DECISION AND FINDING OF FACT
On the 23rd day of October 1995 the South Burlington Zoning Board
of Adjustment heard testimony regarding a variance application of
Rafael Veve, Dorset Commons, 435 Dorset Street this meeting was
also attended by Attorney James Carroll.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for
this application, the Zoning Board finds, concludes, and decides
as follows:
Findings of Fact
1) The area in question zoned R-7 District.
2) Total lot area of Dorset Commons including parcel at 118
Oakwood Drive is 15.3 acres.
3) Density is seven (7) units per acre.
4) Existing density is 105 units, a variance was granted April
1984 which increased density.
5) Use of 118 Oakwood Drive to increase parking area for "The
Pines" is no longer under consideration.
Conclusion
1) Parcel at 118 Oakwood Drive so-called lot D contains, 25,000
square feet which allows for a density of four (4) units.
2) Applicant is proposing a lot merger and to locate the
additional four (4) units within the Dorset Commons complex.
3) Lot D so-called was created by a court judgement with no
access to Dorset Street.
4) The Pines Senior Housing project is no longer leasing the
land in question.
5) Proposal would transfer density from lot D to Dorset
Commons.
6) Access will be from Dorset Street, access from Oakwood
Drive is not under consideration for this appeal.

Based upon the findings and conclusion set -forth above, the
Zoning Board of Adjustment hereby grants the applicants request
to construct an additional four residential unit at Dorset
Commons, 435 Dorset Street. Stipulation that lot D so-called
located at 118 Oakwood DyS'70�e,,be merged with Dorset Commons.
