HomeMy WebLinkAboutSP-10-57 - Decision - 0401 Dorset Street#SP-10-57 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING DORSET HOTEL ASSOCIATES - 401 DORSET STREET SITE PLAN APPLICATION #SP-10-57 FINDINGS OF FACT AND DECISION Dorset Hotel Associates LLC, hereafter referred to as the applicant, is seeking to amend a previously approved 104 unit extended stay hotel. The amendment consists of: 1) removing two parking spaces on lot #1 to construct a patio, and 2) removing one parking space on lot #2, 401 Dorset Street. The applicant is requesting approval to remove a total of three parking spaces to construct a patio and add landscaping. The Development Review Board held a public hearing on September 7, 2010. Chuck Deslauriers represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking to amend a previously approved 104 unit extended stay hotel. The amendment consists of: 1) removing two parking spaces on lot #1 to construct a patio, and 2) removing one parking space on lot #2, 401 Dorset Street. 2. The application was received on August 2, 2010. 3. The owner of record of the subject property is Dorset Hotel Associates. 4. The subject property is located in the CD3 Zoning District. 5. The plan submitted is entitled, "Dorset Land Company Dorset Street South Burlington, VT." Prepared by Trudell Consulting Engineers, dated November 4, 1996, last revised on June 15, 2010. DIMENSIONAL REQUIREMENTS Changes in dimensional coverage are minimal giving the small nature of the proposal and the somewhat large size of the property. Building coverage exceeds the limit for the district, but does not worsen with the application; overall coverage is within the limits of the district. The subject property requires 128 parking spaces. The applicant has submitted an analysis demonstrating the number of vacant spaces during high occupancy. At no time during these study dates were less than 16 spaces vacant, even with 100% occupancy. Based on the aforementioned analysis the requested parking waiver is approved. Thus amendment to Site Plan application #SP-10-57 is approved. DECISION a�� Motion by 6R « C�u��/� , seconded by 6,1g �'V1« , to approve Site Plan Application # -10-57 of Dorset Hotel Associates LLC subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plans submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. The Board grants a parking waiver of 8 spaces or 6.25% for a total of 120 spaces approved. 4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of site modifications. 6. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer.
