Call to order, emergency procedure, agenda review, comments from guests 2. Review and approval of minutes of 05/14/2019 committee meeting 3. Chair’s comments 4. Welcome Regina Mahoney from CCRPC to lead discussion of the latest draft of inclusionary zoning regs for Transit Overlay District and the memo to the Planning Commission and vote to adopt if ready 5. Call to order, emergency procedure, agenda review, comments from guests: John called the meeting to order at 10:02 a.m. He reviewed the exit procedures. There were no public comments. 2. Review and approval of minutes of 05/08/2019 committee meeting: Leslie moved and Mike seconded motion that the minutes of the 05/14/19 meeting be approved as drafted. Sandy indicated that minor correction was needed as meeting took place in Summit Room, not the Champlain Room. Leslie and Mike modified their motion to reflect this correction. Motion passed 4-0-1. 3. Chair’s comments: John reported that, on May 20th, the City Council interviewed Mike, Sandy, and him for re-appointment to the committee. According to Celine Ingalls, no other City residents have applied for consideration for appointment to the committee. John plans to follow up, again, with Kevin Dorn regarding the committee’s request that the City Council increase the size of the committee from seven (7) to nine (9) members. 4. Welcome Regina Mahoney from CCRPC to lead discussion of the latest draft of inclusionary zoning regs for Transit Overlay District and the memo to the Planning Commission and vote to adopt if ready: Regina passed out a revised version of the IZ proposal cover memo and the revised version of the LDRs relating to expanding the application of Inclusionary Zoning to include the Transit Overlay District. Sandy proposed that the committee take action to approve having all Inclusionary rental units be affordable to households with incomes no greater 80% of Area Median Income (AMI) and having all Inclusionary home-ownership units be affordable to households with incomes no greater 100% of Area Median Income (AMI). This action was needed because these changes had not been formally endorsed at the May 14th committee meeting. Leslie moved and Mike seconded that the LDRs require that all Inclusionary rental units be affordable to households with incomes no greater 80% of Area Median Income (AMI) and all Inclusionary home-ownership units be affordable to households with incomes no greater 100% of Area Median Income (AMI). The motion passed 4-0-1. Members then focused on the draft Cover Memo to the Planning Commission. Members proposed the following modifications to the memo. (a) The “From” is to read: “John Simson on behalf of the South Burlington Affordable Housing Committee. (b) On page 2, in the rental example the Max Rent be changed to $1,375 and it be a 1-bedroom unit (instead of a 2-bedroom unit), the Max Household Income be changed to $58,650, and “(based on a 4- person household)” be deleted. (c) On same page, in the ownership example, the Max Household Income be changed to $73,300, and “(based on a 3-person household)” be deleted. (d) On same page, in the next table, in “For reference:” etc. box, delete “(based on a hypothetical 4-person household).” (e) On same page, in the same table, delete the Three bedroom column under “Maximum Rental Prices” and the Four bedroom column under “Maximum Purchase Price for Homeownership.” (f) On same page, in the same table, delete footnote reference “3” from Median NEW Sale Prices, changing it to “4” and add “3” to Maximum Purchase Price for Homeownership. (g) On page 3, in first column, delete “Construction” and insert in its place “Homes.” Sandy moved and Leslie seconded that the committee approve the changes to the memo described above. The motion passed 5-0-0. Members then reviewed the changes to the draft Inclusionary Zoning regulations. Members proposed a minor placement change in 18.01 D. Affordability Requirements, subsection (1) and deletion of “and any others listed . . . “ in 18.01 D. Affordability Requirements, subsection (1)(c)i.(a). John then moved and Leslie seconded that the committee approve the entire latest draft Inclusionary Zoning LDRS for the Transit Overlay District, as modified by the above changes, be approved. The motion passed 4-0-1. Because Todd needed to leave the meeting early, the committee then moved to agenda item 6. 5. Discuss Planning Commission TDR subcommittee Draft TDR Overlay map: John summarized informal position of TDR subcommittee as follows: (a) Receiving areas in SEQ that the Open Space subcommittee does not designate as priority areas for natural resource protection will continue to be receiving areas. (b) In secondary areas density will be limited to base zoning maximums; increased density via TDRs will not be allowed. (c) A TDR “marketplace” needs to be established. Will provide information on numbers and locations of TDRs available for purchase. (d) They subcommittee will identify areas outside the SEQ that may receive TDRs for increased density. (e) City will create a record (databank) of all TDRs in SEQ. (f) Need to find ways to make TDR system work better: ideas include City purchasing the TDRs, “Open Space” large-lot zoning (Amanda indicates it would survive court challenge), members do not support large-lot zoning because land that is not developed is not permanently conserved, Amanda (City Attorney) is developing amendments to TDR LDRs that respond to deficiencies cited in Environmental Court decision. An estimated 1100 TDRs remain available for purchase. 6. Discuss content options/suggestion for IZ Handbook: Members supported the FAQ approach for Handbook content. Members want two separate Handbooks—one for consumers and one for developers. Members are to provide input to Todd and he will prepare a second draft. 7. Reports and updates by committee members: Instead of reports and updates, members discussed follow-up plan regarding submission of Cover Memo and draft Inclusionary Zoning LDRs. Regina will send revised Memo and draft LDRs to John by the end of the week. John will send the memo and LDRs electronically to all Planning Commissioners and Paul Conner the week of June 3rd. The Committee, with Regina’s assistance, would like to present the draft Inclusionary Zoning LDRs to the Planning Commission at its June 25th meeting. Sandy will send email addresses for Planning Commissioners to John. 8. Adjourn: At 12:19 p.m. Mike moved and Leslie seconded motion that the meeting be adjourned. Motion passed 4-0-0. (Quoted from January 23, 2018, meeting minutes) “John asked Mike to prepare a work plan for the committee to collaborate with Coralee to enhance its effectiveness in communicating with residents via the City’s website and via other means. The plan should include specific assignments to be carried out by identified committee members. Mike accepted this assignment.” Homework (not yet reported on): All bike rack tasks should include date of assignment and date for task completion.
