HomeMy WebLinkAboutSD-99-62 - Decision - 0701 Dorset StreetFINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application of Ashbrook Park Homeowner's Association to amend a previously approved 17 unit planned unit development consisting of three buildings, 701 Dorset Street. On the 21' day of September, 1999, the South Burlington Development Review Board approved the revised final plat application of Ashbrook Homeowner's Association to amend a previously approved 17 unit planned unit development consisting of three buildings under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending a 17 unit planned unit development previously approved on October 13, 1981 consisting of three (3) buildings. The amendment consists of creating separate lots under the footprint of each unit. Staff discovered that each unit was being sold with the land underneath without subdivision approval. The Association was contacted and requested to apply for subdivision approval. The sketch plan was reviewed on 6/22/99. 2. The owners of record of this property are Gerald and Doris Marquis. 3. Access: No changes 4. Coverage/setbacks: Building coverage, overall coverage and setbacks limitations will be exceeded on all the footprint lots. Section 10.404 of the zoning regulations allows the Development Review Board to modify the maximum building coverage and setback requirements, but not maximum lot coverage. This problem can be resolved by recording a "Notice of Conditions" indicating that for zoning and subdivision purposes all the lots are to be treated as one (1) lot. 5. Lot size/frontage: The footprint lots will not meet the 9500 square foot minimum lot size requirement and the 80 foot frontage requirement. Section 10.404 of the zoning regulations allows the Development Review Board to modify the minimum lot size and minimum frontage requirements. The recording of a "Notice of Conditions" will eliminate the need to modify the minimum lot size and minimum frontage requirements by indicating that for zoning and subdivision purposes all the lots will be treated as one (1) lot. 6. Other: --- metes and bounds information is included on the plat to tie the corners of each building to DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the final plat application of Ashbrook Park Homeowners Association to amend a previously approved 17 unit planned unit development consisting of three (3) buildings. The amendment consists of creating separate lots under the footprint of each unit, 701 Dorset Street, as depicted on a plan entitled, "Building Locations Ashbrook Park Dorset Street South Burlington, Vermont," prepared by Krebs & Lansing Consulting Engineers, Inc., dated August 16, 1999, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) Prior to recording the final plat plan, the applicant shall record a "Notice of Conditions", approved by the City Attorney, which states that for zoning and subdivision purposes all the footprint lots and the common land lot shall be treated as one (1) lot. 3) Any change to the final plat plan shall require approval by the South Burlington Development Review Board. 4) The final plat plan shall be recorded in the South Burlington land records within 90 days or this approval is null and void. The Development Review Board Chair or Clerk shall sign the plat plan prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format.
