HomeMy WebLinkAboutSP-01-21 - Decision - 0600 Swift Street (2)#SP-01-21 FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Dorset Park Skating Association, Inc. to amend Site Plan Permit #SP-00-24 for Dorset Park Skating Rink Phase II, issued June 6, 2000, to reduce the square footage of the proposed building with a connecting hallway instead of a connecting lounge area between the new and existing rinks, at Dorset Park, 1000 Dorset Street, South Burlington, VT 05403. The Owner of Record of this property is the City of South Burlington. On the 18th day of April, 2001, the Director of Planning and Zoning approved the request of Dorset Park Skating Association, Inc. for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This amendment consists of reducing the total square footage of the proposed building and connector from 40,000 square feet to 33,000 square feet. Changes are proposed to the front and rear elevations of the building to reduce the total square footage. A connecting hallway would be constructed instead of a larger connecting area with lounge on the front side of the building. 2. The Site Plan permit to be amended (#SP-00-24) approved a new ice skating rink 140 feet by 290 feet in size, north of the existing Cairns Arena at Dorset Park. The first phase of this park was originally approved by the Planning Commission on May 26, 1992, and amended December 12, 1994. The existing skating rink (Cairns Arena) was first approved by the Planning Commission on December 12, 1994. 3. The record owner of the property is the City of South Burlington. This property is located at 1000 Dorset Street and is within the Parks and Recreation District. It is bounded on the north by Interstate 89, on the east by the Village at Dorset Park residential development, on the south by other undeveloped park land, and on the west by a single family residence and Dorset Street. 4. Access/circulation: Access and circulation will not be changing as a result of this amendment. 5. Coverage/setbacks: This amendment will result in a minor decrease in the total building coverage on the site from the 3.0% approved under #SP-00-24, and a minor decrease in the overall coverage from the 8.0% approved under #SP-00-24. These are well within the 15% and 25% limits for the District. All setbacks will be met under the revised plan, 6. Park : No changes to the approved parking plan are proposed. 7. Sewer: No changes to the approved wastewater allocation of 1,000 gallons per day are proposed. 8. Li—ghting: No changes to the approved lighting fixtures are proposed. 9. Building height: No changes to building roofline or height are proposed. 10. Traffic: No changes that would result in any additional trip ends or other traffic impacts are proposed. 11. Landscaping: The minimum landscaping requirement for this project is $30,500. The Site Plan application submitted on April 18, 2001 indicates a landscaping cost estimate of $40,000, which exceeds the amount approved in Condition 7 of #SP-00-24. No changes to the landscaping plan are proposed as part of this amendment. 12. Dumpster: A screened dumpster storage area is provided. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Director of Planning and Zoning approves the site plan application of Dorset Park Skating Association, Inc. to amend Site Plan Permit #SP-00-24 for Dorset Park Skating Rink Phase II, issued June 6, 2000, to reduce the square footage of the proposed building with a connecting hallway instead of a connecting lounge area between the new and existing rinks, at Dorset Park, 1000 Dorset Street, South Burlington, as depicted on a plan entitled "Utility and Grading Plan, Dorset Park Skating Rink Phase II, South Burlington, Vermont," prepared by Truex Cullins & Partners and Engineering Ventures and dated "Issued for Permit Review 4/6/01," with the following stipulations: 1) All previous approvals and stipulations, which are not superseded by this approval, shall remain in effect. 2) Any change to the site plan shall require approval by the South Burlington Development Review Board. 3) Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in exterior lighting shall require approval of the Director of Planning & Zoning prior to installation. 4) No changes to parking, landscaping or access and circulation shall be permitted without prior approval. 5) The applicant shall post a landscaping bond of at least $30,500 for street trees prior to issuance of a zoning permit. This bond shall remain in effect for three (3) years to ensure that the landscaping has taken root and has a good chance of surviving. 6) A zoning permit shall be obtained within six (6) months or this approval pursuant to Section 27.302 of the Zoning Regulations, or this approval shall be null and void. 7) A Certificate of Occupancy/Compliance shall be obtained from the Administrative Officer prior to occupancy of the proposed structure. aNAA�6�Wei- Juli Beth Hoover, Director Sout Burlington Department of Planning and Zoning �I• I&•DI Date Please Note: You have the right to appeal this decision to the Vermont Environmental Court, pursuant to 24 V.S.A. § 4471 and V.R.C.P. 76, in writing, within 30 days of the date this decision is issued.
