HomeMy WebLinkAboutCU-96-0000 - Decision - 0401 0421 Dorset StreetSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Cq C L 0 0 ©D DECISION AND FINDING OF FACT On the 9th Day of December, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a conditional use application of the Dorset Land Company, Inc. Charles DesLauriers, 402 Dorset Street, this meeting was also attended by Charles Brush, John Giebink, Joe & Rita Randazzo, M. Yandow, V. Wamsganz, M. Estey, B. Pell and K. Tellinghast. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: 1) The area in question is zoned Central District 3 a depth of 300 feet parallel to Dorset Street, balance of the area involved is zoned Residential 7 District. 2) The proposed use "extended stay hotel" is a conditional use under Section 14.202 of the zoning by-laws. 3) The proposed structure contains 57,000 square feet and the lot in question contains 1.07 acres. 4) Section 14.405 Density requirements allows for a floor area ratio at a base maximum of 0.5. Under a previous zoning by- law, the floor area ratio was grandfathered at 0.72. Section 29.007 allows for a boundary line extension (conditional use) within the Residential 7 District a depth of 50 feet, which increases the floor area ratio. 5) Approval by the Planning Commission (July 12, 1994) permits construction of a general/medical office complex on the parcel under consideration. 6) The entire parcel (12 acres) has approvals as a Planned Unit Development. Uses proposed are senior housing and general offices. Conclusion 1) The developer is proposing to amend an existing approval by construction of an 80 unit extended stay hotel. 2) The applicant has submitted traffic data which reduces the vehicle trips by 25 to 35%. Also, changes the peak hour 1 trips. 3) The proposed use residential in character will serve as a transitional use to the City Center master plan. 4) Neighbors concerns to include drainage, lighting, noise and parking were addressed by evidence submitted by the applicant to include a revised landscape plan. 5) A joint agreement between the Pines Senior Housing and the applicant addresses the common use of parking spaces. 6) Water, sewer and other municipal facilities are not adversely affected by this project. 7) The essential character of the neighborhood is protected by the applicants willingness to landscape the parking area and install a six (6) foot fence. 8) The Board finds that traffic impacts will be less than the previous approved office complex. Extension of Sherry Road was requested by the City to assist turning movements on Dorset Street. Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants a conditional use request which allows for the construction of an 80 unit hotel and the extension of a district boundary line into the R-7 zone located at 401 Dorset Stree" cnairman; South Burlington Zoning Board of Adjustment J A N 13 1997 2
