HomeMy WebLinkAboutSP-98-0000 - Decision - 0899 Dorset StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Faith United Methodist Church to construct a 8250 square foot addition to a 7500 square foot church for a total square footage of 15,750 square feet, 899 Dorset Street. On the 8 h day of September, 1998, the South Burlington Planning Commission approved the request of Faith United Methodist Church for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of constructing a 8250 square foot addition to a 7500 square foot church for a total square footage of 15,750 square feet. The ZBA on 9/14/98 will consider a request from the applicant for a conditional use permit. 2. This property located at 899 Dorset Street lies within the R2 District. It is bounded on the east by Dorset Street, on the north by undeveloped land, on the south by a single family dwelling and the Indian Creek residential development, and on the west by the Indian Creek residential development. 3. Access/circulation: Access is provided by two (2) curb cuts on Dorset Street. The northerly curb cut is 44 feet wide and the southerly curb cut is 32 feet wide. No changes were proposed. Circulation on the site is adequate. 4. Coverage/setbacks: Building coverage is 6% (maximum allowed is 20%). Overall coverage is 28% (maximum allowed is 40%). Front yard coverage is 30% (maximum allowed is 30%). Setback requirements are met. 5. Parking-: A total of 128 parking spaces are required and 101 spaces (51 gravel spaces and 50 paved spaces) are provided including four (4) handicapped spaces and a bike rack. This represents a 27 space or 2 1. 1 % shortfall. The applicant indicated that not all the seats in the building would be used at the same time so therefore parking is adequate. The paved lot should be striped as shown on the plan. 6. Landscaping The minimum landscaping requirement, based on building costs, is $14,720 which is not being met. The applicant sought a credit for the entire landscaping requirement. It was the Commission's opinion that the applicant should plant approximately $3000 - 4000 of additional landscaping. The plan should be revised to show this additional landscaping. 7. Traffic: ITE estimates that the current church generates 5.36 vehicle trip ends (vte's) during the P.M. peak hour and with the expansion to generate 9.14 vte's for a 3.78 vte increase. The applicant was made aware that the road impact fee is $854.28. 8. Sewer: The current sewer allocation is 2244 gpd. No additional allocation is needed. 9. C.O. District: There is a C.O. District along a minor stream westerly of the proposed addition. The addition will not impact this C.O. District. 10. Dumpster: There will be no dumpster storage area on the property. 11. Lighting: Exterior lighting consists of three (3) 300 watt incandescent lamps mounted on poles along the front of the building. two (2) 15 watt incandescent lights mounted on eight (8) foot poles lighting the stairs to the upper parking lot. one (1) 150 watt flood light on the bell tower. This light should be removed or replaced with a downcasting shielded fixture approved by the Director of Planning & Zoning. No additional exterior lighting proposed. 12. Sidewalk: Rather than the applicant constructing a sidewalk in front of the property, staff recommended that the applicant contribute $15 per linear frontage foot for the City to construct a sidewalk along the property's frontage. The plan should be revised to show this sidewalk along the property's frontage in a location approved by the Superintendent of Public Works. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Faith United Methodist Church to construct a 8250 square foot addition to a 7500 square foot church for a total square footage of 15,750, 899 Dorset Street, as depicted on a two (2) page set of plans, page one (1) entitled, "Faith United Methodist Church Proposed Addition Site Plan South Burlington, Vermont," prepared by Civil Engineering Associates, Inc., dated June, 1998, last revised on 8/25/98, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. For the purpose of calculating road impact fees under the South Burlington Impact fee Ordinance, the Planning Commission estimates that the expansion will generate 3.78 additional vehicle trip ends during the P.M. peak hour. 2 3. Any new exterior lighting or changes to existing exterior lighting shall consist of downcasting shielded fixtures. Any change to approved lights shall require approval of the Director of Planning & Zoning prior to installation. The flood light on the bell tower shall be removed or replaced with a downcasting shielded fixture approved by the Director of Planning & Zoning. 4. Prior to issuance of a zoning permit, the applicant shall revise the plan to show landscaping in front of the addition and several street trees along Dorset Street. 5. Pursuant to Section 26.105(a) of the zoning regulations, the Planning Commission grants a landscaping credit of approximately $10,000 - 11,000 for existing trees on the site. 6. Prior to issuance of a zoning permit, the applicant shall post a $4,000 landscape bond. The bond shall remain in effect for three (3) years to assure that the new landscaping takes root and survives. 7. Pursuant to Section 26.256(b) of the zoning regulations, the Planning Commission approves a 27 space or 2 1. 1 % parking shortfall. It is the Commission's opinion that the existing lot spaces will be adequate since all potential seats will not be used at the same time. 8. The applicant shall fulfill the obligation to construct a sidewalk along the Dorset Street frontage by paying to the City the sum of $4,500 ($15 per foot of frontage) on or before one year from the date of site plan approval which funds shall be used by the City to construct sidewalk improvements along Dorset Street. The City shall construct the sidewalk improvements along Dorset Street within one year of receipt of the funds. If City fails to construct such sidewalk improvements within one year, the funds shall be returned to the then property owners. 9. The plan shall be revised to show the changes below and shall require approval of the Director of Planning & Zoning. Three (3) copies of the approved revised plan shall be submitted to the Director of Planning & Zoning prior to permit issuance. a) The site plan shall be revised to show a sidewalk along the property's frontage in a location approved by the Superintendent of Public Works. 10. The paved parking lot shall be striped as shown on the approved plan prior to occupancy of the addition. 11. The pump station shall not use an audio alarm. 12. The valve manhole shall include a tee valve and a length of pipe for connecting an emergency pump. 13. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 3 14. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the expanded area. 15.
