HomeMy WebLinkAboutDR-00-30 - Decision - 0364 0366 0368 Dorset Street#DR-00-30 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, #DR-00-30 of South Burlington Realty Company to amend a planned unit development consisting of 1) a 4800 square foot building consisting of 3,600 square feet of convenience store use and a 1200 square foot fast food restaurant with twenty two (22) seats, 2) an 8,060 square foot building consisting of 3500 square feet of general office use and 4560 square feet used for a multiple number of commercial uses for a multiple number of tenants, 3) an 8,944 square foot building (phase 1) and a 13,640 square foot building (phase 2) for a multiple number of commercial uses for a multiple number of tenants, 364, 366 and 368 Dorset Street. The amendment consists of converting 2,500 square feet of convenience store use to an tai koun do educational facility, 364 Dorset Street, 364, 366, & 368 Dorset Street On the 19th of December, 2000, the South Burlington Development Review Board approved the design review application of South Burlington Realty Company under Section 24.20 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a planned unit development consisting of: 1) a 4800 square foot building consisting of 3,600 square feet of convenience store use and a 1200 square foot fast food restaurant with twenty two (22) seats, 2) an 8,060 square foot building consisting of 3500 square feet of general office use and 4560 square feet used for a multiple number of commercial uses for a multiple number of tenants, 3) an 8,944 square foot building (phase 1) and a 13,640 square foot building (phase 2) for a multiple number of commercial uses for a multiple number of tenants, 364, 366 and 368 Dorset Street. The amendment consists of converting 2,500 square feet of convenience store use to an educational facility (tai koun do school), 364 Dorset Street. 2. The owner of record is Randall Munson. 3. This property is located within Central District Two. It is bounded on the west by Dorset Street, the south and east by San Remo Drive, and on the north by a commercial property. 4. The City Center Design Review Committee reviewed this proposal at their 12/18/00 meeting. The Committee recommended that the Development Review Board approve the application with conditions. 5. The applicant was required, by the July 2000 approval, to bring all changes in use for the building located at 364 Dorset Street before the Design Review Committee as this building has yet to be substantially rehabilitated. The applicant proposed no changes to the exterior of the building and stated that the rear portion of the building may be demolished within a two year period at which time the building would be substantially rehabilitated or replaced. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the design review application #DR-00-30 of South Burlington Realty Company to amend a planned unit development consisting of: 1) a 4800 square foot building consisting of 3,600 square feet of convenience store use and a 1200 square foot fast food restaurant with twenty two (22) seats, 2) an 8,060 square foot building consisting of 3500 square feet of general office use and 4560 square feet used for a multiple number of commercial uses for a multiple number of tenants, 3) an 8,944 square foot building (phase 1) and a 13,640 square foot building (phase 2) for a multiple number of commercial uses for a multiple number of tenants, 364, 366 and 368 Dorset Street. The amendment consists of converting 2,500 square feet of convenience store use to an tai koun do educational facility, 364 Dorset Street, 364, 366, & 368 Dorset Street, as depicted on a five (5) page set of plans, entitled "South Burlington Realty, South Burlington, Vermont, Site Plan", dated 5/7/99, last revised on 12/11/00 with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This approval of the proposed addition is based on the application's compliance with the design review criteria contained in Section 24 of the South Burlington Zoning Ordinance. The Administrative Officer shall make the determination of whether or not this application complies with all other requirements contained in the zoning ordinance. All lights must be downcasting and shielded. Any new lights must be downcasting and shielded. Any new lights must be approved by the Director of Planning and Zoning prior to installation. 4. If the tai koun do educational use is to be extended beyond two (2) years of the date of this approval, the applicant shall submit a revised design review application for further years of use.
