SITE PLAN APPLICATION #SP-15-79A
FINDINGS OF FACT AND DECISION
Site plan application #SP-15-79A of Jon Svitarsky to amend a previously approved plan for a 7,020 sq. ft.
building used as a radio and television station. The amendment consists of converting the building to a
residential use to house a maximum of 25 residents, 372 Dorset Street.
Based on the plans and documents contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant, Jon Svitarsky, is seeking to amend a previously approved plan for a 7,020 sq. ft.
building used as a radio and television station. The amendment consists of converting the
building to a residential use to house a maximum of 25 residents, 372 Dorset Street.
2. The owner of record is Sisters and Brothers Investment Group, LLP.
3. The subject property is located within the City Center Form Based Code District (FBC), Transect 4
4. The application was received December 18, 2015
5. The submitted plan is titled "Site Plan 372 Dorset St. Water Service Upgrade," prepared by
Donald L. Hamlin Consulting Engineers, Inc. and dated 03/03/16.
Zoning and Dimensional Requirements
6. As the application was submitted following the warning of a public hearing on amendments to the
Land Development Regulations by the City Council affecting this parcel, the project must be
reviewed under the relevant portions of each. This application would be reviewed as a Site Plan by
the Development Review Board under the existing regulations and therefore a separate DRB
decision, #SP-15-79, will also be prepared. This application would be reviewed as an administrative
Site Plan under the draft regulations; therefore this separate decision, #SP-15-79A.
7. The use of the building as presented by the applicant in #SP-15-79 Application for Site Plan Review
is a "homeless shelter which will provide food and shelter and help to homeless individuals."
8. There are no changes to lot size or setbacks. Overall coverage has been reduced by the removal
of pavement being replaced by lawn and plantings at the building's main entrance.
9. The use is changing from one permitted use (non-residential) to another permitted use
(residential). Section 14.03(A)(2)(d) of the Land Development Regulations requires Site Plan
approval for this change.

Form Based Code Requirements
10. This project will alter the site of a non -conforming structure in the FBC by removing pavement
and adding lawn and plantings next to the entrance closest to Dorset Street.
11. The changes proposed do not meet the established thresholds for compliance with the FBC
Building Standards of an existing non -conforming structure.
SITE PLAN REVIEW STANDARDS
Access to Abutting Properties
12. No reservation of land is required.
Utility Services
13. A new waterline is proposed and will be underground. The applicant will work with the
Department of Public Works to finalize and implement this action.
Disposal of Wastes
14. The applicant will collect waste within the building in household -scale bins. No dumpsters are
proposed.
Parking
15. No changes to the parking are proposed except the reduction of one (1) space to accommodate
a new lawn and planting area on the site. A minimum of two (2) spaces per 1,000 square feet of
non-residential space and maximum of two (2) spaces per residential unit are permitted. The
removal of one (1) space does not increase the degree of non-conformance.
Landscaping, Screening, and Open Space
16. The applicant will remove approximately 270 sq. ft. of pavement and replace with lawn and
plantings as described on "Site Plan 372 Dorset St. Water Service Upgrade", dated 03/03/16.
DECISION
Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application
#SP-15-79A of Jon Svitarksy subject to the following conditions:
1. All previous approvals and stipulations not superseded by this approval will remain in effect.
This project must be completed as shown on the plan and on file in the South Burlington
Department of Planning and Zoning.

3. The applicant must paint the portions of the building which do not have vinyl siding prior to the
issuance of the Certificate of Occupancy.
4. Prior to permit issuance, the applicant must post a $900.00 landscaping bond. This bond will
remain in full effect for three (3) years to assure that the landscaping has taken root and has a
good chance of survival.
5. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the
Land Development Regulations or this approval is null and void.
The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to
the occupancy of the building under the new use.
Any change to the site plan will require approval by the South Burlington Development Review
Board or the Administrative Officer.

accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
