Grantor Lydia Bartlett Lowell, a widow, is the sole surviving grantee of that conveyance and by a series of recorded instruments title to the lands hereby conveyed has become vested in the joint names of all four Grantors. In aid of this description reference is hereby made to the following recent selloffs by Grantors of lands located easterly of the second of the above -referenced unnamed brooks: Vol. 142 Page_ 440 1. By Warranty Deed dated December 2, 1977 (recorded in Vol. 139 , Page 334-7) Grantors conveyed to the Cify of South Burlington that certain parcel of land referenced above as "San. Pump Station Site" which is outlined in red and depicted as "Pump Station" on a plan entitled "Sewer Easement Plan No. 7 . Bartlett Bay Arpa" dated September 27, 1977 (recorded in Vol. 107 , Page 158 ). 2. By Quit Claim Deed dated December 2, 1977 (recorded in Vol. 120 , Page 544-7) Grantors conveyed to the City of South Burlington a right, in common with others, to pass and repass on foot and in vehicles over that certain 25 foot wide parcel of land referenced above as "Gravel Road" which is outlined in yellow and depicted - as "Gravel Road" on a plan entitled "Sewer Easement Plan No. 6 . Bartlett Bay Area - Pump Station Site" dated May 11, 1977 (recorded in Vol. 107 , Page 157 ), subject to the obligation on the part of the City of South Burlington to construct, improve, repair, maintain and plow said•Gravel Road. 3. By'said Quit Claim Deed Grantors also conveyed to the City of South Burlington an easement and right of way for the laying, construction, building, installation, maintenance, repairing, rebuilding, replacing, operation and patrol of drainage and sewer pipes, mains and conduits on, under, through and across that land which is outlined in red upon said (September 27, 1977) "Sewer Easement Plan No. 7" together with associated construction easement rights and subject to certain covenants on the part of the City of South Burlington as set forth therein. 4. By Warranty Deed dated December 1, 1.977 (recorded Vol. 139 Page 351-4) Grantors conveyed to Elizabeth K. "Annex , Edwards that parcel of land referenced above as to Edwards" which is located westerly of and adjacent to said "Pump Station" land, together with the right to use said "Gravel Road" for ingress and egress. The lands hereby conveyed are subject to the following rights in favor of others: a. A 20-foot wide sewer line easement previously granted to the City of South Burlington by Warranty Deed of Grantor Lydia B. Lowell dated February 4, 1958 (recorded Vol. 34 , Page 411 )• b. A 10-foot wide right of way over the footpath which runs along the westerly side of the land and premises hereby conveyed from said "Gravel Road".,in a southerly direction to the footbridge, which right of way is for the use of those Camp Bartlett property owners whose properties do not adjoin Lake Champlain, all as established by prior deeds of record. The right, in common with others, to use a right of way for access by foot only to Lake Champlain over lands of Catherine L. Price, which right of way begins at the southerly end of said footbridge and then extends in a general westerly direction to the waters of Lake Champlain, passing over and along that strip of land owned by Catherine L. 10tice which is bounded on the north by the first of the above -referenced unnamed brooks and on the south by lands depicted upon the aforesaid plat of "Property of Lydia B. The property is currently zoned R-1 -- PUD and we request that you recommend to the City Council that the area be re -zoned to R-4. The surrounding properties to the west and south are currently zoned R-4. The majority of the properties in the area are a half acre or less and contain camps or year round residences. To maintain the R-1 classi- fication would result in lots that are out of keeping with the balance of the area. We therefore feel that the subject property is improperly classified. The physical nature of the land is flat and such that it can be reasonably divided into eight (8) parcels. We feel that the economics of the develop- ment are such that it does not make economic sense to divide it into four (4) lots but eight (8) lots with the proper access would allow reasonably priced lots and reasonably priced homes. As I stated above, the uses of the adjoining properties are residences single family lots of half acre or less. It is clear that the City of South Burlington at this point is running out of residential lots and to develop this property would meet a pressing need within the City. We feel that this meets the goals and objectives of the South Burlington Master Plan and that it maintains an area as residential which has been residential for some time. The first two phases have received final approval and now that there is adequate sewage capacity, the final two phases are being submitted for approval. As a result of Act 250, measures for minimizing erosion have been substantially ex- panded. In addition, the overall landscaping plan is being presented. There have been some rearrangements of parking and building locations. No substantive issues have arisen, although the revised plan is being reviewed by the Tree Committee and the Fire Chief. Approval for Phase I has expired, but should be renewed , as the developer's timetable was retarded by an unexpectedly long A250 review process. #6 Nadeau Final Plat - all is in order. #7 Day Care Center Site Plan - this proposal received conditional use approval from the City Council, under the interim zoning reg- ulations, on 8/21/78. The day care center is accompanied on this site by a wholesale music store and 2 apartments. In approving this plan, the Council stipulated that screening be erected and that the approval will last 1 year (another review will be necessary if this use is to continue). Since no construction is involved and there are some outstanding large trees on site, no landscaping is necessary. With regard to access, I feel that there are no practical alter- natives to the present scheme that would be a net improvement. As far as parking and circulation are concerned a modest widening of the turnaround would be helpful - otherwise, I see no practical alternatives.
