SOUTH BURLINGTON ZONING NOTICE
The South Burlington Zoning Board of Adjustment will hold a public hearing
at the Cer,;raI School Offices, 1175 Williston Road, South Burlington, Vermont
on Wednesday, June 2, 1971 at 7:30 p.m. to consider the following:
#1 Appeal of Green Mountain Power Corporation seeking a variance from
Section 12.90, Non -conforming use. of the South Burlington Zoning Ordi-
nonce. Request is for permission to erect an additional transformer and
switch gear to the Dorset Street sub -station.
#2 Appeal of Claude Neon of Connecticut, Inc. seeking a variance from Section
7.80, Sign requirements of the South Burlington Zoning Ordinance. Request
is for permission to erect two facade type signs, containing a total of three
hundred and twenty (320) square feet, at the Grand Union, located on Hines-
burg Rood near Williston Road.
#3 Appeal of John S Arlene Cleary seeking a variance from Section 6.40, Yard
requirements of the South Burlington Zoning Ordinance. Request is for per-
mission to construct a swimming pool within seven (7) feet of the required
side yard and within five (5) feet of the rear lot line, at 10 Suburban Square.
#4 Appeal of John Barone, Northern Terminals, Inc. seeking a variance from
Section 8.20, Lot area requirements of the South Burlington Zoning Ordi-
nance. Request is for permission to construct an additional building, 30'x60'
on a lot containing approximately 36,400 square feet, at 1160 Williston
Road.
#5 Appeal of John Barone, Northern Terminals, Inc. seeking a variance from
Section 8.40, Yard requirements of the South Burlington Zoning Ordinance.
Request is for permission to construct a building within fifteen (15) feet of
the required side and rear lot lines, at 1160 Williston Road.
#6 Appeal of John Barone, Northern Terminals, Inc. seeking a variance from
Section 8.62, Screening of parking area .of the South Burlington Zoning
Ordinance. Request is for permission to set-off a parking area, with no
screening from adjacent residential properties, at 1160 Williston Road.
#7 Appeal of Gerald Rafoul seeking a variance from Section 6.40, Yard re-
quirements of the South Burlington Zoning Ordinance. Request is for per-
mission to construct an addition, containing approximately 1296 square
feet within twenty (20) feet of the required front yard and within nine (9)
feet of the required side yard, at 15 Newton Avenue.
#8 Appeal of Shirley Hamilton seeking a variance from Section 12.90, Non-
conforming; alteration of the South Burlington Zoning Ordinance. Request
is for permission to construct an addition, 28'26' in size, at 16 East Terrace.

Re: Expansion of Green Mountain Power sub -station
on Dorset Street

Pursuant to your request, we have reviewed
Green Mountain Power's request to expand their sub-
station on Dorset Street. Our purpose was to determine
whether they are subject to the City Zoning Ordinance,
and if so, what procedures they must undertake.
Based upon the Zoning Ordinance and relevant
statutes, we feel Green Mountain Power is subject to
South Burlington's Zoning Ordinance. The proposed sub-
station is located in Business District A, and is not
a permitted use in that district. However, Green Moun-
tain Power does have a non -conforming use, and the ques-
tion is whether their plans are to expand the existing
structure or merely alter or improve it.
We understand that Green Mountain Power pro-
poses to replace its portable unit with a new trans-
former. This is approximately six feet wide, sixteen
feet long and thirty-five feet high, and includes a
switch gear and conduit. The portable unit now exist-
ing is housed in a trailer, and has been for some time.
Based upon this limited information, Green Mountain
Power's proposal appears to be an alteration of a non-
conforming use, and within the language of Section
12.90 (2) of the Ordinance. If the cost of the trans-
former does not exceed 25 percent of the total fair
market value of the existing structures, a permit should
be issued to Green Mountain Power.

If, however, your investigation reveals that
their proposal is more of an extension of a non -conforming
use under Section 12.90 (3), Green Mountain Power must
seek a variance. The same is true if their proposed trans-
former exceeds in cost 25 percent of the fair market value
of the existing structures.
