HomeMy WebLinkAboutSD-06-98 - Decision - 0895 Dorset Street#SD-06-98 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING HOMESTEAD DESIGN, INC. - PLANNED UNIT DEVELOPMENT FINAL PLAT APPLICATION #SD-06-98 FINDINGS OF FACT AND DECISION Homestead Design, Inc, hereafter referred to as the applicant, is seeking re -approval to amend a previously approved planned unit development consisting of 89-multi-family units in 24 buildings. The amendment consists of: 1) a minor relocation of building M, 2) minor site modifications to sidewalks, patios, etc., and 3) landscaping modifications, Songbird Road. The Development Review Board held a public hearing on December 5, 2006. Bill Nedde represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes and decides the following: FINDINGS OF FACT 1. The applicant is seeking re -approval to amend a previously approved planned unit development consisting of 89-multi-family units in 24 buildings. The amendment consists of: 1) a minor relocation of building M, 2) minor site modifications to sidewalks, patios, etc., and 3) landscaping modifications, Songbird Road. 2. The project received final plat approval on August 9, 2004 and approval for the amendments above on May 2, 2006. The applicant did not record the mylar within the required 6 month period and thus must seek re -approval from the Development Review Board. 3. The owner of record of the subject property is Homestead Design, Inc. 4. The subject property is located in the Residential 2 (R2) Zoning District. 5. The plans submitted with this application consist of a 12 page set of plans, page one (1) entitled, "Site Plan Heatherfield Dorset & Spear Streets South Burlington, Vermont", prepared by Krebs & Lansing Consulting Engineers, Inc., dated May 14, 2003, last revised on 3/24/06. - 1 - #SD-06-98 ZONING DISTRICT & DIMENSIONAL REQUIREMENTS- Lot 5 R2 Zoning District Required Proposed Min. Rear Setback L 5 ft. >5 ft. zoning compliance The Board finds no problems with the following portions of the proposal: ■ Unit M rotated slightly and regraded ■ Deck off Unit N48 reconfigured ■ Patio widths on units K,L,J and I enlarged by 2' in width • Sidewalk moved westerly in the island of Woodthrust Circle ■ Landscape retaining wall added behind Unit L With respect to the applicant's request to condition the approval so as to allow the substitution of like plantings without additional approvals, the applicant shall be allowed this substitution in consultation with the South Burlington City Arborist and the Planning Staff, but without further review by the Development Review Board. DECISION Motionbybrkole Qlu seconded by r4ac h to approve Final Plat Application # D-66-98 of Homestead besign, Inc., subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect, except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall be allowed to substitute like plantings with the approval of the South Burlington City Arborist and in consultation with the City's Planning Staff. No review by the Development Review Board shall be required for the substitution of like plantings. Prior to making the substitutions, the applicant shall provide the Planning Staff with written confirmation from the City Arborist for the approval of the substitution. -2- #SD-06-98 4. The applicant shall provide the City Arborist the name of the species being substituted for "Metzam" London Plane prior to recording the final plat plan. 5. The plat plans shall be revised to show the changes below and shall require approval of the Administrative Officer. Three (3) copies of the approved revised plans shall be submitted to the Administrative Officer prior to recording. a. The landscaping plans shall be revised to remove all Green Ash trees whether they are located in or out of the street right-of-way. b. The landscape plan shall be revised to remove the reference to a project sign proposed for the median at the Songbird Road/Spear Street intersection. 6. Any changes to the final plat plan shall require approval of the South Burlington Department of Planning and Zoning. 7. The final plat plan (sheets SP-5 & SP-6) shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording.
