HomeMy WebLinkAboutSP-94-0000 - Decision - 0600 Swift StreetFINDINGS OF FACT & DECISION STATE OF VERMONT S7 - q� OO o D COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of the City of South Burlington for construction of a 35,000 square foot indoor ice rink including a 5000 square foot mezzanine with 500-600 seats, 1000 Dorset Street. On the 20th of December, 1994, the South Burlington Planning Commission approved the request of the City of South Burlington for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the construction of a 35,000 square foot indoor ice rink including a 5,000 square foot mezzanine with 500-600 seats at the Dorset Street Park. The first phase of the park was approved on 5/26/92. 2. The Dorset Street Park located at 1000 Dorset Street lies within the Municipal District. It is bounded on the north by I-89, on the east by the Village at Dorset Park residential development, on the south by other undeveloped park land and on the west by a single family residence and Dorset Street. 3. Access/circulation: Access to the park is via a 55 foot curb cut on Swift Street Extension. The first 65 feet of the access has a median dividing ingress and egress traffic. Each of the lanes are 16 feet in width. The access road then narrows to 24 feet through out the remainder of the park. No change proposed. Circulation is adequate. 4. Coverage/setbacks: Building coverage is 2% (maximum allowed is 30%). Overall coverage is 10.9% (maximum allowed is 70%). Front yard coverage along Dorset Street is 0% and front yard coverage along Swift Street Extension is 5.1% (maximum allowed is 30%). 5. Parking: The site currently has 143 spaces including eight (8) handicapped spaces (99 paved and 44 gravel). This proposal will add 55 spaces including two (2) handicapped spaces for a total of 198 spaces available. Existing facilities require 92 spaces. This leaves 106 spaces for the sole use of the rink in the summer daytime hours. There are no minimum parking standards for an ice rink in the zoning regulations. It was staff's position that the amount of parking available will be adequate for the athletic fields and the ice rink. 6. Landscaping: The minimum landscaping requirement, based on building costs, is $22,000. This proposal includes $6955 worth of landscaping which when you include landscaping planted with the construction of the athletic fields meets the minimum requirement. recommended that at least a portion of the Pine buffer be planted along the easterly boundary. 7. Sewer: Sewer allocation needed for this project is 3000 gpd. 8. Lighting: Exterior lighting was approved as part of the 5/26/92 approval. Details of building mounted lights should be submitted and approved by the City Planner prior to permit. 9. Building height: Building elevations should be submitted prior to permit issuance to verify conformance with height limitations. 10. Other: Plan should be revised to show dumpster and HVAC locations. These devices should be well screened from the neighborhood. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of the City of South Burlington for construction of a 35,000 square foot indoor ice rink including a 5,000 square foot mezzanine with 500 - 600 seats, Dorset Street Park, 1000 Dorset Street, as depicted on a three (3) page set of plans, page 1 entitled "City of South Burlington, Dorset Street Park, Revised Master Plan for Ice Rink", prepared by Engineering Ventures, Inc., dated December 12, 1994, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. -e 2. A sewer allocation of 3000 gpd is granted. 3. All exterior lighting shall consist of downcasting, shielded fixtures. The applicant shall submit details of building mounted lights for approval by the City Planner prior to issuance of a zoning permit. 4. Applicant shall submit building elevations to the City Planner prior to issuance of a zoning permit to verify compliance with the height limitations. 5. The plan shall be revised prior to issuance of a zoning permit to show the changes listed below and shall require approval of the City Planner. Three (3) copies of the approved revised plan shall be submitted to the City Planner prior to permit issuance. a) The site plan shall be revised to show dumpster and HVAC locations. These devices shall be well screened from the neighborhood. 2 b) The master landscape plan shall be revised to show the new locations of the ice rink and gymnasium and new landscaping which is proposed. 6. A portion of the proposed Pine buffer along the easterly boundary shall be planted in conjunction with the construction of the ice rink. The portion to be planted shall be determined by the ` City Planner prior to issuance of a zoning permit. 7. The proposed location of the gravel fire lane and fire hydrant shall be approved by the Fire Chief prior to issuance of a zoning permit. If the Fire Chief recommends that the location of either facility be revised, the plans shall be revised accordingly. 8. The proposed drainage improvements, and sewer and water services to the building, shall be approved by the City Engineer l/ prior to issuance of a zoning permit. 9. The applicant shall obtain a zoning permit within six (6) months or this approval is null and void.,,, 10. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to use of the ice rink. 11.
