Due to circumstances beyond our control, and in spite of starting the process in February, 1995, we have simply been unable to get our proposed contractor to respond to repeated telephone calls over the past 3 weeks. I cannot do business that way, and have thus contacted another landscape contractor, and am starting the process over again. I assure you that we want to do the landscaping, do it once, and do it right. I anticipate that we will have it completed within 30 days, but to be on the safe side, I am requesting an extention of our deadline until August 1, 1995. Site Plan application of BRT, Inc, c/o Thompson Travel, Inc, to construct a 2,730 sq. ft., 2-story addition to an existing 1,422 sq. ft. building for office use (travel agency) 40 Patchen Rd: Mr. Thompson stated he has an option to buy this property. Mr. Naef said the Zoning Board granted approval for additions to a non -conforming structure and for violations of required setbacks. Members questioned why they were even looking at the application since the Zoning Board had taken virtually all decisions out of the Commission's hands. Mr. Naef said there is a question of parking. According to gross square footage, they need 17 spaces, but only 12 can be provided with available space. Members felt they had to be consistent, as in the past they had required applicants to base parking on gross floor area. Mr. Weith said the shortfall in parking would be 35%. Mr. Thompson said they can build the building without a basement but want to keep the garage. The garage will be used for one vehicle plus storage for recycling and trash. It can also be an entry area for employees. Members did not have a problem with the garage but asked for a stipulation that it cannot be converted to office space. With regard to traffic, 15.1 peak hour trip ends are allowed. Without the basement, traffic comes to 15.18. Members felt this was acceptable. Mr. Naef noted they are short between $200-400 in landscaping. Without the basement, they should come out even. Mr. Weith said lighting needs to be resubmitted as only downcasting, shielded lights are allowed. Mr. Austin moved the Planning Commission approve the site plan ap- plication of BRT, Inc, c/o Thompson Travel, Inc, to construct a 2,730 sq. ft., two-story addition to an existing 1,422 sq. ft. building for office use (travel agency), 40 Patchen Road, as de- picted on a plan entitled "Proposed Office for: BRT, Inc, c/o Thompson Travel, Inc, 125 St. Paul St., Burlington VT " dated June 6, 1994 with a last revision date of June 22, 1994. subject to the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This site plan approval shall not be construed as approval to alter a noncomplying structure. The decision of whether or not to approve alteration of a noncomplying structure shall be made by the Administrative Officer in accordance with Section 19.002 of the PLANNING COMMISSION 28 JUNE 1994 PAGE 9 zoning regulations. 3. The Planning Commission approves the reduction in the number of required parking spaces from 13 to 11 spaces. It is the Planning Commission's opinion that adequate parking will be available. 4. A $2,450 landscape bond shall be posted prior to issuance of a zoning/building permit to cover the cost of the new landscaping. The bond shall remain in effect for three years to assure that the landscaping takes root and has a good chance of surviving. 5. The plan shall be revised prior to issuance of a zoning/ building permit to show the changes listed below and shall require approval of the City Planner. Three copies of the approved revised plan shall be submitted to the City Planner prior to permit issuance. a. The plan shall be revised to reflect the correct coverage information as determined by staff calculations. b. The plan shall be revised to show shrubbery around the ground mounted spotlights for the sign. The planting list shall be revised accordingly. c. The plan shall be revised to provide details of site lighting which is downcasting and shielded. 6. This property is located within Traffic Overlay Zone 5 which allows this lot to generate 15.1 vehicle trip ends (vte's) during the PM peak hour. It is the Commission's opinion that the proposed office use (travel agency) will not exceed the 15.1 vte limit. The applicant shall contribute $1 036 to the Williston Road Traffic Impact Fund - Area 1 prior to issuance of a zoning/buildinq_permit for the additional 8.3 vte's estimated to be generated by this proiect. 7. The applicant shall obtain a zoning/building permit within six months or this approval is null and void. 8. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the newly constructed addition. 9 Any change to the site plan shall require approval by the _South Burlington Planning Commission. 10. Based on expressed representation of the applicant, the proposed garage will be used as a parking space and also for dumpsters and recycling. Any increase in GFA shall require Planning Commission approval. Ms. Peacock seconded. Motion passed unanimously. Mr. Sheahan said he is becoming increasingly uncomfortable with projects such as this which have a number of variances that limit the Planning Commission's review process. Other members agreed this makes it very difficult to do the job the Commission is supposed to be doing. 6. Site Plan application of Burlington Indoor Tennis Center, Inc, dba Twin Oaks Sports & Fitness to remove an existing loading dock and convert 9000 sq. ft. of an 11,000 sq. ft. building to a day care center with a maximum of 24 children and indoor recreation facility for children, 80 Farrell St: Mr. Smith said the building will have 2 tenants: Blue Prints, Etc., and Kids and Fitness. The site is heavily landscaped but they will add some landscaping to screen parking. They will expand the front parking lot and reduce the back parking lot to allow for a play area. They will also reduce the width of one curb cut. The two businesses will have separate entrances. Mr. Burgess asked if a variance will be required for the 25% rule. Mr. Weith wasn't sure. Regarding parking, Mr. Smith said they will have 8 spots for the blueprint business and are asking for 1 per 400 sq. ft. for the day care facility which is the same ratio as at their other similar facility. Members had no problem with this. Mr. Weith said a floodlight at the back of the building should be rotated straight down. The applicant agreed to do this. Existing building No. 36 should be connected to the municipal sewage collection system especially since there will be extensive grading around this building which will probably disturb existing system. 2. Placing sewage pumping station within 2'-6" of edge of road is a problem. Road snow plowing will bury the access opening which has to be open and checked daily. The control box can also be damaged especially being located on the outside of a road curve. The station should be at least 10 feet from edge of road. 3. Sewage pumping station should be operated with three phase power. With alarm connected to Police Station. Area around pumping station and control box shall be paved. 4. Additional information regarding the pumping station construction will be requested. 5. Street parking will have to be restricted at least on one side to allow for emergency vehicles. Being private streets this may be difficult to enforce. 6. Street lights should be included in the development. 7. Sidewalks should be provided including along Patchen Road at least to Interstate highway bridge. Sidewalks to Kirby Road where there is bus service should be considered. 8. Streets should be public, 30' in width built to City standards. 9. Water Department to review water main layout. 10. A hydrant must be located near sewage pumping station for periodic flushing and cleaning of station. 4) Proposed Beauty Salon (40 Patchen Road) 1. Existing curb opening on White Street shall be removed and a new concrete barrier curb poured. Disturbed road pavement shall be patched. 2. New curb opening shall be a poured concrete depressed curb. Existing barrier curb shall be removed in sections. 3. A parking lot drainage inlet should be installed to drain area. It may be possible to pipe it to the street drain at corner of Patchen Road and White Street. This should be checked. Memorandum Next week's agenda items 4/18/83 Page 2 (3) Legal documents were submitted late. At this writing we still have not received information on the proposed land and building ownership arrangement. (4) Water department approval is pending. I cannot recommend final plat approval until these matters are resolved. I am particulary concerned that the landscaping requirements not be allowed to slide. 4) LePage This lot crosses C1 and R4 zones at the corner of White Street and Patchen Road. The Zoning Board has approved the requested beauty salon but has delayed action on any office use until a specific tenant is known. According to traffic standards in the zoning ordinance this small lot with previous residential use could be upgraded to commercial uses with up to 10 or 11 trips per hour. The proposed hair salon may slightly exceed that volume at times, but overall itisa reasonably low volume commercial use. Also, the applicant is relocating the one existing curb cut to a point further away from the main intersection. This improvement should be given some credit. I'.owever, permission for the office use may have to wait until after observation of traffic at the beauty salon. Gravel parking will be provided for 15 cars, an adequate number. However, one dimension is sub -standard, and a revision may result in the loss of one space. The adjacent property owner to the south currently parks on a portion of this property. Some resolution of this arrangement must be worked out. Some landscaping exists, including several trees along the property line of the one abutting residential use. Also, additional shrubs and trees will be planted according to our landscaping formula. 5) Bartlett Commercial Lots This is the second proposed grouping of lots within the overall commercially - approved portion of the Bartlett property. These 5 lots will complete subdivision of land on the south side of Harbor View Road. Proposed lots range from 45,000 to 65,000 square feet. All lots have an ample amount of usable area with the possible exception of lot 7 which is crossed by a "minor stream." Two pairs of lots will be able to share curb cuts and one lot will have its own entrance. If the initial 3 commercial lots are included, there will be a total of 5 curb cuts serving 8 lots with 1725 feet of frontage (one curb cut every 345 feet). This is a very satisfactory arrangement. Also, it appears likely that access for the large undeveloped commercial area north of Harbor View Road will be able to line up with one of the proposed joint curb cuts. Memorandum Next week's agenda items 4/18/83 Page 3 6) Tilley The Tilleys own a large parcel of land with frontage on Hinesburg Road just north of I-89. The front portion is zoned Rl and the larger rear portion is IC. The Tilleys are proposing an in -family transfer of ownership of a portion of their land with the dividing line along the zoning boundary between front and rear land. There is a very major question of access for future development of the in- dustrial portion of this property. However, I am hoping to avoid resolution of that difficult issue at this time. The property has legal access onto Hinesburg Road, but there is no good location there for a major access road. It would be preferable if access could be provided across the O'Brien industrial property onto Kimball Avenue. At the time of actual development I am optimistic that something can be worked out. For now, some legal access would have to be granted for the rear land. Since there is legal access to Hinesburg Road for the entire property now, I suggest that such legal access be retained for both parcels.
