HomeMy WebLinkAboutVR-97-0000 - Decision - 0435 Dorset StreetSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Doc) DECISION AND FINDING OF FACT On the 24th day of February, 1997, the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Rafael Veve, Dorset Commons, 435 Dorset Street. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned R-7 District. 2) Total lot area of Dorset Commons including parcel at 118 Oakwood Drive is 15.3 acres. 3) Density is seven (7) units per acre. 4) Existing density is 105 units, a variance was granted April 1984 which increased density. 5) Access is provided by a 30 foot signalized curb cut on Dorset Street. Conclusion 1) Parcel at 118 Oakwood Drive so-called lot D contains, 25,000 square feet which allows for a density of four (4) units. 2) Applicant is proposing a lot merger and to locate the additional four (4) units within the Dorset Commons complex. 3) Lot D so-called was created by a court judgement with no access to Dorset Street. 4) Proposal would transfer density from lot D to Dorset Commons. 5) Access will be from Dorset Street, access from Oakwood Drive is not under consideration for this appeal. 6) Same application approved by Planning Commission and Zoning Board of Adjustment in October, 1995, project allowed to expire by appellant. Based upon the findings and conclusion setforth above, the Zoning Board of Adjustment hereby grants the applicant request to construct an additional four residential unit at Dorset Commons, 435 Dorset Street.
