Be advised that the appeal of Gerald Divinenzo of 9 Woodcrest Drive requesting
a variance permitting the construction of a 24'x28' addition to within eight (8)
feet of the side yard abutting Woodcrest Drive, is amended and should include
that the addition is also required to obtain a variance from the front yard
requirements. The addition as proposed will be constructed to within twelve
(12) feet of the front yard property line. The minimum requirements are thirty
(30) feet from both property lines. The hearing is scheduled for August 24, 1981
at 5:00 P.M.

Answers to Criteria for Variance to Zoning Regulations
(1) Current positioning of the house on the lot does not allow adding without
requiring a zoning variance. (i.e. 30' from the property line where adjacent
to the street and 15' from neighboring property); see I
(2) Buildings on the property were constructed in 1957 and now are not in con-
formity with provisions of the zoning regulations. Any modification would
require a variance.
(3) The alterations proposed will only add to the value and usability of the
property. Neighboring property owners see no problem with the addition.
(4) Many neighboring property owners have improved their houses by adding
living space. This appeal, if it is granted, will not impair development
of neighboring properties. Variance for addition to a lot on the corner
of Hinesburg Road and Woodcrest Drive was approved within the last two
years.
(5) Other options have been considered including:
(a) Purchasing a larger home in South Burlington.
(b) Adding directing on the back of the house.
The proposed addition will allow constructive use of the yard, improved
property, value and will add to the appeal of the property.

1) Keeping the garage within the zoning regulations for a rear setback will
not allow the intended use of the finished breezeway. I feel that a nine
foot breezeway can only comfortably be used as a mud room.
2) The buildings were constructed in 1957 and are not in compliance with
current zoning regulations; any construction or expansion on the property
requires a variance.
3) The variance requested will add to the value and usability of the property.
Neighboring property owners have no objection to the addition. The variance,
if it is granted, will not affect development of neighboring properties.
4) The requested variance will create no change in the character of the neigh-
borhood. Approximately one quarter of the bourses have detached garages.
With the exception of my garage, all of these are twenty two feet from the
rear property line.
5) I have considered purchasing or building another home in South Burlington.
The proposed variance will allow constructive use and add appeal and value
to the property with minimal variance to the zoning regulations.
