FINDINGS OF FACT & DECISION

Re: Findings of Fact, application of Faith United Methodist Church to amend a previously approved
plan for construction of a 8250 square foot addition to a 7500 square foot church for a total square
footage of 15,750 square feet, 899 Dorset Street. The amendment consists of modifications to the
building footprint and landscaping changes.

On the
� day of November, 1999, the Director of Planning & Zoning approved the request of
Faith United Methodist Church for site plan review under Section 26.10 of the South Burlington
Zoning Regulations based on the following findings:
1. This application is to amend a previously approved plan for construction of 8250 square foot
addition to a 7500 square foot church for a total square footage of 15,750 square feet. The
amendment consists of modifications to the building footprint and landscaping changes. The only
issues affected by this application include landscaping, coverage and impacts on the Conservation and
Open Space District.
2. This property located at 899 Dorset Street lies within the R2 District. It is bounded on the east
by Dorset Street, on the north by undeveloped land, on the south by a single family dwelling and the
Indian Creek residential development, and on the west by the Indian Creek residential development.
3. The record owner of the property is Faith United Methodist Church.
4. Coverage/setbacks: Building coverage is 6% (maximum allowed is 20%). Overall coverage is
28.5% (maximum allowed is 40%). Front yard coverage is 30% (maximum allowed is 30%).
Setback requirements are met.
5. C.O. District: During construction of the addition, trees, vegetation and earth were removed from
the C.O. District adjoining the addition in violation of the zoning regulations. This site plan includes
a reclamation plan for the C.O. District. The original contours of the land in the C.O. District will
be reclaimed. A mixture of trees and shrubs will be planted in the area where landscaping was
removed. A retaining wall will be installed along the edge of the C.O. District in order to retain the
original contours of the C.O. District land.
6. Landscaping: The Planning Commission's 9/8/99 approval required a minimum landscaping
requirement of $4,000. The applicant is proposing to modify the landscaping plan by planting smaller
maples along Dorset Street and by planting landscaping in the C.O. District area. The proposed plan
meets the landscaping requirement. The size of the maples along Dorset Street should be increased
to 2 1/2" - 3" caliper.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Director of Planning & Zoning approves
the site plan application of Faith United Methodist Church to amend a previously approved plan for
construction of a 8250 square foot addition to a 7500 square foot church for a total square footage
of 15,750, 899 Dorset Street. The amendment consists of modifications to the building footprint and
landscaping changes as depicted on a plan, entitled, "Faith United Methodist Church Proposed
Addition Site Plan South Burlington, Vermont," prepared by Civil Engineering Associates, Inc., dated
January, 1999 last revised on 10/27/99, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2. The plan shall be revised to show the changes below and shall require approval of the Director
of Planning & Zoning. Three (3) copies of the approved revised plan shall be submitted to the
Director of Planning & Zoning prior to permit issuance.
a) The site plan shall be revised to show the size of maple trees to be planted along Dorset
Street to be a minimum 2 1/2" - 3" caliper.
b) The site plan shall show the storage shed on the south side of the new addition.
3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the
zoning regulations or this approval is null and void.
4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer
prior to the use of the e� panded area.
5. Any change to the site plan shall require approval by the South Burlington Planning Commission.
