As I indicated in our conversation, I sent you an email using the email address you provided with your Master Signage application (copy enclosed) whereby you were informed that pursuant to Section 3.08 (D) of the Land Development Regulations, the tent was only allowed to be up for 30 days. This 30 day period expired a few days ago. It is my understanding that it is your intention to leave the tent up until the end of September. In order to leave this tent up past today you will need approval under the Land Development Regulations to do so. Since you do not have such an approval and cannot obtain approval, you will need to remove the tent by June 26, 2016. If the tent is not removed by this date, I will be issuing a Notice of Violation. The existing sign is 6.5 ft from the north property line and 3 feet from the west property line. As our entrance to the building is on the San Remo Drive side of the building, our customers have almost exclusively use the San Remo entrance to our parking lot. If asked for directions we always say our entrance is off San Remo Drive. The chain became nesseccary to limit people (about 75 per day) from using my property as a short cut to San Remo Drive. This became a safety and maintenance issue. As this very minor addition of a chain has no effect on the access to the property for my customers or employees from the original plan I do not feel that an application for access modification is approprate. One UST stored gasoline and the other stored heating oil and were used by Nissan Bakery (previous owners). During the UST removals, limited groundwater and soil contamination were observed. An expanded Site Assessment has shown low levels of petroleum contamination in the groundwater at concentrations below the Groundwater Enforcement Standards. the source of the contamination at this site has been adequately characterized and removed; the site does not pose an unreasonable threat to human health or to the environment; Based on the above, the SMS is assigning a Site Management Activity Completed designation. This designation does not release you of any past or future liability associated with the petroleum contamination onsite. It does, however, mean that the SMS is not requesting any additional work in response to the UST removed in October 1996. If the monitoring wells are no longer used or maintained, then they must be properly closed to eliminate a possible conduit for contaminant migration into the subsurface. This closure typically involves filling the wells with a grout material to prevent fluid migration in the borehole. Specific requirements for well closure are outlined in Section 12.3.5. in Appendix A of the Vermont Water Supply Rule -Chapter 21. Mr. Locker said I feel the members are sufficient. This has always functioned as retail and we are only asking for Multiple use. Mr. Locker addressed the 5. Criteria as follows: a) The capacity of existing or planned community facilities will remain the same. b) The character of the area becomes enchanced. c) Traffic is based on the previous use. Jason's would not inflict additional traffic. We also have additional parking spaces. There would be less than 40 people per working day. Please refer to the legal opinion from Steve Stitzel which was distributed to you last week. Fire Chief Goddette has reviewed these plans which include his recommendations. He therefore does not see a problem in provid- ing emergency protection. 6) JASON'S DRY CLEANING. PICK-UP STORE 370 DORSET STREET Jason's Dry Cleaning proposes to use 424 square feet of the Drake Bakeries building at 370 Dorset Street as a dry cleaning pick-up store. They will not use any dry cleaning equipment or produce any hazardous waste. They will occupy that portion of the build- ing closest to Dorset Street. This property is located in Central District 2 and is bounded on the south by the New England Floor Covering building, on the east by a Pizzagalli warehouse, on the north by San Remo Drive and on the west by Dorset Street. The Zoning Board of Adjustment granted a conditional use permit for this multiple use on November 12, 1990 (minutes enclosed). Access/Circulation: There is presently no curbing along Dorset Street giving the property a 100 foot curb cut. The Dorset Street reconstruction will result in a 30 foot curb cut which will serve this property and the property immediately to the south. There is a 72' wide curb cut on San Remo Drive. There is also a right-of-way extending westerly from the new curb cut on Dorset Street to provide legal access to this property. The circulation pattern at present is adequate given that some cus- tomers will park in the front. After widening, the situation will be that there will not be space enough for parking in the front. We know from a practical point of view that customers will be parking in this area even though not allowed. Parking: The proposed use requires three (3) parking spaces and the Drake Bakeries warehouse requires 3 spaces for a total of six (6) spaces required. The plan submitted shows a total of 6 spaces. Under the present conditions, parking in the front for drop-off and pick-up does not pose a problem. Conditions after the widening would not allow for adequate space in front of the building for parking so staff recommends that the three (3) re - FA Memorandum - Planning December 4, 1990 agenda items November 30, 1990 Page 5 quired spaces be located as shown on the plan along the southerly I side of the building. Even though this would,result in only Z5 feet between the parallel parking spaces and the southe ly property line, we do not feel it is a problem because site condi- tions when taken together with the adjacent paved area will result in a parking aisle of adequate width. Staff feels that the three (3) required spaces is adequate based upon observation at the Williston Road facility which had no more than three (3) customers at any one time. Setbacks: The Central District 2 zone requires that all build- ings be 50 feet from the planned Dorset Street. right-of-way. This building will be approximately 22 feet from the planned right-of-way so it is a noncomplying structure. No changes are proposed which would increase the degree of noncompliance. Coverage: Building coverage is 20% (maximum allowed is 40%). Overall lot coverage is 88.2% (maximum allowed is 90%). Landscaping: Minimum landscaping requirement is $12.00 and this amount has been met by the applicant. The applicant has spent $300.00 on landscaping in the front of the building. Floor Area Ratio: The F.A.R. for this lot is .2 (maximum allowed is .5). Traffic: This property lies within Traffic Overlay Zone 6 which would allow a maximum of 23 peak hour trips. Customer count information supplied by the applicant and staff observation at the Williston Road facility and other data submitted by the applicant indicates that 28 peak hour trips would be generated by the property. The Planning Commission set a precedent when it approved a site plan for the S.S.L. Corporation building at 350 Dorset Street and allowed them 11 additional peak hour trips (18% increase) to take into account the Dorset Street improvements. Based on this precedent, staff feels that exceeding the maximum number of trips allowed by three (3) is acceptable. The widening of Dorset Street will make substantial improvements to traffic flow at this location because the existing 100 feet curb cut on Dorset Street will be reduced to a 30 foot curb cut which will be shared with the property to the south, the median strip will prevent left liand turns and the curb cut on San Remo Drive will place left hand turns at a controlled intersection. Appeal of Drake Bakeries Inc. Sam Mageed, agent seeking approval from Section 19.65 Multiple uses. Request is for permission to occupy an existing structure as a retail outlet and a warehouse - truck terminal d.b.a. Drake Bakeries and Jason's Dry Cleaners, located at 370 Dorset Street. Mr. Ward informed the board that the area in question is zoned Central District 2. Section 1.101 Permitted use allows proposed use - existing use is grandfathered. Existing use warehouse/truck terminal d.b.a. Drake Bakeries. Proposed use dry cleaner pick-up store, d.b.a. Jason's Dry Cleaning. Section 19.65 Multiple uses - Section 19.05 Conditional use applies. Lot 94' x 200'. Building 42' x 85' - 3,570 square feet - drycleaning to occupy 424 square feet. Mr. Blais advised the appelants that the State status calls for a minimum of 4 positive votes regardless of how many members are in attendance. He said - if any of you feel you are not having a fair opportunity of having your appeal heard, we will allow you to extend your appeal to the next meeting. Mr. Locker said I feel the members are sufficient. This has always functioned as retail and we are only asking for Multiple use. Mr. Locker addressed the 5. Criteria as follows: a) The capacity of existing or planned community facilities will remain the same. b) The character of the area becomes enchanced. c) Traffic is based on the previous use. Jason's would not inflict additional traffic. We also have additional parking spaces. There would be less than 40 people per working day. A traffic study was handed to the board by Jason's (see attached). Mr. Locker also presented photos showing Jason's operation as to how they would enhance the area development. -2- d) & e) Bylaws and utilization of renewable energy resources would remain the same. Mrs. Bouchard asked - you wouldn't clean anything there. Mr. Locker replied this would be just drop off and pick up. Mr. Graf asked about the parking in the rear of the building. Mr. Stephens said they would come up to the front. It usually takes approximately 60 seconds from the time they pick up, walk around the front of the building, go in and come back out. There was some discussion about the parking and pick up time involved. Mr. Locker said there's 100' on either side of the building where you can go in, pick up your goods and drive out. There are 10 loading doors on either side of the building. Mr. Graf said Drake's will continue to do business with the trucks in the back. Mr. Locker said that's correct. We closed the front approximately 2 years ago. Mr. Randazzo said I'm concerned about the traffic before Dorset St. is widened to 4 lanes. I think this appeal is similar to the one for the Yogurt store. Mr. Locker said Drake's traffic is at 5 AM and return at 12:00 noon. It would not be compatible with the traffic for Jason's. Ms. Lotz asked how long before the road is widened. She also asked Mr. Stephens how long it would take to get up to the type of business that would generate that kind of traffic. Mr. Stephens said at the Shelburne Road store the traffic increased after being in the business 3 1/2 years. The Williston Road facility has been there 28 years. It takes at least a year. I would not expect the traffic to be as great as at either store. The appeal was granted 4 - 1. No. 1 Appeal of Paul G. Adams Appeal of Paul G. Adams seeking approval from Section 19.65 Multiple uses. Request is for permission to construct a 60' x 200' building and occupy with a maximum of ten (10) uses (wholesale, warehousing and storage - distribution) on a lot containing 2.52 acres, lot 42, Ethan Allen Farm Industrial Park, Airport Parkway. On July 23, the Zoning Board of Appeals will consider granting approval for a mixed use operation as well as paving greater than 30% of the front yard on San Remo Drive, and allowing a 10 foot aisle for angled parking, rather than the required 20 foot aisle. Assuming this is granted, my comments are as follows: General: The applicant proposes to make significant improvements to the appearance of the lot by landscaping the presently paved Dorset Street front yard and the southerly side yard. Due to the physical size of the lot and the location of the building, the yard on San Remo will be primarily parking. Pedestrain and Vehicular Access: A 20 foot entrance drive and a 20 foot exit drive are proposed on San Remo Drive. Chief Goddette and Bill Szymanski recommend that the curb cut closest to Dorset Street be moved further down San Remo because it will be blocked by snow when plows come through. The Dorset Street widening also calls for moving the curb cut. Parking spaces #1 and #2 should be moved to the back of the lot. This could also open the northern side for add- itional parking if necessary. A walkway is provided along the edge of the building. Parking and Circulation: The applicant is requesting approval for a 10' aisle to accommodate the traffic backing out of angled spaces on the San Remo side of the building. Parking in the rear will have a 20' aisle. Ten parking spaces are required and shown. A delivery truck space is provided as required. Landscaping and Screening: Proposed landscaping and screening are major improvements to the existing lot. 350 of the lot will be land- scaped. The value meets the 3s requirement. Other: Due to the Dorset Street widening, the applicant has been asked to dedicate 15 feet of frontage to the City. 6) Guerra, Michael and Roberta, 1540 Williston Road The applicant proposes to convert an existing single-family building to a medical clinic. It is located on the north side of Williston Road between John Larkin's property and Merriam -Graves. The Zoning Board gave its approval on July 9, 1984 for this use in the C-4 district, and allowed a 12 foot drive rather than the 20 foot mimimum. They placed the following restrictions: There can be no significant external changes to the appearance of the front of the building; the number of parking spaces may not exceed 8; the use is restricted to a single physican. The proposed City street should be constructed to City stand- ards including a sidewalk to the School District easterly boundary with a temporary turnaround. 2. The southerly portion of lot 2 is traversed by an important drainage way which drains a large area. It is flat and requires periodic dredging. An easement of 10 feet in width on each side of the centerline should be reserved for City maintenance access. 5) Bagel Bakery, Dorset Street 1. The entrance drive will start very close to the sidewalk when Dorset Street is reconstructed. A snow plow pushes snow to the right. When plowing an intersecting street as in this case San Remo Drive, the plow will start on Dorset and come around the curve and a drive close to the intersection on the right side will get more than its share of the snow pushed into"it. My recommendation would be to eliminate parking spaces 1 and 2 and move entrance easterly. Additional parking could be provided along east side of building. 2. Road opening's shall include repressed concrete curbs across there entire length. 6) Guerra Medical Office, 1540 Williston Road 1. A parking lot drainage plan shall be submitted. 2. Sidewalk shall. remain as is across drive. Plan shows it missing. 3. The one long vehicle drive creates problems that may require backing onto Williston Road or back into the parking lot when a conflict occurs. An opening to the adjacent business would help. 7) Mobil Oil Station, Kennedy Drive-Hinesburq Road 1. If east road opening on to Kennedy Drive is used for exiting vehicles going east on Kennedy Drive it may be difficult to get around island especially if the vehicle is to the far east. 2. A large trailer truck may have difficult getting around after being serviced. Application b:/Rodney Mayo 'for site plan approval of a new and used car dealership at_370 Dorsey Street The Commission had Zoning Board minutes from 11/21/77 and 1/26/81 relating; to this property and the adjacent one. Mr. Spitz said the Board had giver. conditional use approval to this use and looked at the property in relation to the adjacent lot. The Board had previously approved a use on the adjacent site and one plan showed a shared access, but the adjacent lot has no legal right to use part of this applicant's lot. Each lot has separate access now. The front is all open now and that will be closed off and landscaped. A fence will be extended along the property line between the two properties and access to the lot will be from San Remo Drive. There are 6 bays facing San Remo Drive and that will be reduced to 4. Mr. :-spitz did not feel the curb opening on San Remo Drive should be made smaller because of the building location and the short distance. He said the road and the right of way might be used for some movements. There will be one-way circulation on the lot and cars will be displayed in front. The fence between the properties is needed for security. Mr. Poger noted that approving this site plan would impact the lot next door. Mr. Spitz noted that when the 'Zoning Board had given approval for 2 or 3 uses on the other lot, a shared drive had been shown, but the applicant at that time had no authorization to use that.'What it means now is that the site next door will be crowded. Mr. Mayo said he had offered to let the owners of the building next door buy this lot from him, but they had hot exercised their option. Mr. Poger stated that what the Commission was doing here was creating new conditions on the lot next door, and while he realized that they could not force the adjacent owners to come back in, he wondered if the zoning ordinance should have some provision added to deal with situations like this. Mr. Mona mentioned informing the Zoning Board in writing of the action the Commission would take tonight. Mr. Mayo said the owners next door had told him that one of the uses in the building would be moving out and they would try to work out something for the other uses. Mr. Mayo said there would no-t be a curb in front; it would just be closed off with the landscaping. There will be a small sign and the cars sold will be very expensive. Mr. Mona wondered about what would happen if Mr. Mayo were not sucessful and had to sell. Someone else could come in with the same use and sell junk. The lot could go f rom an implied low volume to a high volume. Mr. Mayo replied that a franchise would not approve a lot that size for a high volume use and 3. Review of required Mitel road improvements at the intersection of Kenn Drive and Hinesburg Road stipulation 6 from Mav 5_ ICHI AmirnvAt Mr. Poger read a letter from the District Environmental Commission. One portion of the letter stated that the sewer, pedestrian trail, and Swift atreet Extension easements could not be activated until a study was done of the Southeast Quadrant and the Winooski River area. Mr. Ewing said that meant no expansion in that area could take place until the study was done. Mr. Spitz said it would be a city study. He felt the Winooski River area wording only referred to that area within the city, but Mr. Woolery noted that the letter should say "within the city" if that were the case. The city is a party to the letter. Mr. Levesque felt the people making the decisions were not in tune with the 21st century. He said the prime agricultural land was not in Chittenden County - the jobs were here. He proposed that some of the land which had formerly been fields be cleared for farming and that land for industry be left in Chittenden County so people had places to work. He noted that 90% of the state had been cleared and farmed at one time, and he said this was still prime agricultural land. Mr. Spitz said the letter was before the Commission for its information. Applicant requests some outside storage behind the building - location and extent of storage should be more fully described at Tuesday's meeting. Otherwise, I see no significant problems. 3) ,/ Mayo, Dorset Street J1 n, Applicant has received a variance fran the Zoning Board of Adjustment for a new/used car dealership at the site of the previous Holsum bakery at the corner of Dorset Street and San Remo Drive. Copies of previous Zoning Board actions on this and the adjoining site are enclosed. Memorandum Next week's agenda items 6/5/81 Page 2 Dealership is for a relatively expensive variety of vehicles - .jaguars, Ferraris, etc. Applicant expects a maximum of 25 cars on display at any 1 time. However, site will still be fairly crowded. Currently, site is almost all gravel. Applicant proposes to close off Dorset Street with a 10 foot wide landscaped strip and to add landscaping areas at the two corners of the property along San Remo Drive. Cost of trees meets the ordinance requirement, but front yard is substandard (10 foot width instead of 15 feet, and 28%'landscaped instead of 50%). The difficulty is that the applicant wishes to display cars along Dorset Street, and the fixed building location prevents any wider front yard green strip. The other issue is that by constructing a fence along the southern property boundary, existing shared use with the adjoining property will be cut off. This will cause score difficulties for the adjoining property, but it has no legal rights to use the applicant's property. The applicant feels he needs the fence for security reasons. 4) Mitel Several potential traffic problems have been identified at the Kennedy Drive/ Hinesburg Road intersection. a) Traffic volumes for design year 10,86 plus Mitel traffic will exceed service standards on both Hinesburg Road approach legs. Initial capacity calculations indicated that this problem would be resolved by addition of a second lane on each Hinesburg Road approach. Alternate calculations indicate that at certain peak hour conditions (e.g. northbound trips on Hinesburg Road turning left onto Kennedy Drive in the morning), an additional requirement would be a multi -phase traffic signal that would allow exclusive left -turn phases. b) Turning radii for large semi -trailers are insufficient for both right - turn movements from Hinesburg Road onto Kennedy Drive. This will become more critical on the northbound approach due to increased truck traffic from the industrial park. c) Traffic volumes on Kennedy Drive will exceed service standards after design year 1986 but in the not -too -distant future. At some point, additional approach lanes should be provided at the intersection and the entire length of Kennedy Drive may have to be widened to four lanes. The proposal that will be presented at Tuesday's meeting is that both Hinesburg Road approaches will be widened to accomodate two 12-foot lanes and that turning radii on the northbound Hinesburg Road approach will be increased to accomodate large semi -trailers but that the southbound Hinesburg Road approach will be maintained at a design serving all but the largest trucks. The improved traffic signal, a fairly expensive item, would not be provided at this time. Finally, the entire intersection would be designed for a future time period, perhaps 20 years hence, and the above improvements would be constructed to be consistent with the overall design. Request is for permission to convert an existing structure into an automobil re,c"ijjj,f ,g shop in conjunction with an existing thrift shop, located a 372 orset Street. P:r. Ward said that the area was zoned BFD and that the existing ues was permitted. This use will be expanded to 3,500 square feet and the second use will occupy the rear section of the building, with about 784 square feet for auto refirbishing and 2240 square feet for the shop area. Under Section 8.10, this use is conditional. Section 11.15 permits only one use per lot. Mr. Ward said that the Board had given the building a multiple use variance prior to this application. Yr. rrassard submitted an appeal in writing, which he gave to each member of the board. (see attached copy) He said that he and his brother owned Brassard fiutomotive Services and that they had taken the building as collateral on a rote. The note was reneged upon, and they acquired the building. At that time, they wanted the use to stay the same. The Board has in the past allowed dual use in the building, and at one time 3 businesses operated out of it. 3e said that it was ideally suited for dual use and was)in fact, built for that. The peculiar configuration of the building limits the possible tenants and they felt that the auto protection business would be the best use. The expansion of the thrift shop will not involve more traffic, he said. They have looked for suitable tenants for 3 or 4 months and feel that what they propose would constitute the minimu= variance. :r. Maurice F.eid, who would run the rear operation, said that there would be a showroom area with a customer lounge and displays. He is presently involved in rustprocfing and he said that he really did not need 8 bays, as were :,resent, but he needed more than the 2 he presently has. They would use 4 of the bays, and there would be no heavy equipment. The other bay areas will be used for storage. No cars would be left in the parking area for long periods of time and he felt that the operation would not generate a lot of traffic or be very noisy. It would be open 6 days a week, 8 to 10 hours per day. He said that they might have a person there one hour before 8:00 am and one hour after 5:00 pm for those people who worked during the day. There will be one or two employees. Mr. Brassard said that the use would not impair the capacity of existing -facilities since both operations are low key. It will not adversely effect the character of the area, since there are similar auto related services in the area and the t s:_cp will be at the rear. Both businesses are low traffic generators and will nit hurt the traffic on Dorset Street. The yard will be fenced and landscaping added to the front. The plan will go to site -plan review. Mr. Alan Webster represented Mr. Mayo and said they would sell and service new and used cars. These will be relatively expensive imported cars, of high quality. He did not feel the use would strain community facilities, a - change the character of the area, violate any by-laws, or hurt any other uses in the area. He did not expect a lot of traffic because of the limited size of the lot and the cost of the cars. He did not expect more than 5 employees and 25-30 people coming in per day. Mr. Mayo felt he could not fit more than 19-20 cars outside. He said there was not any affiliation between this use and Mayo's Subaru at all. He explained why he wanted the curb cut in the place it was shown and said that he proposed a fence between him and the property next door. This will be closed at night for security. He has limited space on the lot and the fence will insure that he has room to display cars. He did not feel he could have a car franchise on the lot unless tha cars were very expensive, because of the limited room. Mr. Mike Brassard said he owned the building next door and had put a lot of money into it. He felt the approval of this use would permanently impair development of the adjacent property and said they objected to it because of the wall. If the wall is built, he said, he will lose two tenants. One tenant will lose half her parking spaces and the other will find it hard to get to his bays in the rear of the building and will not be able to park cars in back. He also said the fence would go down the middle of the present shared access. The previous owner had worked together with the owners of the adjacent building. Mr. Reed asked who owned the property on which the fence was to be built and was told Mr. Mayo did. Mr. Reed said it seemed that the adjacent property was not large enough for the uses which were on it. Ar. Brassard said if the wall went in he would have to find a tenant who could operate with only 3 parking spaces and he did not know of any. It was also felt that the travel lane next to the fence would be narrow and might be dangerous if two cars met. Mx. Brassard said !fir. Mayo wanted the fence as a result of his proposed use, but Xr. Reed replied that the board could not tell him he could not use his own property to build a fence, and it appeared that the adjacent lot was overcrowded. Kr. Brassard said the city had approved the use about 5 years ago and he felt he was protected under 13.105. Mr. Dinklage moved to request an opinion from the City Attorney as to whether there was any real or implied understanding on the part of the city in regard to the use of those two pieces of land when the initial multiple use permission was granted. Kr. Guyette seconded the motion. Mr. Webster said what Mr. Brassard was saying was that his business could=not function without using Mr. Mayo's land and in the past there had been an understanding between the Brassards and the previous owner. He did not feel that 13.105 gave the Brassards the right to use �irr. Mayo's land. He felt the fence issue was irrelevant, since the way cars will be parked on the lot will have the same effect. Mr. Brassard said the minutes of the meeting when he received approval discuss the shared access with one curb cut for two businesses. Spitz, City Planner Re: Cross Bakery Appeal Date: 7/18/80 The intent of the new Cl--C2 zoning is to categorize all commercial uses according to the amount of traffic they are likely to generate. Any commercial use may be permitted as part of a PCD proposal (minimum 4 acres and 350 feet front- age) if traffic criteria can be satisfied. However, uses on individual, small lots must be of a type and size that characterize them as "low -traffic generators" (in C-1) or "medium -traffic generators" (in C-2). Standards have been pulled out of traffic reports and incorporated into the City's zoning ordinance to establish when any particular use may be considered a low or medium -traffic generator. When the standard for any given use is determined, the permitted gross floor area is ratioed to the minimum lot size for the Cl (60,000 square feet); or C2 (80,000 square feet) district. In the case of the proposed beverage sales establishment, anything larger than a 5,000 square foot building on a minimum lot size of 80,000 square feet would exceed the standard for a medium -traffic generator. Since the lot is of substandard size, the permitted area for a beverage sales use is even smaller. The Planning Commission recognizes the limitations that the new Cl-C2 zoning places on individual commercial uses, especially on pre-existing small lots. However, traffic conditions on Williston and Shelburne Roads demand strong measures. Where pre-existing uses exist, it may be reasonable to allow continuation of those uses or changes in use that do not generate increased traffic. However, if Cl-C2 zoning is to be effective any higher traffic generators must be directed into PCD projects where traffic circulation patterns may be more easily controlled.
