FINAL PLAT APPLICATION #SD-07-03
FINDINGS OF FACT AND DECISION
Homestead Design, Inc, hereafter referred to as the applicant, is seeking to amend a previously
approved planned unit development consisting of 89 multi -family units in 24 buildings. The
amendment consists of replacing a six (6) unit multi -family building (Unit A) with three (3) two-
family dwellings, Songbird Road. The Development Review Board held a public hearing on
February 6, 2007. Tim Blais represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking to amend a previously approved planned unit
development consisting of 89 multi -family units in 24 buildings. The amendment
consists of replacing a six (6) unit multi -family building (Unit A) with three (3) two-
family dwellings, Songbird Road.
2. The owner of record of the subject property is Homestead Design, Inc.
3. The subject property is located in the Residential 2 (R2) Zoning District.
4. The plans submitted consist of a four (4) page set of plans, page one (1) entitled,
"Overall Site Plan Heatherfield Dorset & Spear Streets South Burlington,
Vermont", prepared by Krebs & Lansing Consulting Engineers, Inc., dated
5/14/03, last revised on 1/5/07.

There are no issues with the applicant's proposal to replace the six -unit building with three
(3) two-family dwellings. The changes in impervious coverages remain well below the
thresholds for the district. The setbacks are being met. Appropriate parking spaces are
being provided.
This new configuration will require a named, private road. The applicant has submitted a
proposal to the Planning Commission and a name has been approved. The plans should
be updated to reflect the new name.
The applicant has also proposed some minor changes to the traffic calming devices,
including the addition of a speed hump. They have reviewed the proposed changes with
the Director of Public Works who has stated that they are acceptable.

to approve Final Plat Application #SD-07-03 of Homestead Design, Inc.,�subject to the
following conditions:
1) All previous approvals and stipulations shall remain in full effect, except as amended
herein.
2) This project shall be completed as shown on the plat submitted by the applicant and
on file in the South Burlington Department of Planning of Zoning.
3) The plans shall be revised to show the changes below and shall require approval of
the Administrative Officer. Three (3) copies of the approved revised plans shall be
submitted to the Administrative Officer prior to recording.
a) The plans shall be revised to label the new private street as "Kingfisher Court".
b) The plans shall be revised to note the Enhanced 9-1-1 addresses for the new
units.
4) Any change to the final plat plan shall require approval of the South Burlington
Development Review Board.
5) The final plat plan (sheet SP-1) shall be recorded in the land records within 180 days
or this approval is null and void. The plan shall be signed by the Board Chair or
Clerk prior to recording. Prior to recording the final plat plan, the applicant shall
submit a copy of the survey plat in digital format. The format of the digital information
shall require approval of the Director of Planning and Zoning.
