HomeMy WebLinkAboutSP-02-26 - Decision - 0600 Swift Street#SP-02-26 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON RE: Findings of Fact, site plan application #SP-02-26 of the City of South Burlington to amend previously approved site plan #SP-01-21 for Dorset Park Skating Rink Phase II, to relocate a sidewalk, add mechanical equipment, and add exterior lighting over entry doors, at Dorset Park,1000 Dorset Street, South Burlington, VT 05403. On the 9t' day of April, the Director of Planning & Zoning approved the site plan application of the City of South Burlington under Section 26.10(b) of the South Burlington Zoning Regulations, based on the following findings: 1. This project consists of a site plan application to amend previously approved site plan #SP-01-21 for Dorset Park Skating Rink Phase II, to relocate a sidewalk and mechanical equipment at the new Dorset Park Skating Rink, Dorset Park,1000 Dorset Street. The proposed changes would (1) relocate a sidewalk currently approved to extend from the west entrance of the building to the west parking area, and instead extend the sidewalk the length of the west facade of the building to connect to the north parking area; (2) add mechanical equipment on the southwest side of the building; (3) create a fenced enclosure area housing mechanical equipment at the northeast corner of the building; and (4) add exterior lighting consisting of one light over each single door, and a triple light over the double door on the west entrance to the rink. 2. The owner of record is the City of South Burlington. 3. The Site Plan permit to be amended in this decision amended earlier Site Plan Permit #SP-00-24, which approved a new 140 by 290 foot ice skating rink north of the Cairns Arena at Dorset Park. The first phase of Dorset Park and the Cairns Arena were originally approved by the Planning Commission on December 12,1994. 4. This property is located within the Park and Recreation District. It is bounded to the north by Interstate 89, to the east by the Village at Dorset Park residential development, to the south by City -owned park land, and to the west by single family residences on Dorset Street. 5. Access or parking: No changes to access or parking will result. #SP-02-26 6. Circulation: The proposed amendment will relocate a sidewalk that had been approved to extend from the west entrance of the rink to the west parking area. The proposal would instead provide a sidewalk extending from the west entrance along the west fagade of the building and connecting to the north parking area. 7. Coverage/setbacks: The proposed sidewalk and mechanical equipment will add a combined total of 1,106 SF of impervious coverage to the site. This results in a negligible increase in overall site coverage (from 8.0% to 8.03%). This is well below the 25% limit for the district. No change to building coverage will result. All setbacks are met. 8. Lighting: The proposed amendment will add a single light fixture over each single door entry, and a triple light fixture over the double door entry on the west side of the building. 9. Landscaping: No changes affecting overall landscaping are proposed and no additional bond is required. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Director of Planning and Zoning approves site plan application #SP-02-26 of the City of South Burlington to amend previously approved site plan #SP-01-21 to relocate a sidewalk and create a fenced enclosure housing mechanical equipment at Dorset Park Skating Rink, Dorset Park,100 Dorset Street. The amendment is depicted on a plan entitled "Proposed Layout Plan C.14," dated 3/15/02 and prepared by Truex Cullins Associates, with the following stipulations: 1. All previous approvals and stipulations that are not superseded by this approval shall remain in effect. 2. Prior to making any change to the lighting approved in this amendment, cut sheets for all fixtures shall be submitted to and approved by the Director of Planning & Zoning. 3. The applicant shall obtain a zoning permit within six (6) months of the date of this decision, pursuant to Section 27.302 of the Zoning Regulations, or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer. #SP-02-26 5. Any change to the approved site plan shall require approval of the South Burlington Development Review Board.
