THAT I. Charles IIafter, resident in, and Tax. Collector for,
the City of South Burlington, in the County of Ch.i.ttenden, and
State of Vermont, send greetings:
'WHEREAS, I am the duly appointed Tax Collector for the City
of South Burlington, having taken my oath of office; that
pursuant to my duties of office, I did extend by warrant on the
30" day of March, 1998, upon the property described hereinafter
for delinquent taxes, thereafter giving notice of tax sale by
public notice published in the Burlington Free Press, a newspaper
published in Burlington, Vermont, upon April 9, 1999, April 16,
1999, and April 23, 1999, and posted :in the South Burlington City
Clerk's Office; that notice was given by certified mail to the
delinquent taxpayer; that no payment had been received for said
delinquent taxes and the property was therefore sold on May 5,
1999, at the tax sale to Ronald Charlebois of Burlington,
Vermont; and

taxpayer has passed and the hereinafter described property has
not been redeemed, I do by these presents and in consideration of
the One and More Dollars paid to my full satisfaction by said

The Grantor herein grants to the Grantees in common with others
certain beach rights conveyed to the Grantor by Warranty Deed

Dear Mr. Trono:
This office has been informed that you recently sold lot IA to a David and
Sandra Tremblay, and that the sale did not include lot Ih. As you are aware
the Planning Commission granted sub -division approval with a stipulation that
lot 1B be considered a part of lot IA. The fact that you conveyed the property
to the Tremblay's %ithuut lot 1B does not appear to be violating, the stipulations
setforth by the Planning Commission, however, lot 1B is not deemed an acceptable
building lot.
By means of this letter, we wish to place you on notice that the City does not
consider lot 1B as a building lot and that an) request to develop the lot will
involve a re submission to the Planning Commission plus the Zoning board of
Adjustment due to the fact that the lot is substandard to the City's Loning
requirements.

Peter Trono requested that I submit a form of covenant in
regard to the requirement on Lot 1B that it not have any residence
constructed on it. It is Peter's intention, to the best of my
knowledge, to sell Lots lA and 1B together.
My suggested language would be as follows:
"By acceptance of this deed, the Grantees, their
heirs and assigns, agree that no residence may
be constructed upon that portion of the afore-
mentioned property known as Lot 1B; This covenant
shall run with the land."
If the Town Attorney wishes to redraft that covenant, please
let me know, and I will be happy to consult with him.

Know all men by these presents that we, Lydia B. Lowell, a widow,
of Shelburne, County of Chittenden Itnd State of Vermont, Richard
H. Lowell of Phoenix, County of Maricopa and State of Arizona,
Roy W. Bartlett (also known as W. Roy Bartlett) of Mercer Island,
County of King and State of Washington, and Linda B. Griswold of
Okemos, County of Ingham and State of Michigan, Grantors, in the
consideration of Ten Dollars and other good and valuable
consideration paid to our full satisfaction by J. Peter Trono
of Burlington, County of Chittenden and State of Vermont,
Grantee, by these presents, do freely give, grant, sell, convey
and confirm unto the said Grantee J. Peter Trono and his heirs
and assigns forever, two vacant parcels of land at Bartletts
Bay in South Burlington, County of Chittenden and State of
Vermont, described as follows, viz:
Parcel I. Parcel I is all that land, containing 4.70
acres, now owned by Grantors which is depicted as the
shaded area on a plat entitled "Property of Lydia B.
Lowell et al" dated November 1977 and recorded in Vol.
107, Page of the South Burlington Land Records and
is also designated thereon as Parcel "A", Parcel "B"
and "Gravel Road". Parcel I is bounded as follows: on
the north by the south line of Bartlett Road; on the
east by the west line of Brigham Road; on the south by
the meandering and changing mid -line of that unnamed
brook which flows in a general westerly direction into
Lake Champlain; and on the west by the meandering and
changing mid -line of that unnamed brook which flows in
a general southerly direction into Lake Champlain and
also by lands designated on said plat as "Annex to
Edwards", "San. Pump Station Site", "Lot No. `21" and
finally "Lot No. 20".
Parcel II. Parcel II is all that parcel of land, containing
13,440 square feet or 0.30 acres, which has a north
line fronting on the south line of Bartlett Bay Road of
58 feet, more or less; a west line fronting on the east
line or Brigham Road of 215 feet; an east line fronting
on the west line of the railroad right-of-way (following
a fence line) of 225 feet; and a south line of 58 feet,
more or less, which connects the southerly terminal
points of said east and west lines.
Being two portions of lands and premises conveyed to
Grantor Lydia B. Lowell under her maiden name of Lydia
P. Bartlett and to Roy H. Bartlett and Robert Bartlett
by Quit Claim Deed of Roy R. and Catherine P. Bartlett
dated December 24, 1934 and recorded in Vol. 11, Page
553 of the South Burlington Land Records. Grantor
Lydia Bartlett Lowell, a widow, is the sole surviving
grantee of that conveyance and by a series of recorded
instruments title to the lands hereby conveyed has
become vested in the joint names of all four Grantors.
In aid of this description reference is hereby made to
the following recent selloffs by Grantors of lands
located easterly of the second of the above -referenced
unnamed brooks:

By Warranty Deed dated December 2, 1977 (recorded in
Vol. 139 , Page 334-7) Grantors conveyed to the Cify of
South Burlington that certain parcel of land referenced
above as "San. Pump Station Site" which is outlined in
red and depicted as "Pump Station" on a plan entitled
"Sewer Easement Plan No. 7 . Bartlett Bay Arpa" dated
September 27, 1977 (recorded in Vol. 107 , Page 158 ).

By Quit Claim Deed dated December 2, 1977 (recorded in
Vol. 120 , Page 544-7) Grantors conveyed to the City of
South Burlington a right, in common with others, to
pass and repass on foot and in vehicles over that
certain 25 foot wide parcel of land referenced above as
"Gravel Road" which is outlined in yellow and depicted -
as "Gravel Road" on a plan entitled "Sewer Easement
Plan No. 6 . Bartlett Bay Area - Pump Station Site"
dated May 11, 1977 (recorded in Vol. 107 , Page 157 ),
subject to the obligation on the part of the City of
South Burlington to construct, improve, repair, maintain
and plow said•Gravel Road.

By'said Quit Claim Deed Grantors also conveyed to the
City of South Burlington an easement and right of way
for the laying, construction, building, installation,
maintenance, repairing, rebuilding, replacing, operation
and patrol of drainage and sewer pipes, mains and
conduits on, under, through and across that land which
is outlined in red upon said (September 27, 1977)
"Sewer Easement Plan No. 7" together with associated
construction easement rights and subject to certain
covenants on the part of the City of South Burlington
as set forth therein.

By Warranty Deed dated December 1, 1.977 (recorded Vol.
139 Page 351-4) Grantors conveyed to Elizabeth K.
"Annex
,
Edwards that parcel of land referenced above as
to Edwards" which is located westerly of and adjacent
to said "Pump Station" land, together with the right to
use said "Gravel Road" for ingress and egress.
The
lands hereby conveyed are subject to the following
rights in favor of others:
a.
A 20-foot wide sewer line easement previously granted
to the City of South Burlington by Warranty Deed of
Grantor Lydia B. Lowell dated February 4, 1958 (recorded
Vol. 34 , Page 411 )•
b.
A 10-foot wide right of way over the footpath which
runs along the westerly side of the land and premises
hereby conveyed from said "Gravel Road".,in a southerly
direction to the footbridge, which right of way is for
the use of those Camp Bartlett property owners whose
properties do not adjoin Lake Champlain, all as
established by prior deeds of record.
C.
Real and Bertha Charlebois have a non-exclusive right
of way for ingress and egress over the existing driveway
on the lands hereby conveyed which runs from said

The following rights are included with this conveyance:
1. The right to use the aforesaid footpath and footbridge,
in common with the aforesaid owners of other Camp
Bartlett properties whose properties do not adjoin Lake
Champlain, subject to the obligation of maintenance and
repair to be shared with other users (but not with
Grantors, or any of them).
2. The right, in common with others, to use a right of way
for access by foot only to Lake Champlain over lands of
Catherine L. Price, which right of way begins at the
southerly end of said footbridge and then extends in a
general westerly direction to the waters of Lake
Champlain, passing over and along that strip of land
owned by Catherine L. 10tice which is bounded on the
north by the first of the above -referenced unnamed
brooks and on the south by lands depicted upon the
aforesaid plat of "Property of Lydia B. Lowell" as
"Moore & Faigle", together with the right, in common
with others to use the beach portion of said strip of
land but only for purposes of bathing and the storage
of one dinghy.
It is a condition of this conveyance that the style and

It is Dick Spoke's opinion that this proposal to add a drive-
in -window is "grandfathered" under the savings clause of interim
zoning. Under the criterian of access for site plan review, I
question whether the Commission has sufficient grounds or legal
authority to deny or drastically modify the proposed plan. How
ever, under the criteria of parking, circulation, and landscaping
and screening, I believe this proposal does not warrant approval,
and that the Commission has adequate grounds and authority for
denying the application.
#3 Trono Subdivision (Lowell Property)
This plan conforms in ell respects to the discussions at
Sketch plan review regarding: right of way and pavement width,
pedestrian access (private) to the Lake, the right of way to a
land locked parcel, and delineation of the .3 acres to bring the
gross acreage up to 5 acres.
The applicant has worked closely and cooperated fully with
myself, the City Engineer, and the Water District. I see no sub-
stantive issues to be discussed in this application. Engineering)
legal and other details can be resolved administratively prior to,
or as a condition of final plat approval.

1. Brigham Road is a City street and has a R.O.W. width of only
21 feet. The.traveled-surface is gravel for a width of 20 feet.
This laves no roon) for the drainage ditches or off -traveled
way services such as water and natural gas. The city standard
is a 60 foot R.O.W. The very minimum that we could live with
is 50 feet.
2. The 25 foot easement serving the Edwards and Charlebois
properties , also-sarves th�:new=city"sewage-pumping station.
The City has agreed to maintain this easement. If additional
development -is to utilize this easement, it should become a
Gity street built to city standards.
3. All water.mains must be 8 inch. Final plans to be reviewed
and approved by City Water Department. =

This firm represents Peter Trono who recently purchased almost five (5)
acres from Lydia Lowell in Bartlett's Bay. The property is currently
zoned R-1 -- PUD and we request that you recommend to the City Council
that the area be re -zoned to R-4.
The surrounding properties to the west and south are currently zoned
R-4. The majority of the properties in the area are a half acre or less
and contain camps or year round residences. To maintain the R-1 classi-
fication would result in lots that are out of keeping with the balance
of the area.
We therefore feel that the subject property is improperly classified.
The physical nature of the land is flat and such that it can be reasonably
divided into eight (8) parcels. We feel that the economics of the develop-
ment are such that it does not make economic sense to divide it into four
(4) lots but eight (8) lots with the proper access would allow reasonably
priced lots and reasonably priced homes. As I stated above, the uses of
the adjoining properties are residences single family lots of half acre
or less. It is clear that the City of South Burlington at this point is
running out of residential lots and to develop this property would meet
a pressing need within the City.
We feel that this meets the goals and objectives of the South Burlington
Master Plan and that it maintains an area as residential which has been
residential for some time. Furthermore since the City Water and Sewer
is available to this area, the necessity for larger lots for leach fields
and/or wells has vanished.

We believe that this would be consistent with the South Burlington
Comprehensive Plan as it does maintain, as stated above, the residential
nature in keeping with the surrounding area and the community as a whole.
The traffic, noise and other general aesthetics of the area would not be
increased by this new development as additional access roads would be
available and would not impose any greater additional burden on existing
streets. We do not feel that this will pose an undue burden on existing
or proposed municipal services because they are already in the area nor will
it pose unreasonable highway congestion.
Basically we propose that this 4.7 acres be divided into common land and
eight (8) single family residence sites. We have a plan that we request
time for a hearing to present to you and we therefore request at this time
that you grant us a hearing and strongly recommend to the City Council that
this area be re -zoned.

1. Drainage ditches must be outside of sewage pumping
station site and off of sewer easements except where
they cross at right angles.
2. Driveways must be constructed as per City details, this
may require a deeper side ditch.
3. Storm water on Brigham Road should drain along street to
brook. Brigham Court will require a culvert pipe.
4. Corrections requested by the City Water Department are
not included on the plans.
5. Sewer manhole inverts to be constructed to a depth
equal to pipe diameters.

#2 Castlerock Condominiums - a suggested motion of approval has
been prepared, for circulation at the meeting.
#3 Trono Construction Final Plat - with the exception of some
minor engineering details and finallized legal documents, all is
in order on this application.
#4 DesLauriers Final Plat - The Commission's requests, to plot
the centerline of the brook on this lot, plus show a schematic
layout for the "backland", have been complied with.
#5 Hickok & Boardman / Flanders Lumber Final Plat- this proposal,
as you may recall, is for 150 two bedroom condominiums to be
built in 4 phases on the so called Brand Farm, directly west of
Twin Oaks Tennis Center. The first two phases have received final
approval and now that there is adequate sewage capacity, the final
two phases are being submitted for approval. As a result of Act
250, measures for minimizing erosion have been substantially ex-
panded. In addition, the overall landscaping plan is being presented.
There have been some rearrangements of parking and building locations.
No substantive issues have arisen, although the revised plan is being
reviewed by the Tree Committee and the Fire Chief. Approval for
Phase I has expired, but should be renewed , as the developer's
timetable was retarded by an unexpectedly long A250 review process.
#6 Nadeau Final Plat - all is in order.
#7 Day Care Center Site Plan - this proposal received conditional
use approval from the City Council, under the interim zoning reg-
ulations, on 8/21/78. The day care center is accompanied on this
site by a wholesale music store and 2 apartments. In approving this
plan, the Council stipulated that screening be erected and that the
approval will last 1 year (another review will be necessary if this
use is to continue). Since no construction is involved and there are
some outstanding large trees on site, no landscaping is necessary.
With regard to access, I feel that there are no practical alter-
natives to the present scheme that would be a net improvement. As
far as parking and circulation are concerned a modest widening of
the turnaround would be helpful - otherwise, I see no practical
alternatives.
Although I am so_newhat uneasy about the compata bility of this
