FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, design review application of Scott Gordon to amend a planned unit
development consisting of. 1) a 4800 square foot building consisting of 3,600 square feet
of convenience store use and a 1200 square foot fast food restaurant with twenty two (22)
seats, and 2) an 8,060 square foot building consisting of 3500 square feet of general
office use and 4560 square feet used for a multiple number of commercial uses for a
multiple number of tenants. The amendment consists of converting 600+I- square feet of
convenience store use to fast food use and adding one rooftop device, 364 Dorset Street.
On the 25th of July, 2000, the South Burlington Development Review Board approved
the design review application of Scott Gordon under Section 24.20 of the South
Burlington Zoning Regulations based on the following findings:
1. This project consists of amending a planned unit development consisting of: 1) a
4800 square foot building consisting of 3,600 square feet of convenience store use
and a 1200 square foot fast food restaurant with twenty two (22) seats, and 2) an
8,060 square foot building consisting of 3500 square feet of general office use and
4560 square feet used for a multiple number of commercial uses for a multiple
number of tenants. The amendment consists of converting 600+/- square feet of
convenience store use to fast food use and adding one rooftop device, 364 Dorset
Street.
2. The owner of record is Randall Munson.
3. Consistent Design: The change in use will only result in one exterior change. The
applicant has proposed to add one conical roof top device over the south facade of the
building. The restaurant currently occupying 1200 square feet of the building has
three unscreened roof top devices over the northern fagade of the building. This
building has not been rehabilitated and a number of the exterior attributes of the
building have yet to be substantially addressed. As the applicant is proposing a
relatively minor change to the exterior, it is recommended that the brunt of the
building's deficiencies not be brought to bear on the part of the applicant. The roof
top device is compatible and consistent with existing roof top devices and the exterior
appearance of the building.
4. Materials, Colors and Textures: The roof top device will be constructed of sheet metal
and will be unpainted as the other three rooftop devices on the building currently are.
5. Human Scale Design: The roof top device does not contribute to promoting a human
scale design. The existing roof top devices do not promote a human scale design, as
they are not screened from public view. As stated previously though, the applicant
has proposed a relatively minor change to the exterior of the building, and it is
recommended that the brunt of the building's deficiencies not be brought to bear on
the part of the applicant.
6. Roof as a DesigLi Element: The proposed roof top device will be unscreened.
Screening the proposed device with a louvered cupola type box may make the device
more attractive from a design perspective, but this would also result in a design
element distinctively different from the design of the building.
7. Orientation of Building to the Street: The proposed roof top device will have no affect
on the orientation of the building to the street.
8. Landscape and Plantings: No additional landscaping is proposed.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves the design review application #DR-00-15 of Scott Gordon to amend a planned
unit development consisting of: 1) a 4800 square foot building consisting of 3,600 square
feet of convenience store use and a 1200 square foot fast food restaurant with twenty two
(22) seats, and 2) an 8,060 square foot building consisting of 3500 square feet of general
office use and 4560 square feet used for a multiple number of commercial uses for a
multiple number of tenants. The amendment consists of converting 600+/- square feet of
convenience store use to fast food use and adding one rooftop device, 364 Dorset Street,
as depicted on a four page set of plans, entitled "South Burlington Realty, South
Burlington, Vermont, Site Plan", dated 5/7/99, with a stamped received date of 7/14/00,
with the following stipulations:
1. All previous approvals and stipulations, which are not superseded by this approval, shall
remain in effect.
2. This recommendation for approval of the proposed addition is based on the
application's compliance with the design review criteria contained in Section 24 of
the South Burlington Zoning Ordinance. The Code Officer shall make the
determination of whether or not this application complies with all other requirements
contained in the zoning ordinance.
