Re: Findings of Fact, application of Canoe Imports, Inc. to convert a 3738 square
foot mixed use building (personal service and storage/distribution) to retail use, 370
Dorset Street.
On the 23rd day of July, 1996, the South Burlington Planning Commission approved
the request of Canoe Imports, Inc. for site plan review under Section 26.10 of the
South Burlington Zoning Regulations based on the following findings:
1. This project consists of converting a 3738 square foot mixed use building
(personal service and storage/distribution) to retail use. The personal service use
was approved on 12 /4 / 90 .
2. This property located at 370 Dorset Street lies within the CD2 District. It is
bounded on the north by San Remo Drive, on the west by Dorset Street, on the east
by a contractor's yard, and on the south by a retail store.
3. Access/circulation: Access is provided by a 36 foot curb cut on San Remo Drive
and a 30 foot shared curb cut on Dorset Street.
Circulation on the site is adequate.
4. Coverage/setbacks: Building coverage is 21% (maximum allowed is 40%) . Overall
coverage is 78.5% (maximum allowed is 90%) .
5. The existing building is located entirely within the allowable building envelope
for the CD2 District.
6. Floor Area Ratio: The floor area ratio (F . A. R . ) is 0.21 ( maximum allowed is
0.5).
7. Parking: A total of 19 parking spaces are required and 22 spaces including one
(1) handicapped space is being provided. A bike rack is being provided as required
under Section 26.253 (b) of the zoning regulations.
8. Landscaping: The minimum landscaping requirement, based on building costs,
is $660 which is being met. Proposed plantings include Spirea, Sandcherry,
Hydrangea, Arborvitae, Yew and Forythia.
9. Traffic: ITE estimates that the proposed use will generate 13.45 additional
vehicle trip ends (vte's) during the P.M. peak hour. The applicant was made aware
that the road impact fee will be approximately $2800.
10. Sewer: No additional allocation needed.
11. Lighting: Exterior lighting will consists of four (4) 100 watt high pressure
sodium lamps with downcasting shielded fixtures mounted on the building.
12. Dumpster: The dumpster storage area will be screened with cedar stockade
fencing.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission
approves the site plan application of Canoe Imports, Inc. to convert a 3738 square
foot mixed use building (personal service and storage/distribution) to retail use, 370
Dorset Street, as depicted on a plan entitled "New Store For Canoe Imports, 370
Dorset Street, S. Burlington, Vermont," prepared by William Gardner, Architect,
dated 7 / 15 / 96, subject to the following stipulations:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. Prior to issuance of a zoning permit, the applicant shall post a $660 landscape
bond. The bond shall remain in effect for three (3) years to assure that the
landscaping takes root and has a good chance of surviving.
3. All new exterior lighting shall consist of downcasting shielded fixtures so as not
to cast light beyond the property line. Any changes in lighting shall be approved
by the City Planner prior to installation.
4. For purposes of calculating road impact fees under the South Burlington impact
fee ordinance, the Planning Commission estimates that the proposed use will generate
13.45 additional vehicle trip ends during the P.M. peak hour.
5. The fence proposed along San Remo Drive shall include an opening in front of the
front door in order to provide more direct pedestrian access from the street.
6. The applicant shall obtain a zoning permit within six (6) months pursuant to
Section 27.302 of the zoning regulations or this approval is null and void.
7. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to occupancy of the converted building.
8. Any change to the site plan shall require approval by the South Burlington
Planning Commission.
9. Based on expressed representation of the application, there shall be no outside
storage or display of merchandise.
