Specifically, we failed to notify you of a change of tenants as required by Condition #5 of said approval. Attached for reference is a current list of Unit Owners and Tenants, and their respective occupations. The tenant Well Evolved moved in approximately 1 year ago, and the tenant Oasis moved in at approximately the same time. The tenant Lightwave is a continuation of the former Rolfing practice of Jeff Galper, who has passed away. We are seeking approval of the tenants Well Evolved and Oasis. Based on our experience of the past 10 years, our building has more than adequate parking available to accommodate the occupancy uses of the businesses herein. While we have no hard evidence regarding the afternoon peak Vehicle Trip Ends, our observations indicate that the VTE's are well below the allowed 28.95. We apologize for any inconvenience that we may have caused. We would be pleased to meet with you should you wish to discuss this further. Sincerely, Richard M. Doherty, Registered Agent 595 Dorset Street, Ste. #6 So. Burlington, VT 05403 Re: Zoning Violation — Changing Tenants without Approval Dear Mr. Doherty: It has come to my attention that a new tenant called "Well Evolved" has occupied space at 595 Dorset Street for approximately one (1) year. A review of our records indicate that approval has not been obtained for this tenant as required under the Site Plan approval issued on 1/23/08 (copy enclosed). This site plan approval included the approval of an "umbrella permit" for this property which required that before any new tenant can occupy the building, it must first obtain approval. Since no approval has been obtained for this new tenant as required under condition #5 of said approval, you are in violation of the zoning regulations. Therefore, you have seven (7) days from the date of this letter to obtain approval as outlined under condition #5 of the approval. Should you have any questions, please feel free to contact me. VQaJS.k\UA- SOUTH BURLINGTON DEVELOPMENT REVIEW BOARD 19 JUNE 2007 Site Plan Application #SP-07-40 of The Willows Association for an umbrella approval for medical and general office uses, 595 Dorset St: Ms. LaRose noted this was originally approved for all Medical offices. They are asking for a general and medical office umbrella. Staff has no issues. Ms. Quimby moved to approve Site Plan Application #SP-07-40 of The Willows Association subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously. 8. Sketch Plan Application #SD-07-32 of Pat Ayer for a planned unit development consisting of two 44,000 sq. ft. commercial buildings, Airport Parkway: Mr. Ayer said one building will be 20,000 sq. ft. and the other 24,000 sq. ft. Mr. Ayer indicated he had hired an engineer to get sight lines at the egress. They are at least double the requirements. Mr. Behr noted that the regulations require a 32-foot pavement width. After some discussion, and the fact that it will be a private road, members were OK with a 28-foot width. Mr. Ayer addressed the wetland and buffer, noting that the Stormwater Dept. and the Army Corps of Engineers have no interest in the area. Ms. LaRose noted there is a Velco/GMP right-of-way through the property which is the reason for the building layout. The applicant suggested doing preliminary and final plat together. The members had no issue with this. 9. Site Plan Application #SP-07-41 of Fessou Enterprises, LLC, to amend a previously approved plan for an 11,304 sq. ft. mixed use commercial building. The amendment consists of landscaping and site modifications, 1820 Shelburne Rd: Mr. Wilson said they will replace the 2 maple trees on Allen Road that have died. Two maples on the other side of the building will be replaced with something that doesn't go high enough to reach the overhead wires. No other issues were raised. Ms. Quimby moved to approve Site Plan Application #SP-07-41 of Fessou Enterprises, LLC, subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously. COMMENTS Associate Planner Cathyann La Rose, referred to herein as Staff, has reviewed the plans and has the following comments: ZONING DISTRICT & DIMENSIONAL REQUIREMENTS There are no changes to the building as a result of this application. No new construction is proposed. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. (f) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. There are no changes to the building as a result of this application. No new construction is proposed. Therefore the above criteria are not applicable to this application. Site plan applications shall meet the following specific standards as set forth in Section 14.07 of the South Burlington Land Development Regulations: CITY OF SOUTH BURLINGTON 3 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\sit\wil lows\wil lows umbrella.doc (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not feel it is necessary to create any additional access points to the properties that abut the subject property. (b) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). No additional dumpsters will result. . (d) Landscaping and Screening Requirements As no new construction is proposed, his criterion is not applicable to this application. Lighting There are no changes to lighting proposed as part of this application. Other- Umbrella Permit The biggest issues involved in issuing an umbrella approval are whether the proposed uses are allowed in the district, whether the site provides enough parking, and whether or not the estimated traffic generation can be supported by the traffic impact fees already paid. The applicant has proposed that office and general office use be approved under the umbrella permit: Staff finds no issues with the approval of these uses as of right. The property contains 7782 square feet of space. Staff has calculated the impacts should the entire building be devoted to the more intensive use of medical office. Parking Five (5) spaces per 1000 square feet are required for medical office use; thus 39 spaces shall be required, including 2 parking spaces which shall be marked as handicapped -accessible. Forty five are provided on site, including two reserved for handicapped. The applicant shall adhere to the following conditions to ensure that any future changes in use are in compliance with the SBLDR. CITY OF SOUTH BURLINGTON 4 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\sit\willows\willows umbrella.doc Traffic Medical office use is estimated to generate 3.72 pm peak vte's per 1000 SF. Thus the estimated vehicle trip ends should the entire site be used as medical office shall be 28.95. The building was originally approved as all office so no increase in traffic is expected and no additional impact fees are needed. 1. This approval is for general and medical office use, which are currently permitted uses in the Commercial 2 Zoning District. If the land development regulations change so that any of the above uses are no longer permitted, then those uses which are no longer permitted shall no longer be approved. RECOMMENDATION Staff recommends that the Development Review Board approve Site Plan application #SP-07-40. LATHAM, JR 1905-1972 I am writing this letter following up on our telephone conversation of Friday, July 26, 1991. I have recently completed a title search of the Willows office condominium. In my title search I found an early plan of the Willows dated September, 1978, which was recorded in Volume 153, Page 21 of the South Burlington Land Records and signed as approved by the Planning Commission on February 1, 1979. It is my understanding that this initial plan showed a residential condominium development which was later abandoned. A second site plan of the Willows was recorded February 15, 1980 in Volume 153, Page 76 of the land records. This plan shows a slightly different project and has not been signed by the planning commission. It is my understanding that the plan recorded in Volume 153, Page 76 of the land records depicts the commercial development which was later constructed. In our telephone conversation you indicated that a commercial condominium such as the Willows is not a subdivision as defined by the South Burlington Subdivision Ordinance and therefore, the plan depicted the project does not have to be recorded in the land records and signed by the planning commission. The plan recorded in Volume 153, Page 76 of the land records depicting the commercial project did not have to be recorded in the land records to comply with the city ordinance and the fact that it is not signed by the planning commission is not a violation of the ordinance. If this letter accurately reflects the ordinance, please sign at the bottom and return it to our offices. Sewer and grater mains will be municipally owned and maintained. S. This plan shall be recorded within 90 days. Mr. Jacob seconded the motion. It was, noted that the phasing schedule imposed by the Commission was to force the developer to build out gradually, thereby not putting a large drain on city services suddenly. The motion passed unanimously. Site plan review, office building at northwest corner of Dorset Street and Kennedy Drive Mr. Hurley said the plan showed a loop for in and out traffic and that 35 parking spaces were shown. All the things required before, when the application was for residential unitsphave been shown again, such as the possible on ramp for the Interstate and land for Dorset Street widening. This building is smaller than the last one. There will be 7 medical and dental offices of 1,000 sq. f t. each, and the building will be 1 112 stories tall. It meets all the setback requirements. Each office will have two entrances - one in front and one in back. -Mr. Page said that if the city land next to this were developed, if the city wanted to, and at its expense. access to this property could be provided and the two could share a curb cut. Mr. Woolery moved that the South Burlington Planning Commission approve the site plan proposal of Gordon Hurley for a 7 unit dental/medical complex of 7,000sq. ft., as depicted on a plan entitled The Willows", subject to the followine stipulations: 1. A strip of land, 12' in width, for widening of Dorset Street shall be secured by an offer of irrevacable deli n&ti nn _ 2. The approval of this plan supercedes the previous approval and associated stipulations for a residential project. 3. Access to the project from Dorset Street maw be relocated, at the City's expense, to a point north of, but within 100' of this property, when_ and if the abutting municipal property is developed. 4. ,,,ANNING COMMISSION MARCH 13, 1979 4. This approval expires 6 months from this date 5• A_landscaping bond of $6,000 shall be posted Mr. Levesque seconded the motion, and all were in favor. Sketch plan review, 1 lot subdivision proposal of Brassard Automotive Services, Inc. to the rear of Al's French Fries Mr. Page said that 9 months ago the Al's French Fries lot had been set off from the rest of the land now owned by the Brassards. At that time there had been a lot of discussion about a number of issues, but the hardest issues were those of traffic and curb cuts. One stipulation imposed at the time was that when there was development of the backland, there would be further restrictions on the Williston Road curb cuts. He also felt the Commission should look into requiring a city street and possibly public sewer and water mains up to the new lot. Mr. Page also felt that the Midas lot should be large enough to allow for expansion of the business and said the Commission needed to look at access between this land and the "Superblock" area behind it. Mr. Brassard said that he was talking to adjoining property owners about a land swap so that his piece did not have such irregular boundary lines. Mr. Poger said he had understood that there would be a Dorset St. - Hinesburg Road Connector and that the city street from the 1didas lot on Williston Road would tie into that. The point was discussed further. Mr. Page said he had an opinion from a traffic consultant on what kind of road should go through the development and said he would look it up. Sketch plan review, 1 lot subdivision at 392 White Street Mr. Page said the area was toned R4 and that there was a single family dwelling, on the lot as well as a right of way to a duplex on a lot set off originally from the lot with the single family dwelling. The right of way is 25' wide. The proposal is to set off a 1/4 acre lot in the rear and provide access from a private right of way that serves the duplex and the single family home existing now. There would then be 4 units on the private drive. The Commission seemed t9 `feel that the drive should perhaps be a city street, and failing that;8iulde Vlleast be widened. There are a lot of long lots in the area and there is potential for more requests like this one. Mr. Ewing wanted to see the Fire Chief's reaction to the plan. It was noted that if all the owners of long lots in the area got together, they could subdivide the land and put in a city street with a cul-de-sac to serve them all. Mr. Poger did not like the idea of long lots with a number of units on them, and said that just because the area was zoned R4 did not mean one had to have a home on every 1/4 acre of land. Mr. Woolery felt that if this subdivision were allowed, the right of way would have to be widened and probably some of the preliminary work in making the drive a city street would have to be done. He asked Mr. Sprano, the applicant, to talk to Mr. Page further about the idea. The Commiasion seemed to feel that a 50' right of way would be needed. If Mr. 3prano did some of the preliminary work on the road. if the other lots were subdivided, those people could do the rest of the work. The City Engineer will comment on this. The meeting was adjourned at 10:15 pm. ,. r City of South Burlington 575 DORSET STREET SOUTH BURLINGTON, VERMONT 05403 FAX 658-4748 PLANNER 658-7955 March 20, 1991 Mr. Lance Llewellyn Fitzpatrick -Llewellyn Associates One Wentworth Drive Williston, Vermont 05495 Re: Unit #5, 595 Dorset Street - PB-4-0454 Dear Lance: ZONING ADMINISTRATOR 658-7958 This letter serves to inform you that Unit #5 located at 595 Dorset Street is currently served by the City's Airport Parkway Treatment facility. The concept of "mixed use" development is one that is increasingly being promoted by many cities and towns across the country, including South Burlington. The theory behind mixed use development is that by mixing uses within the same development or within relatively close proximity to one another, the need to get in one's car and drive to a particular store, business, restaurant or residence is reduced, thereby resulting in reduced traffic congestion, traffic hazards and pollution resulting from automobiles. The City Center plan and zoning is centered around the concept of compact, mixed use development. In addition, in reference to the City's commercial centers, the Comprehensive Plan states that "The City encourages mixed -use development in these areas (e.g., mixed residential/commercial or mixed retail/office/restaurant) to encourage pedestrian movement, use of public transportation services, and shared parking opportunities." In my opinion, the proposal to operate a hair salon within an office complex is compatible with the City's goals to promote mixed use development within its commercial districts. For example, employees of the various medical offices in the complex could theoretically get their hair cut at the proposed hair salon. Likewise, employees of the hair salon could utilize the services offered by the various general/medical office establishments in the complex. Either of these actions would result in less vehicle trips on South Burlington roads. While the reduction of a few trips generated by this property will not have a dramatic impact on traf f is congestion in the City as a whole, the cumulative of fect of many mixed use developments throughout the City may have a noticeable impact. While mixed use development is generally desirable, it is important however, that the mix of uses be carefully considered in terms of adequacy of parking spaces, traffic impacts, etc. That is the purpose of conditional use and site plan review. Plan should be revised to show current condition. 5) KENNEDY DRIVE INVESTMENTS - HAIRDRESSER - SITE PLAN This project consists of the conversion of a 1,300 square foot condominium to retail use (hairdressing and tanning salon). This property was last reviewed by the Planning Commission on 3/13/79. This change in use results in a multiple use of the property requiring approval from the Zoning Board of Adjustment. The Zoning Board of Adjustment held a hearing on the proposal on 12/14/92 and continued it to their 1/11/93 meeting. This property located at 595 Dorst Street lies within the C2 district. It is bounded on the north by City Hall, on the south and west by interstate ramps, and on the east by Dorset Street. Access/circulation: Access is provided via the shared curb cut with City Hall and an access drive on City property. The Dorset Street reconstruction eliminated the property's only curb cut on Dorset Street. Circulation is one-way around the building in a counterclockwise direction and is adequate. Parking: This property will now require 43 parking spaces and 45 parking spaces are being provided including two (2) handicapped spaces. Parking spaces #33, 34 and 35 are partially located within the Dorset Street r.o.w. These spaces must be relocated outside of the r.o.w. Landscaping: There is no minimum landscaping requirement since no building improvements are proposed. Existing landscaping is adequate. C.O. Zone: A 50 foot strip along both the southerly and westerly boundaries of the property are in the CO zone. The southerly zone is shown but not the westerly one. Plan should be revised to show the C.O. zone along the westerly boundary. Memorandum - Planning December 29, 1992 agenda items December 22, 1992 Page 6 Coverage/setbacks: Building coverage is 11.5% (maximum allowed is 30%). Overall coverage is 66.7% (maximum allowed is 70%). Front yard coverage is 92.8% (maximum allowed is 30%). This appears to be an existing situation. Traffic: This property is located in Traffic Overlay Zone 2 which would allow this property to generate a maximum of 19.9 vehicle trip ends (vte's) during the P.M. Peak hour. I.T.E. estimates the current uses to generate 37 vte's and the conversion of one (1)unit to a hairdresser would increase vte's by one (1). This estimate is based on using the retail use trip rate for the hairdresser and tanning salon uses. The Planning Commission can allow traffic volumes above the normal standards if it determines that site improvements will produce a net benefit for traffic flow (Section 17.50 of the zoning regulations). The Planning Commission in the past has allowed such increases due to the reconstruction of Dorset Street. Sewer: No additional sewer allocation needed. Proposed use is projected to use less sewer than previous use. 6) BARRY'S TRANSMISSIONS - AUTO SALES & REPAIR - SITE PLAN This project consists of the reestablishment of an auto sales and repair use at the former Mayo's Subaru dealership. There will be no additions or alterations made to the building. The Zoning Board of Adjustment on December 14, 1992 granted the applicant a conditional use permit for the proposed use. This property located at 1907 Williston Road lies within the Mixed Industrial & Commercial district. It is bounded on the north by Williston Road, on the east by Plywood City (vacant), and five (5) residences on Clinton Street, on the south by the INS building and several vacant lots on Kimball Avenue, and on the west by a construction equipment sales and service business. Access/circulation: Access is currently provided by a 40 foot curb cut and a 43 foot curb cut. No changes are proposed to these curb cuts. The Plywood City access is located on this property within the 60 foot r.o.w. It would be a long term benefit for traffic access along Williston Road if the access to this property were -\,00`910 l .gip:>a ,3 •any 5(-) 10 Tel MEMORANDUM To: City Planner; From: John Steele Date: November 11, 92 Revised December 14, 1992 Subject: The Willow Professional Building 595 Dors Street File: 92094 Description: The existing 9,100 sq ft professional building includes 7 two story 1,300 sq ft office condominimums. I.T.E. estimates that this change in use will increase the vehicle trip ends by one (1) for this property. The property currently, exceeds the limit allowed by 15.4 trip ends. The Planning Commission can allow traffic volumes above the normal standards if it determines that site improvements will produce a net benefit for traffic flow (Section 17.50). The Planning Commission in the past has allowed such increases due to the reconstruciton of Dorset Street. While the reduction of a few trips generated by this property will not have a dramatic impact on traffic congestion in the City as a whole, the cumulative affect of many mixed use developments throughout the City may have a noticeable impact. While mixed use development is generally desirable, it is important however, that the mix of uses be carefully considered in terms of adequacy of parking spaces, traffic impacts, etc. That is the purpose of conditional use and site plan review. We understand that the potential change to a beauty parlor's use is permitted. However, we are against such multi -use under Unit #4, pri- marily due to the inability we feel to accommodate the traffic of a service business such as this. As you know, our bylaws insist that each unit is entitled to five parking spots per unit; and although there are five additional spots in the area, we have had our parking reduced as a result of the changes which have taken place on Dorset Street. Therefore, the other owners mentioned below would ask that the approval for multi -use of Unit #4 be denied, due not only to park- ing constraints but also to the lack of ventilation and potential for odor from the beauty parlor, and that the use for our building continue to be primarily general office. McBean said that they were asking the Commission to allow them to divide one lot into two and that at the last meeting the Commission had felt that if they allowed that, he would have to -upgrade the _present dirt road to city standards, per stipulation of the Commission. He said he wanted to set aside 31 acres of land from the lot which now has 46 acres and a house. He felt the Subdivision Regulations allowed him to do this if he waived all rights of development on the land unless he came before the Commission again acid went through full subdivision review. !Vzl. Levesque felt an agreement was an agreement and that if the land was divided, Mr. McBean should upgrade the road. Mr. Peter Collins represented the Jewetts, who own a home in the "iiCBean Subdivision". tie felt it was clear in the April 12 and March 8, 1977 minutes that if there was further subdivision the road would be upgraded and he was sure that the proposal now was for a subdivision, no matter how it was defined. He said the people in that subdivision had bought the land knowing that there was this restriction on further development and he said they did not want to prevent I,ir. McBean from further subdivision but felt that he would have to upgrade the road first. Mr. Page felt that the 31 acres could be separated if the development rights on that parcel were waived. This would mean that the owner of that entity could not develop it until he had gone through full subdivision review. If this entity were sold, the new ot:ner would have to go through subdivision review and pave the road before he could develop the lot. Mr. Mona moved to close the public hearing and Mr. Woolery seconded that. rr. Woolery suggested that Mr. McBean sell the 46 acre parcel as one and reserve the right to buy 31 acres of it later. The restriction on upgrading the road would stay with it then. Mr. Collins confirmed that that could be put in the deed and then the minute that 46 acre parcel was not one piece, the road would have to be upgraded. The motion passed with all voting aye. Mr. Draper moved that the final plat application of Dr. Marshall McBean for a 1 lot subdivision be denied unless it is accompanied7by a written stipulation to improve the private drive to city standards to extend to the pro,.osed dividing line of lot 5 and that a cul-de-sac be built at the end of the street. BOX 107 WILLISTON, VT. 05495 879-6888 v 'CUSTOMER SATISFACTION IS MY BUSINESS' M E M O R A N D U M To: South Burlington City Council & City Manager, William Szymanski From: Richard Ward, Zoning Administrative Officer Re: Hurley's application for a dance studio, at Kennedy & Dorset Street Date: September 21, 1978 The council (at it's September 18th. Meeting) questioned whether Mr. Hurley's request to operate a dance studio in conjunction with six dwelling units is in fact a home occupation instead of a conditional use. Having discussed this with Attorney Spokes, in his opinion this is definitely not a home occupation. Under the interim zoning district regulations a dance studio is not a permitted use and therefore requires approval by the City Council. As a result of the interim regulations the multi -use provision in the permanent zoning regulations is no longer applicable. M E M 0 R A N D U M To: South 3urlington City Council From: Richard tiard, Zoning Administrator Re: Conditional use application, G. Hurley, Dorset Street and Kennedy Drive Date: September 7, 1975 Area in question (north-west corner of Dorset & Kennedy Drive) abuts the interstate to the west and the on -ramp to the south, contains one plus acres. Has been granted preliminary approval for seven residential units, area zoned R-7 under the 1974 zoning regulations. Dance studio is a Business Retail use. Applicant requesting conditional use approval by eliminating one dwelling unit and replacing with a dance studio. Plannina Commission has approved this subeivision with the following conditions, (1) that a strip of land 121 in width for widening Dorset Street shall be secured by an offer of irr- evocable dedication (2) land shall be reserved for a north bound on ramp to the Interstate. Other general conditions were included which do not pertain to this application. Municipal sewer and water is available to this site. All dimensional requirements are confo.rminc. Question the need for a graveled turnaround to the west of the property, this eliminates screening from the Interstate which was originally proposed. The front yard buffer (land- scaping) requirement (Section 11.702) will require a waiver by the Zoning Board of Adjustment (driveway and parking area occupies an area greater than 5W* of the front yard). Question the need for twent,'r four parking spaces and the need for par"Ang spaces 20 to 24 on the plan. Planning Corrunission could waive the parking requirements under Section 13.40.
