FINDINGS OF FACT & DECISION
STATE OF VERMONT

CITY OF SOUTH BURLINGTON
Re: Findings of Fact, application of Donny's N.Y. Pizza to replace four (4) windows in a building
containing a restaurant and convenience store, 364 Dorset Street.
On the 3`d day of August, 1999, the South Burlington Development Review Board approved the
request of Donny's N.Y. Pizza for design review approval under Section 24.20 of the South
Burlington Zoning Regulation's based on the following findings:
1. This project consists of replacing four (4) windows in a building containing a restaurant and
convenience store. The removal of existing windows and replacing them with a window of different
design and/or color triggers design review. The applicant is also proposing to remove some shutters
and paint a lattice vent cover as recommended by the City Center Design Review Committee. The
applicant is proposing no other changes to building or property.
2. The application was reviewed by the City Center Design Review Committee on July 20, 1999.
The Committee decided to not recommend major changes to the building and property. They felt that
since the applicant was proposing only to replace existing windows in the exact same space, then the
level of required design improvement should be commensurate with the proposed change. The
committee recommended that the color of the windows match existing windows and doors, shutters
along Dorset Street be removed, a lattice vent cover and the door located along Dorset Street be
painted a color similar to the stone siding, and an existing light be removed or replaced with a
downcasting fixture. The recommendations of the Design Review Committee are contained in the
enclosed meeting minutes.
3. The criteria by which the DRB must review an application are summarized below.
BUILDING DESIGN
4. Consistent Design: The existing building does not meet this criterion. The building materials on
the front half of the building are different from materials on the back half of the building. Also,
window design is inconsistent.
S. Materials: The existing building does not meet this criterion. The front half of the building consists
of artificial stone and the back half consists of metal siding. Section 24.401(b)(iii) prohibits metal
skin.

6. Colors & Textures: The existing building does not meet this criterion. The textures of building
materials are different between the front half of the building and the back half.
7. Windows and Doors: Windows and doors appear to be arranged in a pattern. Doors appear to
be of different types and styles. The window air condition units on the south side of the building
detract from the design.
8. Design Elements: There does not appear to be any thought to using vertical and horizontal design
elements to improve the design of the building.
9. Roofs: The existing roof is flat on the front half of the building and a very low pitch roof on the
back half of the building. No changes or improvements are proposed.
10. Orient Buildings to Public Street: The building is not well oriented to the public street. It is
oriented to the parking lots located on the north and south sides of the building.
11. Rooftop Devices: There are a number of rooftop devices on the existing building which are not
screened.
12. Energy Efficiency The applicant should address how this criterion is being met.
SITE DESIGN
13. Landscaping: This property is almost 100% covered with pavement and building. No changes
or improvements proposed.
14. Special Features: This criterion is not met with the existing building. Air conditioning units, ice
machine, and electric boxes are not screened and are visible to the public.
15. Walls/fences: There is currently a chain link fence with barbed wire and striped webbing on the
south side of the building. No changes proposed.
16. Accessible open space: Not applicable since no open space exists or is proposed.
17. Circulation: vehicular circulation is adequate. Pedestrian access is inadequate. The building is
surrounded by access drives and parking. No separate pedestrian facilities on the site.
18. Exterior Lighting: Details of exterior lighting was not submitted. Staff and the Design Review
Committee recommend that the light on the southwest corner of the building be replaced with a
downcasting shielded fixture.
19. Nature's Events: The issue of runoff and snow fall does not seem to be a problem.

20. Security & Safety The applicant should explain how these issues are being addressed.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves the
design review application of Donny's N.Y. Pizza to replace four (4) windows in a building used for
a restaurant and convenience store, 364 Dorset Street, as depicted on a photo exhibit dated
"received" 7/28/99, with the following stipulations:
1. Prior to issuance of certificate of occupancy/compliance, the applicant shall be responsible for the
following improvements:
a) The light fixture on the southwest corner of the building shall be removed or replaced with
a downcasting shielded fixture. The type of replacement fixture shall require approval of the
Director of Planning & Zoning.
b) The door and door frame along Dorset Street shall be removed.
d) The screen lattice to the left of the pizza restaurant entrance on the north side of the
building shall be painted a similar color as the stone facing on the building so that it blends
in better with the stone facing.
c) The shutters on the front of the building along Dorset Street shall be removed.
d) The screen lattice to the left of the pizza restaurant entrance on the north side of the
building shall be painted a similar color as the stone facing on the building so that it blends
in better with the stone facing.
2. The applicant shall obtain a certificate of occupancy/compliance from the Administrative Officer
upon completion of the window replacement project.
