HomeMy WebLinkAboutSD-06-16 - Decision - 0000 Brand Farm Drive#SD-06-16 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING & ZONING NIKIL PATEL — BRAND FARM DRIVE — BUILDING #18 FINAL PLAT APPLICATION #SD-06-16 FINDINGS OF FACT AND DECISION Nikil Patel, hereinafter referred to as the applicant is seeking final plat approval to amend a previously approved planned unit development consisting of 167 units. The amendment consists of approving the "as -built" location of building #18, 1801-1804 Brand Farm Drive. The Development Review Board held a public hearing on April 18, 2006. The applicant was present at the meeting. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking final plat approval to amend a previously approved planned unit development consisting of 167 units. The amendment consists of approving the "as - built" location of building #18, 1801-1804 Brand Farm Drive. 2. The building, which is the subject of this application, was constructed in a slightly different location than where it was approved. The approved location and orientation is shown on Exhibit A and is labeled building #20. It is now known as building #18. 3. The request is for approval of it's "as -built" location shown on the proposed plan 4. The plan submitted is entitled, "Village @ Dorset Park South Burlington Vermont Location of Building 18", prepared by Llewellyn -Howley, Inc., dated 3/3/06. / DECISION C Motion by ��! �� �C{/rl1/%J� seconded by� to approve Final Plat Application #SD-06-16 of Nikil Patel, subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect, except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. - 1 - #SD-06-16 3. Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. 4. The final plat plan shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording.
