HomeMy WebLinkAboutSD-05-77 - Decision - 0895 Dorset StreetCITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING HOMESTEAD DESIGN, INC — PLANNED UNIT DEVELOPMENT SONGBIRD ROAD FINAL PLAT APPLICATION #SD-05-77 Homestead Design, Inc, hereafter referred to as the applicant, is seeking to amend a previously approved planned unit development consisting of 89-multi-family units in 24 buildings. The amendment consists of revising the landscaped berms by increasing the height from three (3) feet to six (6) feet, Songbird Road. The Development Review Board held a public hearing on September 20, 2005. Bill Nedde represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking to amend a previously approved planned unit development consisting of 89-multi-family units in 24 buildings. The amendment consists of revising the landscaped berms by increasing the height from three (3) feet to six (6) feet, Songbird Road. 2. The owner of record of the subject property is Homestead Design, Inc. 3. The subject property is located in the Residential 2 (R2) Zoning District. 4. The plans submitted is entitled, "Site Plan Heatherfield Dorset & Spear Streets South Burlington, Vermont", prepared by Krebs & Lansing Consulting Engineers, Inc., dated May 14, 2003, last revised on 8/19/05. Rear Setback 5 ft. �>5 ft. 4 zoning compliance 4 waiver granted pursuant to Section 15.02(A)(3) of the Land Development Regulations Landscaped Berms The applicant is proposing to increase the height of the landscaped berms located near Units I, J, K, and L from 3 ft to 6 ft. The applicant argues that this will provide better screening from Interstates 1-89 and 1-189. This proposal has no negative impact on the project as proposed and approved in August, 2004. Furthermore, the change in the height of the berms does not change any previous staff comments regarding site plan or planned unit development review of this project. DECISION Motion by Larry Kupferman, seconded by Chuck Bolton, to approve Final Plat Application #SD-05-77 of Homestead Design Inc., subject to the following conditions: 1) All previous approvals and stipulations shall remain in full effect, except as amended herein. 2) This project shall be completed as shown on the plat submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3) The plat plans shall be revised to show the changes below and shall require approval of the Administrative Officer. Four (4) copies of the approved revised plans shall be submitted to the Administrative Officer prior to recording. a) The landscaping plans shall be revised to show the revised berms. 4) Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. -2- 5) The final plat plan (Sheet SP-5) shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording.
