Findings of Fact. Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on May 24. 1999 by application of John and
Martha Hochl seeking a variance from Section 26.00 Noncomplying structures and Section 25.00 Dimensional
requirements of the South Burlington Zoning Regulations. Request is for permission to construct a 8' x 70' wrap -around
porch to within forty-five (45) feet of the required front yard located at 900 Dorset Street. The Board of Adjustment finds
as follows:
1) This property located at 900 Dorset Street lies within the SEQ District.
2) The required front setback requirement is 50 feet from the planned r.o.w. Section 25.101 of the zoning regulations
indicates that the r.o.w. is planned to be widened from 66 feet to 100 feet. This is an increase of 34 feet or 17 feet on
either side of the road. The setback requirement from the existing r.o.w. is 67 feet and the proposed porch would be 45
feet from the existing r.o.w.
3) The existing 8' x 14' porch on the front of the house would be removed and replaced with an 8' x 70' wrap -around
porch. A 38 foot portion of the 70 foot length would be along the front of the house.
4) The proposal would not result in any additional encroachment into the setback area. The proposed porch would not be
any closer to the front property line than the existing porch.
5) This porch is needed to protect the house from the wind because this portion of the house can't be insulated.
6) The existing house pre -dates the zoning regulations and is a pre-existing noncomplying structure.
ORDER
The variance to construct the 8' x 70' wrap -around porch to within 45 feet of the proposed right-of-way at 900 Dorset
Street is hereby GRANTED ,, rr�
