HomeMy WebLinkAboutSP-02-38 - Decision - 0550 Dorset Street#SP-02-38 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON RE: Findings of Fact, site plan application #SP-02-38 of the City of South Burlington to amend previously approved site plan #SP-02-20 for two schools totaling 167,000 square feet. The amendment consists of constructing a 59 square foot vestibule addition to the north entrance of the high school, 550 Dorset Street. On the 18'h day of July, the Director of Planning & Zoning approved the site plan application of the City of South Burlington under Section 26.10(b) of the South Burlington Zoning Regulations, based on the following findings: This project consists of a site plan application to amend previously approved site plan #SP-02-20 for two schools to add a 59 square foot vestibule to the north entrance of the high school. 2. The owner of record is the City of South Burlington. 3. This property is located within the Municipal District and the Park and Recreation District. It is bounded on the south by Kennedy Drive, on the west by Dorset Street, on the north by three businesses and single family residences, and on the east by residences and Hinesburg Road. 4. Access, circulation and parking: No changes to access, circulation or parking will result. 5. Coverage/setbacks: The proposed vestibule will add 59 SF of building coverage. Building coverage will be 4.41 %, with the maximum allowed being 30%. Overall site coverage will increase by 1 SF to 9.491yo, with the maximum allowed being 70%. Front yard coverage is unchanged. Coverage requirements are therefore met. All setback requirements are met. 6. Landscaping. No additional landscaping is required. #SP-02-38 DECISION AND CONDITIONS Based on the above Findings of Face, the South Burlington Director of Planning and Zoning approves site plan application #SP-02-38 of the City of South Burlington to amend previously approved site plan #SP-02-38 to add a 59 SF vestibule to the north entrance of the high school at 550 Dorset Street. The amendment is depicted on a plan entitled "South Burlington School District Proposed Parking Improvements," dated July, 2001 and with a date received notation of July 16, 2002, with the following stipulations: 1. All previous approvals and stipulations that are not superseded by this approval shall remain in effect. 2. Any exterior lighting attached to the vestibule shall be downcasting and shielded fixtures. 3. The applicant shall obtain a zoning permit within six (6) months of the date of this decision, pursuant to Section 27.302 of the Zoning Regulations, or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer. 5. Any change to the approved site plan shall require approval of the South Burlington Development Review Board. e Hoover Date irector of Planning & Zoning Please Note: You have the right to appeal this decision to the Vermont Environmental Court, pursuant to 24 V.S.A. § 4471 and V.R. C.P. 76, in writing, within 30 days of the date this decision is issued. The fee is $150.00. If you fail to appeal this decision, your right to challenge this decision at some future time may be lost because you waited too long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d) (exclusivity of remedy; finality).
