Dear Bob and Lynn Charlier: Our office has completed an initial review of the above referenced project and has determined that the additional information listed below will be needed before approval can be granted. Please note that those comments concerning the interior waste and water distribution and ventilation plans were prepared by Mr. Robert Hood, Environmental Technician. (1) The 1 inch water service entrance within the building does not have a ten foot horizontal separation distance from the nearby soil and waste lines located below grade or within the slab. The ten foot separation is shown on the exterior site plan. Please submit 2 sets of revised plumbing plans to show this correction. Upon receipt of the above items, we shall continue our review. Should there be any further questions, please do not hesitate to contact me. The subject property is shown as Lot No. 1 on the plan attached hereto as Exhibit A. Investors Management Company, Inc. (by a predecessor company) acquired Lot No. 1 in 1979. On July 17, 1985, Robert and Lynn Charlier entered in an agreement to purchase this property from Investors Management Company. In August of 1985, they applied for site plan approval for the subject property and obtained such approval from the Planning Commission on September 24, 1985. On September 19, 1985, five days before the granting of the site plan approval mentioned above, Investors Management Company purchased Lot No. 2 shown on the attached plan. It is my understanding that this property was occupied as a residence at the time of such purchase. On March 12, 1986, Investors Management Company conveyed the Park and Ride property to P & T Land Investment Partnership, a partnership with Robert and Lynn Charlier as partners. This property was thereafter developed and has been used as Park and Fly. On June 27, 1986, Investors Management Company conveyed Lot No. 2 shown on the above -referenced plan to Michael and Trudy Haire. The issue presented on the basis of the above -stated sequence of conveyances is whether Lot No. 2, a substandard lot, merged with Lot No. 1 at the time of its acquisition by Investors Management Company on September 19, 1985. It is our opinion that it did not. J Mr. Joseph Weith April 28, 1994 Page 2 The Charliers entered into a contract to purchase Lot No. 1, and applied for a site plan approval for the Park and Fly business on the property before Investors Management Company acquired Parcel No. 2. Based on this, the contract to purchase the property and the site plan submitted in support of site plan approval encompassed all of the property owned by Investors Management Company at the time such documents were prepared. This status changed only a couple days before final approval by the City. However, following the approval, the Charliers completed purchase of Lot No. 1 and developed the property in accordance with approval they applied for. Under these circumstances, the Charliers in effect acquired vested rights in the application they submitted for the Park and Fly business. Since, after receiving approval, they completed purchase of the property and development of the business in accordance with the approval granted, they have a strong argument under Vermont law that they are entitled to maintain the business in the form approved by the Planning Commission. This in turn defeats any claim that Lot No. 2 merged with Lot No. 1 when it was acquired by Investors Management Company. Very truly yours, Steven F. Robert and Lynn Charlier are in fact partners of P & T Land Investment Partnership which owns the land and operates the Park & Ride business. Robert and Lynn did file the site plan application for approval by the South Burlington City Planning Commission in August of 1985 on behalf of the partnership. 2. The sales agreement to purchase 481 White Street (the property upon which the Park & Ride business is operated), was entered into with Investment Management Company, Inc. on July 17, 1985. That is the date the Charliers paid the deposit required by the Sales Agreement. As you noted, both the Sales Agreement and the application for site plan approval were filed prior to the conveyance of Lot # 1 (the house lot) by Paul and Linda Meade to Investors Management Company, Inc. on September 19, 1985. In fact, that deed was not recorded in the South Burlington City Land Records until the day after the South Burlington City Planning Commission had given its final site plan approval on the evening of September 24, 1985. After analyzing the sequence of events, it is my understanding that we are in agreement that merger of the two properties (the large P & T business lot and the house lot) did not occur and therefore no actual subdivision occurred when Investors Management Company, Inc. conveyed the P & T business lot to P & T Land Investment ( Steve Stitzel, Esq. GRAVEL AND SHEA April 29, 1994 Page 2 Partnership. This conclusion is justified for two reasons. First, Investors Management Company, Inc. had already divested equitable title in the P & T business lot by executing the Sales Agreement on July 17, 1985, more than two months before it actually took title to the house lot. Second, since the Charliers had filed the application for site plan approval before Investors Management Company, Inc. took title to the house lot, the Partnership had obtained a vested interest in the site plan approval prior to the conveyance of the house lot to Investors Management Company, Inc. I understand you will provide an opinion along those lines to Joe Weith, who will acknowledge endorsement and acceptance of the opinion. You and Joe will obtain the South Burlington City Planning Commission's agreement with your opinion at your meeting to be held next Tuesday evening. The land falls away to a stream. He said he might possibly build a house on the land someday. He has improved the current structure. There were no major objections and Mr. Jacob agreed to view the property and give his opinions. �!. Site Plan application of Robert & Lynn-Charlier for construction of a 1040 §A ft building for Park & Ll business located on White St. Extension Ms. Charlier noted the Commission approved a location at Gregory Industrial Park but there was a concern about traffic so they got another site. They have met with the Airport people and no objections were made. Mr. Duncan said the land is 2.4 acres, accessed from White St. Extension. It backs along the Airport fence. The project will not have any car service area, just arrival/departure facilities. They can park 207 cars on site. The area will be mostly crushed stone. The site collects torm water from the airport and there is an area that ponds water. This is alleviated by a 12" main. The pond will be enlarged and maintained. Mr. Szymanski suggests upgrading White St. Extension to a public street. The Charliers have bought the land across the street and they suggest making it a prive street. We are not asking that the y City "throw up" or abandon White Street Extension, only that the improvements to White Street be those as depicted on the submitted plan rather than constructing White Street to city street standards. As I indicated, White Street Extension presently serves only two properties. One is the house on the southeast corner of the intersection of White Street Extension and Airport Drive whose driveway exits off White Street Extension (property presently owned by the City of Burlington), and the other property is that of Mr, and Mrs. Charlier, a portion of which is now devoted to the park and fly operation. My clients have agreed that they will install, repair and maintain the paved roadway and'sidewalk, including snowplowing. Their liability insurance coverage issued in connection with the operation of the business will extend to cover all liability for the roadway on White Street Extension. Should the City desire a more formal documentation of my clients' commitment to maintain and repair the roadway, they would be glad to execute any appropriate agreement you may see 'Lit to submit to them. Mr. William Szymanski October 24, 1985 Page Two In light of the fact that the roadway to be constructed from Airport Drive to the Park and Fly property will not be required to meet city standards, the construction costs as quoted by Webster Martin Consulting Engineers has been reduced from $24,000 to $11,000. Accordingly, my clients are prepared to execute a three party agreement to escrow the $11,000 to insure completion of the roadway and sidewalk in compliance with the plans. By way of explanation, the business will not generate any large truck traffic on White Street Extension. The business will operate with shuttle vans which will provide continual transportation to and from the doors of the airport for customers' parking at its facility. It is anticipated that there will be little, if any, pedestrian traffic generated by the operation of the business. It is anticipated that cars parking at the facility will in general be those using air transportation for longer business or pleasure trips. Customers using the facility will have the benefit of knowing their vehicles are secured at all times and that their vehicles will be warmed up and heated or cooled as the weather dictates when they enter the vehicle upon returning from their trip. The business is intended to compliment and provide an important auxiliary service to the airport itself and will help to alleviate a severe parking problem that now exists. Storm drainage is a problem that must be looked into by a professional engineer. The airport dischages storm water via a 30" pipe onto the property. Their exists a holding pond. Phase 2, for which approval is not being requested at this time, would involve filling, lighting and fencing. This would be an expansion of the Park & Travel business located across the street from this project site. The Zoning Board of Adjustment will hear the applicant's request for a conditional use permit for multiple use of the property on January 24, 1994. This property located at 1392 Airport Drive lies within the Airport District. It is bounded on the north by a single family residence, on the west by Airport Drive, on the east by the Burlington International Airport and the south by White Street. Access/circulation: Access is currently provided by a 14 foot curb cut on Airport Drive to serve the single family residence. The applicant is proposing unlimited access along White Street for a distance of 160 feet. This portion of White Street is a cul-de-sac serving the existing Park & Travel business, the proposed parking area and an emergency access to the airport property. The applicant is exploring the possibility of having this portion of the street thrown -up so it would no longer be a city street. Circulation is adequate. Coverage/setbacks: Building coverage is 5.3% (maximum allowed is 30%). Overall coverage is 45.2% (maximum allowed is 70%). Front yard coverage along Airport Drive is 28.4% (maximum allowed is 30%). The dwelling and garage do not meet the setback requirements. These structures are therefore subject to Section 19.002 of the zoning regulations. Landscaping: There is no minimum landscaping requirement, based on building cost, for this project. It is bounded on the north by Swift Street, on the east by an office/warehouse building, on the south by Pizza Hut and on the west by an auto service station owned by the applicant. Access/circulation: Access is provided by a 30 foot curb cut on Swift Street and an access drive at the rear of the property to the adjacent service station. No access changes proposed. Circulation is adequate. Coverage/setbacks: Building coverage is 33% (maximum allowed is 30%). Overall coverage is 77% (maximum allowed is 70%). Although current coverage limitations are being exceeded, this application will not increase the degree of noncompliance. Building does not meet setback requirements and is therefore subject to Section 19.002 of the zoning regulations. Landscaping: The minimum landscaping requirement, based on building costs is $60 which is not being met. The site is well landscaped so staff does not recommend any additional landscaping. It is our understanding from our meeting that there will be a 6' chain link fence constructed approximately 1' from our common property line to a point approximately 3' west of the east side of the existing garage, then south to White Street. Also there will be sugar maple trees planted on the fence line from my property line to White Street. We request that a hedge of an appropriate nature, height of 5' or more be planted between their fence and the parking area along our common property line and from our property line south to the new location of the garage. We consider something of the nature of cedar trees that would shield our property from noise, debris and light. A stipulation is requested that care of the trees and hedges be maintained for a minimum of 5 years, since damage to these items can be caused by snow removal or neglect. It is expected that the buffer zone will be the minimum required by City of South Burlington zoning and planning requirements. Second, we request any lights added to this area have a shield installed to reduce the amount of light shinning in our back bedroom. Third, we wish a stipulation that the residential area of the lot be use exclusively for residential use and no activity or business use of this area be permitted. That is, no Park & Travel overflow of cars be parked in this area, no Park & Travel washing, vacuuming, mechanical repairs, etc. or storage, advertizing or selling of property not directly owned by the persons residing in the residential area.
