HomeMy WebLinkAboutVR-95-0000 - Decision - 0600 Swift StreetSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON v DECISION AND FINDING OF FACT On the 24th day of April, 1995 the South Burlington Zoning Board of Adjustment heard testimony regarding the appeal of The City of South Burlington, Bruce O'Neill, agent, Recreation Director for the City. This hearing was also attended by Albert Audette from the Highway Department. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The applicant represents the City of South Burlington regarding the development of Dorset Park. 2) Included within the development is a proposal to construct baseball dugouts along the first and third base line. 3) Two of the proposed dugouts are to be constructed within the required front yard. The required front yard being 50 feet from the property line. 4) Structures do not have permanent foundations and could be moved. 5) Other facilities planned for the park which created a problem when designing the layout of the ball field. 6) No other location available along Dorset Street to construct proposed dugouts. Conclusions 1) Section 4.20 requires a setback of fifty (50) feet from the planned right-of-way. The proposed setbacks are 28 feet for the little league ball field and thirty four (34) feet for the larger ball field. 2) The layout of the ball fields and the safety factor are the main reason for the location of the proposed dugouts. 3) The proposed structures are defined as land development because of their size. 1 4) Other facilities are planned for the "park", physical circumstances prevent any other location for the proposed dugouts. 5) Variance is in accordance to existing land use and does not alter the character of the area. 6) By reason of omission, no provisions within bylaws to allow for accessory use structures. Based upon the findings and conclusions setforth above, the Zoning Board of Adjustment hereby grants the applicants request to construct two baseball dugouts, one 7'x 24' and the other 7'x 32' within the required gdb�pw at, Dorset Park.
