DECISION AND FINDING OF FACT
On the 28th day of August 1995 the South Burlington Zoning Board
of Adjustment heard testimony regarding the conditional use
application of the Pines Housing Limited Partnership, Charles
Brush agent, 421 Dorset Street, also attending this meeting,
Attorney William Schroeder, adjoining property owners including
Millie Estey, Madeline Yandow, Kit Tillinghast and Charlotte
Teese.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for
this application, the Zoning Board finds, concludes, and decides
as follows:
Findings of Fact
1) The area is in question is zoned R-7 District.
2) The proposed use in a conditional use under Section 10.20 of
the zoning, bylaws.
3) The proposed development is the construction of a 6000
square feet senior center and addition of additional parking
in conjunction with a nursing home located at 421 Dorset
Street.
4) Original conditional use approval was granted by the ZBA on
November 22, 1993.
5) The additional parking area will result in development on an
adjoining parcel of land owned by Veve Associate. This
parcel contains 12,000 square feet.
Conclusion
1) The Pines Housing is proposing to lease the land in question
for 40 plus years.
3) The proposed use should not alter the character of the area
nor have any impact on municipal facilities.
4) Request is in keeping with the long range goals for the City
Center Plan.
5) Evidence submitted by Resource Systems Group addresses the
number of parking spaces necessary to meet the needs of the

center.
6) No effects on existing by laws or renewable energy resources.
Based upon the findings and conclusion set -forth above, the
Zoning Board of Adjustment hereby grants the applicants request
to operate a 6000 square foot Senior Center at the Pines, 421
Dorset Street. The Board stipulates that the applicant shall
have the ability to demonstrate to the Planning Commission at
site plan review his ability to produce a maximum of 130 total
parking spaces for all uses include the new 6000 square foot
