FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, final plat application #SD-00-63 and design review application
#DR-00-28 of South Burlington Realty Company to amend a planned unit development
consisting of 35,444 square feet of mixed commercial use in four (4) buildings, 364, 366
and 368 Dorset Street. The amendment consists of making minor site layout and facade
modifications, 364-368 Dorset Street.
On the 2nd of January, 2001, the South Burlington Development Review Board approved
the final plat application of the South Burlington Realty Company under Section 204 of
the South Burlington Subdivision Regulations and the design review application under
Section 24.20 of the South Burlington Zoning Regulations based on the following
findings:
1. This property is located within Central District Two. It is bounded on the west by Dorset
Street, the south and east by San Remo Drive, and on the north by a commercial property.
2. The owner of record is Randall Munson.
3. This project consists of amending a planned unit development consisting of 35,444
square feet of mixed commercial use in four (4) buildings, 364, 366 and 368 Dorset
Street. The amendment consists of making minor site layout modifications.
4. This property is located within Central District Two. It is bounded on the west by Dorset
Street, the south and east by San Remo Drive, and on the north by a commercial property.
5. Lighting: Cut sheets for all fixtures have been provided. The applicant proposed
adding one (1) 70 watt metal halide wall light to the north fagade and one (1) to the south
facade of 368 Dorset Street and two (2) 70 watt metal halide wall lights to the north
fagade of 366 Dorset Street. All lights must be downcasting and shielded and approved
by the Director of Planning and Zoning.
6. Landscaping:, The applicant proposed minor site changes which include leaving the
transformer in its current location at the corner of San Remo Drive and Dorset Street,
allowing the wooden guardrail along Dorset Street to stay in its present location, and
removing the portion of sidewalk between the 8,944 square foot building at 368 Dorset
Street and the courtyard area along the east facade. At its December 18, 2000 meeting,
the Design Review Committee recommended against allowing the wooden guardrail to
stay.
7. Sidewalk: The applicant proposed curving a portion of the sidewalk leading in from
Dorset Street along San Remo Drive. This will not conform to the San Remo Drive
Streetscape plan but is necessitated by the existing transformer.
8. Design Review: The City Center Design Review Committee considered this application
at their December 18t' meeting.
The Design Review Committee recommended approval with the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2. This recommendation for approval of the proposed addition is based on the
application's compliance with the design review criteria contained in Section 24 of
the South Burlington Zoning Ordinance. The Administrative Officer shall make the
determination of whether or not this application complies with all other requirements
contained in the zoning ordinance.
3. The plans shall be revised to show the changes listed below and shall require approval
of the Director of Planning & Zoning (hereinafter Director). Four (4) copies of the
approved revised site plans shall be submitted to the Director prior to permit issuance.
a) The plans shall be revised to include an evergreen screen around the
transformer located at 368 Dorset Street.
b) The plans shall be revised to remove the wooden guardrail along Dorset
Street.
c) The plans shall be revised to screen the utilities on the east fagade of 368
Dorset Street with either landscaping or a closet to be approved by staff and
the gas piping painted to match the siding.
d) All lights shall be downcasting and shielded. Any changes to the lighting
shall be approved by the Director of Planning and Zoning prior to installation.
e) The elevations shall be revised to show a transom on the east facade of 366
Dorset Street centered on the gable to be approved by staff.
f) The elevations shall be revised to show a single door on the west facade of
366 Dorset Street.
g) The elevations shall be revised to show plain column bases on the south
fagade of 366 Dorset Street.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves final plat application #SD-00-63 and design review application #DR-00-28 of
South Burlington Realty Company to amend a planned unit development consisting of
35,444 square feet of mixed commercial use in four (4) buildings, 364, 366 and 368
Dorset Street. The amendment consists of making minor site layout and fagade
modifications, 364-368 Dorset Street, as depicted on a five page set of plans, page one
entitled "South Burlington Realty 364-368 Dorset Street South Burlington Vermont,"
prepared by Llewellyn -Howley, Inc, dated 5/7/99, last revised on 12/11/00, with the
following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. The plat plans shall be revised to show the changes below and shall require
approval of the Director of Planning & Zoning. Four copies of the approved
revised plans shall be submitted to the Director of Planning & Zoning prior to
recording:
h) The plans shall be revised to include an evergreen screen around the
transformer located at 368 Dorset Street.
i) The plans shall be revised to remove the wooden guardrail along Dorset
Street.
j) The plans shall be revised to screen the utilities on the east facade of 368
Dorset Street with either landscaping or a closet to be approved by the
Director and the gas piping painted to match the siding.
k) The elevations shall be revised to show a transom on the east fagade of 366
Dorset Street centered on the gable to be approved by the Director.
1) The elevations shall be revised to show a single door on the west fagade of
366 Dorset Street.
m) The elevations shall be revised to show plain column bases on the south
fagade of 366 Dorset Street.
3. All exterior lighting shall consist of downcasting shielded fixtures. Any change
to approved lights shall require approval of the Director of Planning & Zoning
prior to installation.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the zoning regulations or this approval is null and void.
5. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to occupancy of the buildings.
6. The final plat plans (site plan sheet 1 of 1) shall be recorded in the South Burlington
land records within 90 days or this approval is null and void. The plans shall be
signed by the Development Review Board Chair or Clerk prior to recording.
