FINDINGS OF FACT AND DECISION

Re: Findings of Fact, site plan application of the Dorset Park Skating Association, Inc. to construct a
new ice skating rink 140 feet by 290 feet north of the existing Cairns Arena at Dorset Park
On the 16th of May, 2000, the South Burlington Development Review Board approved the site plan
application of the Dorset Park Skating Association, Inc. under Section 26.10 of the South Burlington
Zoning Regulations based on the following findings:
1. This project consists of constructing a new ice skating rink 140 feet by 290 feet north of the existing
Cairns Arena at Dorset Park. The first phase of this park was originally approved by the Planning
Commission on May 26, 1992 and then approved amendments on December 12, 1994. The existing
skating rink was approved by the Planning Commission on December 12, 1994. This property is located
in the Park and Recreation District.
2. Dorset Park is located at 1000 Dorset Street lies within the Parks and Recreation District. It is bounded
on the north by I-89, on the east by the Village at Dorset Park residential development, on the south by
other undeveloped park land, and on the west by a single family residence and Dorset Street.
3. Access: A 35-foot curb cut provides access from Swift Street Extension. The first 65 feet of the access
has a median dividing ingress and egress traffic. Each of the lanes are 16 feet in width. The access road
then narrows to 27 feet through the remainder of the park. Circulation on the site is adequate.
4. Coverage/Setbacks: Building coverage is presently 1.43% and total coverage is 5.05. Proposed building
coverage is 3.32% (maximum of 15%) and total coverage will be 8.46% (maximum of 25%). Front yard
coverage for Dorset Street will remain unchanged at 0%. Swift Street front yard coverage will also remain
unchanged at 5.1% (maximum 30%). All setbacks appear to be met.
5. Parking: There are currently 198 parking spaces provided at the park, of which 10 are designated as
handicapped. The applicant has proposed adding 71 parking spaces, of which three spaces will be
designated as handicapped, for a total of 269 parking spaces. Of the current parking, 106 parking spaces
have been designated for the current rink.
6. Sewer: The applicant has requested an additional sewer allocation of 1,000 g.p.d.
7. Li tin : The applicant has submitted cut sheets for the Director of Planning and Zoning to review.
The applicant should submit additional information indicating the wattage of each fixture. All lights must
be downcasting and shielded.
8. Building Height: The building will be a flat roofed structure that will rise to a height of 34.5 feet.
9. Traffic: The intersection of Swift Street Extension and Dorset Street was designed to accommodate a
full build -out of the park and therefore no additional improvements are required.
10. Landscaping: The minimum landscaping requirement is $30,500. The applicant has proposed
$15,133 worth new of landscaping and is requesting a waiver for $15,367. The applicant has proposed
to relocate 26 white pine and 4 pin oak. The site is already well landscaped.
11. Dumpster: A screened dumpster storage area is being provided.
12.Other: The applicant should revise the master plan approved on May 26, 1992 to reflect the proposed
changes to the park.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves the site
plan application #SP-00-24 of the Dorset Park Skating Association, Inc. to construct a new ice skating rink
140 feet by 290 feet north of the existing Cairns Arena at Dorset Park, as depicted on a set of plans the
first page of which is entitled, "South Burlington Rink Dorset Street South Burlington, Vermont",
prepared by Truex Cullins & Partners Architects and Engineering Ventures, dated 5/12/00, with the
following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect.
2. The applicant shall consult with the Fire Department on the location of any proposed fire hydrants and
submit revised plans prior to permit issuance, if required.
3. The structure shall be sprinklered and have a fire alarm approved by the Fire Chief
4. The structure shall have a refrigerant monitoring system tied to the fire alarm that must notify all
occupants of a leak. The applicant shall consult with the Fire Department on the type of alarm.
5. The Development Review Board approves an additional sewer allocation of 1,000 gpd.
6. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond
the property line. Any change in lighting shall be approved by the Director prior to installation.

7. The applicant shall post a $30,500 landscape bond for street trees prior to issuance of a permit. These
bonds shall remain in effect for three (3) years to assure that the landscaping has taken root and has a good
chance of surviving.
8. Pursuant to Section 26.105(a) of the Zoning Regulations, a landscaping credit in the amount of $15,367
is granted for existing trees on the site.
9. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the
Development Review Board estimates that the additional skating rink will generate zero (0) additional
vehicle trip ends during the P.M. peak hour.
10. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the
Zoning Regulations or this approval is null and void.
11. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior
to occupancy of the proposed structure.
12. Any change to the site plan shall require approval of the South Burlington Development Review Board.
