On the Right -Of -Way Easement and Agreement, I believe that the first full paragraph on the second page is inappropriate as to a surface easement. I believe that this language applies only to a subsurface situation. Therefore, I am requesting that this paragraph be deleted. In the next paragraph, I request that "...prevent trespass" be changed to read "...make all reasonable attempts to prevent trespass". Since the City is in the practice of taking only Warranty Deeds as to roads, I have some difficulty accepting the constraints of an Administrators Deed. Therefore, I am requesting either that the Administrator by separate document supplement the warranties to those of a full Warranty Deed or, alternatively, as you have suggested, we will accept, upon the same general terms and conditions, a Warranty Deed from the purchaser. In the Sewer Easement and Bill of Sale, we need to fill in the blanks and address the question as to whether the City is to be conveyed a pumping station, and if it is, whether this should be done by appropriate Warranty Deed. To the extent that this document appears to contain warranties, the same considerations as to a Warranty Deed apply. Sincerely, David H. Spitz, City Planner DS/:mcg 3 . PLANKING COMMISSION SEPTEMBER 23,1980 The paved area will be retained and the rest of the parking will be red crushed stone. Snow removal was discussed. It will be pushed along the edge of the hedges and tree line. Mr. Spitz felt that the hedge might have to be moved farther over in front of the diagonal spaces to leave room there — snow from that area might have to be removed. Mr. Cannizzaro said he would have to live with the possibility of removing snow 1 or 2 times a year and Mr. Walsh wanted to include that as a stipulation. Mr. Ewing felt the Commission should require that the spaces be kept open, but what was done with the snow was Mr. Cannizzaro's business. M. Mona noted that, if needed at a later time, trees could be cut to allow for more parking and smaller --plantings could replace them. This would only be done if it had to be. Mr. Ewing moved that the South Burlington Planning Commission approve the site plan application of Rosario V. Cannizzaro for continued use of six apartments and two new offices as depicted on a plan entitled "Design proposal for 938 & 950 Shelburne Road", prepared by Christopher Dunn, dated September 23, 1980, subject to the following stipulations: 1. Curb openings on Shelburne Road shall be closed with �rrenite or concrete curbs. 2. New shrubs on the Shelburne Road side of the parking lot shall be located at.least 2" 112 feet in front of the parking area.- 3. A landscaping bond of $5200 shall be provided to cover removal of dead trees and lawn and driveway area improvements as well as new plantings. 4. This approval expires in 6 months. 5. Snow shall not block the parking spaces. 6. Any change in the use from the owner's real estate office and a rented low traffic intensity use office shall come back to the Planning Commission for approval. Mr. Jacob seconded the motion. Mr. Mona requested that Iir. Cannizzaro inform the Commission of the use the first tenant will have. Mr. Schpucker said the applicant wound not mind doing so and would send a letter. The motion carried unanimously. Continuation of public hearing on application by L.E. Farrell Company for final plat approval of a 3 lot subdivision on Allen Road, also application by the L.E. Farrell Company for site plan approval of a soft drink bottlin- -,lant consisting of 2 buildings 78,400 sq. ft. and 9,600_sq. _ft. on lot 3 of the proposed subdivision Mr. L.--phere said this was now a 3 lot subdivision and that Pepsi would take over the eraire parcel. The Pepsi building will be on lot 3. The garage has been moved forward and the number of parking spaces has remained the same. The Fire Chief wants one of the hydrants moved. :r. Lamphere said they would tie into the CJD water line, bring utilities down the street, and construct a retention basin. Mr. 'Walsh noted that a right turn lane had been discussed before and it was noted that those stipulations should still exist. There will be 14 route trucks and 1-2 trailera in this operation, as well as about 50 enployees. The trucks will leave about 7 as and be back between 3 and 4:30pm. PLANNING C01PIMISSION SEPTE)+ ER 23, 1960 Mr. Walsh asked about the easement to Lhelburne, but he was told that it would interfere with this development and that neither side seemed to want it. irlr. Spitz stated that the Fire Chief had some rroblems with the plans and those had not been resolved yet and that the water superintendent had not received the plans yet. 7.r. Lamphere said he had talked to the Chief and the applicants had no problem with his restrictions, but that the superintendent was out of town. Mir. Spitz said he had not had time to review the street documents. He felt that his letter to the applicants of 9/11 identified these areas and that there had been time to resolve them. He recommended holding final approval until these are done. Xr. Kolvoord said the topo lines had not been correct the first time and that had held up the plans. He felt everyone involved had-work-ed hard to try to be finished on time. i:r. roger felt approval should be next week, after everything is cleared up. Mr. Ewing noted that this was not the first time topo lines had been inaccurate and he felt that when it happened it wasted everyone's time. Mx. Spitz felt everything should be finished by next week and he thought that only 1 representative of the applicants would have to be present at that hearing. iIr. Ewing moved to continue the public hearing on the application of L.E. Farrell for final plat approval of a 3 lot subdivision on Allen Road until Seatember 30, 1980 at 7:30 pm at City Hall. Mr. Walsh seconded the motion and all were in favor. Proposed changes in Vermont Planning and Development Act Mr. Spitz passed out the proposed changes. He will make comments on the changes and transmit them to the State and the Regional Planning Commission. He felt the changes could be discussed sometime this fall if the Commission wished. Other business Mr. Spitz said the sewer allocation for Sugartree had been changed from 7,000 gpd, which was a mistake, to 8500 gpd. Regarding the second Treetop entrance/exit, I-ir. Spitz went over his 9/19/80 memo on the subject. Mr. Poger went over the history of this subject. Treetops wanted 2 entrances, but the Commission wanted only 1 because its goal was to hold the number of curb cuts on Kennedy Drive to 1 per lot in order to keep that road as a through street for high speed. He noted that this second entrance was less than 1,000' from Sugartree's access. He was concerned about left turning traffic for that complex and he added that the Commission had asked from the start for 1 entrance because they have felt that is in the best interest of the city. Mr. Poger said that if there were problems caused by having only one entrance, he would not object to opening it back up, but he noted that the Commission had insisted on a particular configuration and it has not ever even been tested. He wanted'to know if the city would be better off with one entrance or two. A'essrs. Ewing and Walsh agreed that they would like the cut closed as a matter of s,rinciple, although Kr. Ewing hated to c'_ose it with the Planner, .•:ariager, and Fire Chief all wanting it open. The left turn at the office building at the corner cf :ennedy and Williston Rd. was discussed. Applicant proposes to close off Dorset Street curb cut and to replace it with one on San Remo Drive. Applicant also proposes to cut off joint access to abutting property owner. Barrier design and effect on existing circulation pattern must be reviewed. 6) Cannizzaro Application will be reviewed only if approved on Monday by the Zoning Board. Property currently contains six apartments and a retail piano store. Applicant plans to replace the store with two offices including his own real estate operation. Site is fairly crowded. Parking spaces are both too few in number and to small in size - they will have to be revised. Note that the 7% grade is considerably below the maximum City standard for a minor street (10%). 3) Pepsi. Applicants have run into topography problems on the pepsi lot. They will appear at the meeting to explain the situation but will not be requesting any approvals. 4) Treetops. Kevin Killilea, president of Treetops Association, called to say they will be installing a break away device across the emergency access. 5) Lang. Applicants own a total of 121 acres on the west side of Dorset Street approx- mately 4 mile north of the Shelburne line. Two ten -acre lots are proposed with frontage on Dorset Street, and a future right-of-way has been left to serve rear land. The property is crossed by both pedestrian trails and proposed City streets, as shown on City planning maps. 6) Milot, Patchen Road. (1) ACCESS. Right-of-way narrows to 24 feet at one point, insufficient for a sidewalk. State law requires a minimum right-of-way of 20 feet for any lot. If a lot is proposed for higher -density development, the Planning Commission must be satisfied that the narrow right-of-way is adequate for safety and overall access for the proposed number of units. For this development a 24 foot walkway plus a sidewalk should be the minimum; a full public street right-of-way with a connection to the adjacent Munson property would be more desireable. This would tie in to the corridor shown on the proposed City street map, which is best located on Munson's land. (2) LAYOUT. Entire property is 13+ acres. Proposed portion for development is approximately 3 acres, smaller than indicatedAsketch plan. The City's zoning ordinance addresses proper allocation of open space and what standards must be met to approve full zoning density for a PUD — see sections 6.302(c) and 12.002(A) (10) . Trail location should be shown on plat to ensure there is no conflict. Some parking spaces in front of garages appear a bit short (I measured 17' in front of #34 and several others). Street lights shall be provided along the future city street. J 3) Sugar Tree Major issues frcm preliminary plat review have been resolved. The fire chief has approved an arrangement whereby the water system will not be looped but an additional fire hydrant will be added on Kennedy Drive to insure adequate safety. Also, street lights of the Town and Country variety have been located on the map. And the trail location has been spotted and is off the applicant's property. A snow fence has been marked on the landscaping plan to insure tree protection. A total development cost estimate must still be submitted to allow determination of the landscaping bond. Concerning potential access to the Ryan property - although such access, does not appear likely to be used, the option should be kept open. A 50' by 100' easement (up from 30' by 60') would allow construction of a City street. Wording of the easement is still being worked out. Other changes to the plat - the sidewalk should be extended to the second driveway; also, a street name should be indicated. 4) Farrell Company - (Pepsi) a) Traffic. Improvements at intersection with Allen Road include wide turning radii at the curb and a 250' passing lane on Allen Road. No improvements have been proposed for Shelburne Road intersection. State has been consulted and has responded that its normal review would be at Act 250. If the City wishes to have an additional review it must make its own request to applicant to undertake a traffic study and to provide any necessary road improvements. b) Sidewalk. The applicant has not proposed a sidewalk. c) Water system and fire protection. Previous subdivision proposal included a looped water system. At present, this proposal does not. Fire Chief feels looped system plus an additional hydrant may be necessary. Issue remains to be resolved. d) Pedestrian easement. Easement may follow CWD line, east property line or any other suitable location. Ends of easement should align with Allenbrook home easement and with an appropriate connection, if any, to the Shelburne development. e) Site plan. Details, including landscaping, drainage and utilities, are incomplete. Other questions include length of loading dock and whether setback to Counter property line is adequate (industrial rear yard requirement is 50 feet). I do not feel that site plan submission has progressed far enough to receive final approval. 5) Kranz Application for a supermarket, drug store other coarriercial spaceerestaurant, and Fotomat kiosk was approved by Ctiy Council with stipulations in January under interim zoning. Approval is valid for 6 months so applicant need not be considered under new Cl-C2 zoning. 3. PLANNING COMMISSION JUNE 10, 1980 7. Sewer allotment for this project is 7,000 gallons per day. 8. Recreation fee for this project is $2200. 9. Landscaping information shall be submitted with the final _plat. 10. A sidewalk shall be indicated from the buildings to Kennedy Drive on the final plat.-�--_--------- --_—__ -_ ,r. Levesque seconded the motion. Mr. Mona asked about the easement onto the city parkland. It was felt that exactly what would be required could be indicated at final plat. Mr. Spitz noted that if the easement were extended to the Ryan land, 30' x 60' might not be the right dimensions to request. Mr. Fiona felt it would be all right to change the size of the easement, and its purpose, at the final hearing. Mr. Poger agreed that the stipulation,at preliminary plat, did not limit the Commission. Mr. Foger also said that the possibility of combining the Ryan property access here would be investigated. There may be an additional requirement made. Mr. Jacob asked if the developers objected to the use of the recreation fee for something not exactly in their area. Mr. Milot replied that he did not object to the fee being used for recreational purposes anywhere in the city. If it were used to purchase a large parcel of land, he would not object. The motion carried unanimously. Sketch plan review of application by Farrell Company and the Lozon Estate for a 6 lot subdivision layout to include 1 lot for a soft drink bottling plant, located off Allen Road Mr. Kolvoord said the land had been subdivided in 1978 into 11 lots. The Farrell company wants to buy the entire parcel and reduce the number of lots to 6. Mr. Kolvoord mentioned that they might reduce the number to 4 lots. The previous road location will be changed and they will now go under the power line and along one side of it. Mr. Kolvoord felt the traffic generated by this use of the land would be much less than the previous uses. They will have 3 tractor trailer trucks and about 12 route trucks. The plant will employ 50- 70 people. There will be a garage building for truck maintenance and storage. Mr. Kolvoord said the plan was not to sell the other lots now, but the cost of extending the sewer line up Allen Road will have to be offset by their sale in the future. The entrance road will be at the same place on Allen Road as it was in the previous plan. Mr. Kolvoord felt the trees would screen the facility from the road. If the road did extend as far as the Shelburne line, it was mentioned that the Commission might want to see some sort of emergency access planned, but Mr. Rowell said the roads on the Shelburne side did not come near this property. Mr. Kolvoord went through the stipulations placed at the last hearing on the previous subdivision. Some no longer apply. Road improvements were discussed. A 250' bylane is shown on Allen Road because of the curve in the road at that point. The Commission also had some concerns about cars coming fast down Allen Road and hitting trucks pulling slowly out of this development. The applicants said signs warning of that could be erected, and they could cut some trees on the land to improve sight distance. Vr. Mona also wanted to have large radii on the new drive so large trucks could negotiate it easily. The Commission discussed traffic on Shelburne Road waiting to turn up Allen Road. Cars will use the shoulder to pass left— ' 4. PLANNING COMMISSION JUNE 10, 1980 turning traffic and the State has said that the shoulder is not adequate for that purpose. It was felt that the State should be contacted on the matter again and Mr. Spitz was asked to do so. Mr. Mona also suggested a deceleration lane on the right so trucks could pull into it before turning into the development. Hours of operation for the plant will be 7 am to 6 pm, with most workers leaving at 3 pm. Mr. Spitz felt the applicant should think about making the area a PCD if he was planning to sell the other lots . Mr. Poger asked Mr. Spitz to ask the City Attorney if the property was grandfathered, since application was made under the old zoning. Mr. Spitz did not think the grandfathering would apply to the lots themselves and he said the Zoning Board had granted a use variance for this lot. Other business Mr. Mona noted that on the June 23 Zoning Board agenda there was a request from Robert Provost for a multiple use for 1270 Williston Road. He asked that the City Council be contacted and asked how long the city would stay under the gun of what will happen on this lot before it is purchased. Mr. Poger asked Mr. Spitz to draft a letter to the Council asking them to consider buying the property before Mr. Provost multiplied the use. Mr. Poger noted that the school bus stopped in front of the emergency access on Kennedy Drive for Treetop and he did not feel that was an appropriate place to stop, particularly in light of the fact that there was a place provided for busses at the Treetop entrance. Mr. Poger also noted that Treetop had no connection with ICV any more and he said the Commission could ask the Association to close the emergency access. He asked Mr. Spitz to schedule a meeting with Treetop representatives to discuss the issue. He also asked Mr. Spitz to find out if the city could close it, what it would cost, and if the Fire Chief could run his trucks over the curb. The meeting was adjourned at 10:15 pm.
