) buildings containing 12 units, Village at Dorset Park.
On the llth of August, 1992 the South Burlington Planning
Commission approved the request of A&G Investments for revised
final plat approval under Section 204 of the South Burlington
Subdivision Regulations based on the following findings:
1. The applicants are proposing to amend the approved 177 unit
planned residential development by reducing the overall density by
ten (10) units by reducing the number of multi -family units. This
project will now consist of 63 single family lots and 104 multi-
family units for a total of 167 units. The reduction in units is
achieved by changing four (4) buildings containing 22 units into
three (3) buildings containing 12 units. These buildings are
located along the northerly boundary. The Planning Commission
approved an amendment to this project on 4/2/92.
2. Access/circulation: Access and circulation will not change as
a result of this amendment. The Swift Street Extension/Dorset
Street intersection will be modified as part of the Dorset Street
Park development.
3. Coverage/setbacks: Building coverage will be 14.7% (maximum
allowed is 20%). Overall coverage will be 27.6% (maximum allowed
is 40%) . The new multi -family buildings will not meet the side
setback requirement of 20 feet. These buildings are proposed to
abut the pump station, therefore there is no problem with a 10 foot
setback at this location. The side yard of building #10 abuts a
proposed single family dwelling lot. This will result in a 20 foot
separation between the multi -family building and a future single
family home. The currently approved buildings have a side setback
of 15 - 17 feet. Since this project is a PUD, the Planning
Commission may approve a modification to the side yard setback
pursuant to Section 19.15 of the zoning regulations. All other
setback requirements will be met.
4. Landscaping: The landscaping requirement for the 80 multi-
family units is $52,700. The landscaping proposed amounts to
$41,666. a shortfall of $11,034. The 1988 approval required a
landscaping bond of $85,000 for the multi -family units. Records
indicate that a $19,000 bond was posted and subsequently released.
The remaining $66,000 amount should be reduced to $52,700.
5. Sewer: The sewer allocation of 4/2/92 was reduced to 81,150
gpd. The reduction of this project by 10 units would reduce the
allocation by 4500 gpd for a total allocation of 76,650 gpd.
6. Other:
--- note #5 on sheet 1 indicates that this proposal involves 18
buildings designated by shading, staff counts 22 shaded
buildings on the plan.
--- buildings are numbered 1 through 30 but there are only 28
buildings on the plan.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the revised final plat application of A&G
Investments to change four (4) buildings containing 22 units
(buildings 10-13) into three (3) buildings containing 12 units as
depicted on a 3 page set of plans, page one entitled, "The Village
at Dorset Park, a Planned Residential Development, South
Burlington, Vermont, Overall Site Plan", prepared by FitzPatrick-
Llewellyn, Inc. and dated February, 1992, last revised 7/l/92, with
the following stipulations:
1. All previous approvals and conditions which are not superseded
by this approval shall remain in effect.
2. The applicant shall post, prior to permit, a 3-year, $52,700
landscaping bond for the multi -family units.
3. The Planning Commission grants an $11,034 landscaping credit
for existing vegetation to remain. This vegetation exists in the
proposed common area within the multi -family portion of the
development.
4. The Planning Commission grants a revised total sewer allocation
of 76,650 gpd to account for ten less units in the development.
The applicant shall pay the appropriate sewer fee prior to issuance
of a zoning/building permit.
5. Notes on the plan shall be revised prior to recording to
correctly indicate a total of 28 multi -family buildings.
6. The revised final plat plans shall be recorded prior to
issuance of a zoning/building permit and within 90 days or this
approval is null and void. The revised final plat plans shall be
signed by the Planning ommiss,ion Chair or Clerk prior to
recording.
