PAUL STREET BURLINGTON, VERMONT OS401 May 18, 1971 Richard Ward, Zoning Administrator City of South Burlington South Burlington, Vermont 05401 Re: Expansion of Green Mountain Power sub -station on Dorset Street Dear Dick: AREA CODE 802 863-2877 Pursuant to your request, we have reviewed Green Mountain Power's request to expand their sub- station on Dorset Street. Our purpose was to determine whether they are subject to the City Zoning Ordinance, and if so, what procedures they must undertake. Based upon the Zoning Ordinance and relevant statutes, we feel Green Mountain Power is subject to South Burlington's Zoning Ordinance. The proposed sub- station is located in Business District A, and is not a permitted use in that district. However, Green Moun- tain Power does have a non -conforming use, and the ques- tion is whether their plans are to expand the existing structure or merely alter or improve it. We understand that Green Mountain Power pro- poses to replace its portable unit with a new trans- former. This is approximately six feet wide, sixteen feet long and thirty-five feet high, and includes a switch gear and conduit. The portable unit now exist- ing is housed in a trailer, and has been for some time. Based upon this limited information, Green Mountain Power's proposal appears to be an alteration of a non- conforming use, and within the language of Section 12.90 (2) of the Ordinance. If the cost of the trans- former does not exceed 25 percent of the total fair market value of the existing structures, a permit should be issued to Green Mountain Power.
