At the City Council Meeting of November 4, 1985, during the
review of the ZBA Agenda for November 18, 1985, the Council
expressed their concern for the following appeals:
#3. Franklin Bessette, 10 Maplewood Drive - Operating a small
engine repair and sale of power lawn mowers and snow blowers,
would alter the character of this residential area.
#4. Champlain Oil Company, 354-356 Dorset Street - The Council
objected to a similar proposal (gas station - convenience store)
when it was presented several months ago in the same area and
for the same reasons.
The Council also recommends that the Board get input from the
Dorset Street Committee on this proposal.

Dear Fred:
On November 11, the Dorset Street Committee met with Mr.
TonyCairns of the Champlain Oil Company regarding his plans
for 354 & 356 Dorset St' An informal discussion followed,
which covered the proposed uses, setbacks, turning traffic,
visual effects, and thoughts about integrating his plans into
the Dorset Street plans' The committee has not yet formed a
concensus regarding the city center concept or yet made
specific recommendations for the development of Dorset St.
However, we have adopted and published goals and objectives'
Please note that the lots in question are in the very
center of the San Remo Drive "block", and hence any changes
there could have a substantial effect on the city's ability
to develop that area in a coordinated manner supporting a
city center concept'
Although no formal position was taken by the committee
regarding Mr- Carin's proposal, I will try to summarize the
salient points of concensus.
1) Most committee members and planning staff did not
think that the proposed uses, per se, were incon-
sistent with the development we want to see in
that area.
2) A buffer zone, possibly a landscaped area, is
desired between the edge of the widened Dorset St'
and commercial/business activity. Hence we ask
the Zoning Board to be extremely cautious in
considering any variance to the setback require-
ments'
3> There was substantial concern about southbound
vehicles turning left into the gas station/store.
A stipulation which the Zoning Board could con-
sider would delay operation of the gas pumps and
convenience store until Dorset Street has been
widened and the barrier/divider installed so as to
prevent those left turns'

Plans have been reviewed by this dept. and
the only problem at this time is more
information is needed on location of under
ground storage tanks.
#2. Bartlett Property Cluster #C;
The only problem I can see at this time is
given protection to the back unit. There must
be at least an 18' fire lane to the unit for
emergency equipment. Because of the location
I could see if not maintained in the winter
time the best we could do is try to protect
life safety and unable to do anything about
the building.
#3. Pizzagalli New Building 35 Joy Drive;
The only problem at this time is a hydrant
must be installed at the main drive way to
the new building.

MOTION OF APPROVAL -
That the South Burlington Planning Commission approve the site plan
application of Champlain Oil Company for construction of a new
4480 square foot office building at 354 Dorset Street as depicted
on a plan entitled "Champlain Oil Complex" prepared by Graphic/
Construction Management Services, Inc., and dated November 21, 1985
with the following stipulations:
1. A $6300 landscaping bond shall be posted prior to permit.
2. A sewer allocation of 420 gallons per day is granted. The
applicant shall pay the reqired sewer impact fee.
3. The applicant shall furnish the Fire Chief with necessary
information regarding underground storage tanks and take required
steps for the removal of abandoned tanks if necessary.
4. A concrete depressed curb shall be installed across the new
driveway on San Remo Drive. A bond shall be posted for this work
prior to permit in an amount determined by the City Engineer.
5. The parking area shall be graded to drain toward existing
catch basins.
6. The applicant is encouraged to return to the Planning commission
with a revised site plan to conform to interim zoning that may be
established to support a City Center in this area.
7. The building permit shall be obtained within 6 months.

3. The applicant shall meet the recommendations of Wagner,
Heindel & Noyse for stormwater detention bV a method approved
by the City Engineer. If construction proceeds during the
winter or spring months, the applicant shall follow the
recommendations of Wagner, Heindel & Noyse for erosion
control.
4. The plan shall show T-shaped driveways for each building,
allowing two cars to park in front of a unit such that they
each have unimpeded access, as approved by the City Planner.
5. A revised landscaping plan with street trees and site
landscaping shall be approved �2y the City Planner prior to
permit. A bond shall be posted in an amount determined
the City Planner prior to permit
6. The revised plan shall be recorded with the City Clerk
within 90 days or it shall be invalid.

H. Consider site plan application of Tony Cairns for Champlain
Oil Co. for the construction of a 4480 sq. ft. office
building and use of existing building for Champlain Oil Co.,
at 354 Dorset St.
The existing Merrill building will serve for oil storage.
Offices in front will be for the dispatcher. The new
building will be for office staff. One curb cut will be
closed and the drive leading to the front of the Merrill
building will be closed. One of 2 existing gas pumps will
probably be removed. Champlain has only 4 trucks. Mr.
Belter felt there should be a way to separate Champlain's lot
from Alco next door. Mr. Cairns said there is a chain link
fence that could be extended.
The new building will be 4800 sq. ft, initially single story
but with the capability of being extended to 2 stories.
Mrs. Lafleur noted that the Fire Chief says there is an
underground storage tank that he would like information on.
Mr. Cairns said they will request that Merrill remove all
tanks over a certain number of years old.
Mrs. Lafleur noted that the plan conforms to existing zoning
and is improving the lot. However, because new plans are
being considered for Dorset St. and it may be that with re-
zoning, trucking and industrial warehousing will be zoned
out. The Dorset St. Committee is looking at the San Remo Dr.

area as a possible city center and are talking about green
areas, etc. The Champlain proposal is in a critical area and
was shown on Boyle's plan as a green area. Mr. Cairns noted
that they had closed the entrances on Dorset St. for the
convenience store they propose in the future. Mrs. Lafleur
noted she could not possibly recommend this plan if the
entrances were not closed now.
Mr. Dooley moved that the Planning Commission approve the
site plan application of Champlain Oil Company for
construction of a new 4480 sq. ft. office building at 354
Dorset St. as depicted on a plan entitled "Champlain Oil

1. A 12' wide by 200' foot long access drive serving a duplex
will not allow two way travel. It should be at least 18' wide.
I would rather see two triplexes and the long drive duplex
eliminated.

unless they are parked one behind the other which is not good.
3. The drainage way in south-west corner should be piped
instead of the open ditch.

short duration ponding on the site after a heavy rainfall.

4) CHAMPLAIN OIL COMPANY, 354 DORSET STREET
The applicant proposes to construct a 4480 square foot office
building on the 80,751 square foot lot on which the Merrill
Trucking business is located. The office building fronts on
San Remo Drive and is located directly behind the Country
Kitchen bakery store. It is zoned Commercial-2 and has received
Zoning Board approval for multiple uses on a lot. (The proposal
for a convenience store on the Country Kitchen lot has been
withdrawn. This application involves the Merrill lot only.)
Access & Circulation: Circulation is adequate. The applicant
has agreed to close two curb cuts (driveways) on Dorset Street:
First, the driveway north of the trucking building will be closed
and this northern parking lot accessed from San Remo. Second,
the driveway from the center of the building at the overhead
door will be closed and the front yard landscaped. This is
a significant improvement both aesthetically and for safety
reasons.
The 66 foot opening leading to the pumps next to the Merrill
building will remain. The front of Country Kitchen will not
change and is not involved in this application. Although this
opening does not conform to our standard, the impending Dorset
Street widening will change this area significantly so I am not
that concerned. It would be useless to curb and sidewalk this
only to be torn up in a year or two.
Parking: The parking spaces meet our requirements. The office
building requires 18; nineteen are shown including two handi-
capped spaces. The truck terminal requires nine and thirteen
are shown.
Landscaping: This plan requires a $6300 landscaping bond. The
plan exceeds this requirement. A significant area of land-
scaping is added along San Remo to meet the front yard coverage
requirement.
Traffic: This lot permits 91 trips during the peak hour. The
office and storage building is expected to produce 42 trips per
day according to the applicant. The ITE data shows approximately
fifty one trips for two uses during the peak hour. Either
estimate is acceptable.
Other: A sewer allocation of 420 gallons per day is needed for
the 28 total employees. See Goddette's and Szymanski's memo.

The Dorset Street Committee has reviewed an early set of plans.
In general, they believe that the office use is compatible with
their concepts for a City Center. They were more concerned about
the plan for a convenience store and gas pumps that has been
withdrawn. Advisor Peter Owens from T.J. Boyle and Associates
has also reviewed this plan and agrees that although the office
use is not objectionable, the trucking use is not as compatible.
It is, of course, a permitted use until such time we change the
zoning.
The property is in a strategic centralized location in the San
Remo block that will limit development options in the future.
The applicant has indicated he may remove the Merrill building
at some later date which may help promote the "City Center"
concept. Please be aware however, that these issues are not
part of the site plan review criteria.
5) PIZZAGALLI DEVELOPMENT COMPANY, 35 JOY DRIVE
The applicant proposes to construct a 23,000 square foot office
building on the lot just west of the newly constructed office
building. The plans show a connecting walkway to the newly
constructed building which needs Zoning Board of Adjustment
approval for a set -back variance. That walkway shall be
contingent upon Zoning Board of Adjustment approval.
Access and Circulation: A new 24 foot wide driveway is shown
from Joy Drive. Circulation is provided around the back of the
building by connecting the two parking lots.
Pam: The ordinance requires 92 spaces. The applicant proposes
seventy-five and therefore needs a waiver of 18%.
Landscaping: A bond for $19,450 will be required prior to permit.
The plan meets this requirement.
Other: The sidewalk shall be continued from the sidewalk
required at 55 Joy Drive. It shall be depressed concrete and
continuous across the driveway.
A sewer allocation of 825 gallons per day is required. The
$2.50 fee per gallon shall be paid prior to permit.

As requested, we have examined the existing and proposed curb cuts serving your
354 and 356 Dorset Street parcels. Attachment A illustrates the existing site layout, with
Lots #1 and #2 being 354 and 356 Dorset Street, respectively.
Historically, we understand that each parcel .has had direct access onto Dorset
Street. 354 Dorset Street is presently accessed via a well defined curb cut located
between the building and the grassed island which straddles the southerly lot line.
Access to 356 Dorset Street, on the other hand, essentially consisted of an undefined
curb cut which extended the length of that parcel's frontage.
The contract plans for the Dorset Street reconstruction project, which is now
underway, proposes to completely eliminate the existing access to 356 Dorset Street.
Instead, this parcel would be accessed through a 40 feet wide curb cut at 354 Dorset
Street, which presently is Champlain Oil's truck terminal. The proposed access layout is
shown in Attachment B.
At the present time, the south side of the building and access at 354 Dorset Street
is used as a refueling and servicing area for semi -trailer and other truck vehicles. With
the new median on Dorset Street, traffic flow through this area will be predominantly one-
way, with trucks entering from Dorset Street and exiting via San Remo Drive. We
understand that at times there can be over five trucks parked in this immediate area
being serviced.
The Dorset Street reconstruction plans do not detail how 356 Dorset Street is to
be accessed from the adjacent parcel or how parking and internal traffic circulation will
be modified. Because of the land -taking which has occurred in front of the existing

building at 356 Dorset Street, it is reasonable to anticipate that all future parking will be
to the rear of this building.
With parking so situated, the remaining issue becomes how best to access the
existing building at 356 Dorset Street. It appears that the Dorset Street reconstruction
project will require this parcel to be accessed via the proposed curb cut serving 354
Dorset Street. Under that scenario, it is likely that large trucks parked_at he refueling and
service area will interfere with and may even block traffic flow and access to 356 Dorset
Street.
An alternative is to provide 356 Dorset Street to have its own curb cut directly onto
Dorset Street. Such a curb cut would most likely be located on the northerly side of the
existing building. This would completely eliminate potential conflicts and dissimilar traffic
flows entering and exiting via 354 Dorset Street's curb cut. To gain some insight as to
the amount of traffic which would be entering and exiting 356 Dorset Street during the
p.m. peak hour, we calculated the potential trip generation' of the existing building. Using
typical trip generation rates for a building of this size (1,770 sq.ft.), we estimate a p.m.
peak hour trip generation of 10 vte/hour (2 enter plus 8 exit) for a general office use, or
9 vte/hour (5 enter plus 4 exit) for a specialty retail use. With the new median on Dorset
Street, all movements will be right -turn only.
The above trip generation estimates are unlikely to create any traffic congestion
or safety impacts from a new curb cut exclusively serving 356 Dorset Street. It is oyr
opinion that the benefits of such a curb cut outweigh the potential negative impacts of,
routing this traffic through an existing truck terminal's service area. Additionally, we
understand that you are agreeable to a sunset clause being placed on such a curb cut
should 354 Dorset Street cease to be used as a truck terminal. If that should happen,
and 354 Dorset Street be redeveloped, the access to 356 Dorset will be closed and
rerouted through 354 Dorset Street. I

I reviewed the letter from Roger Dickinson of Lemoureux & Stone
dated 6/16/93 regarding the curb cut issue for the above referenced
properties. I agree with Roger's assessment that the current plan
of one curb cut serving both buildings is inadequate. This is
mainly due to the location of fuel pumps at 356 Dorset Street and
the likely potential for trucks which are fueling at the pumps to
interfere with access to the 354 Dorset Street building.
In my opinion, the best option would be to maintain one curb cut
for both buildings and relocate the fuel pumps further back on this
property. This concept was first proposed in 1986 as is shown on
the enclosed sketch.
If relocating the pumps is cost prohibitive, I support Roger's
recommendation for two separate curb cuts. If this is approved,
I recommended that a condition be imposed that requires the two
curb cuts to be combined into one shared curb cut when the use of
354 Dorset Street changes. In addition, parking for 356 Dorset
Street should be required to be provided to the rear of the
building.

The automobile service stations surveyed generally
are located atintersections n/freeway interchanges
and include facilities for sorvioing, repairing and
fueling motor vehicles.
Onanaverage weekday, aservice station will gen-

ments were traced adeight stations in three Illinois

7. Site plan application of Tony Cairns, Champlain Oil Co. to
construct a service station with a 1400 sq. ft. building and
2 pumping stations at 356 Dorset St.
Mr. Cairns explained the station would be on the site of the
present Country Kitchen. He explained his self -conducted
traffic study which resulted in more vehicles than allowed by
the overlay district. Mr. Burgess said there was again a
question of whether to use the overlay district, and you
can't have it both ways. (referring to the Timberlane
application). Mrs. Maher said that in both the overlay and
Mr. Cairns' figures the allowable vehicles is exceeded and
she could not vote for the plan. It was noted that there is
a plan for a convenience store at this same location that has
been tabled by the Zoning Board. A poll of the Commission
showed that no one was disposed to exceed the overlay zone.
Mrs. Hurd moved that the Planning Commission deny the site
plan application of Tony Cairns (Champlain Oil Company) on
the grounds that it does not meet the traffic overlay
district. Mrs. Maher seconded. Motion passed unanimously.
8. Site plan application of Berard Construction Co,Inc, to
construct a 2400 sg. ft. Vermont Custom Sheet Metal building
for storage use at 5 Ethan Allen Drive.
Mr. Belter stepped down from the Commission during this
discussion.
Randy Berard explained the necessity for the second driveway
to bring in supplies twice a month. Trucks must back into
the building and they would not want to use the existing
drive because of its proximity to the telephone pole. In
order to use the back of the building they would have to use
part of the steep embankment. A tractor trailer will be
completely off the road when backed up. The existing curb

Service Station with a 1400 square foot building and 2 pumping
stations as depicted on a plan entitled "Service Station, Dorset
Street, South Burlington, Vermont" prepared by
Graphic/Construction Management Services, Inc., dated 5/18/87
with the following stipulations/

1) A landscaping bond of $2100.00 shall be posted prior to

2) A sewer allocation of 45 gallons per day shall be obtained
prior to permit.
3) Any driveway lights and signs shall be outside of the parking
limits for the Dorset Street reconstruction.
4) Garage floor drains shall be connected to a grease and grit
trap before connecting to the City sewer system.
5) A storm drainage plan shall 'be submitted to the City Engineer

TRAFFIC STUDY
DORSET ST.
The enclosed sheets show a traffic study that was conducted by myself in the
month of March, 1987.
The basis of my study was to establish the percentage of cars turning into
and out of a given service station property at a given hourly period broken down by
5 minute intervals. I wanted to establish the peak periods of traffic more closely
than by the hour, therefore the study was done in 5 minute increments.
On March 17, I first monitored traffic on Shelburne Road, the heaviest travelled
road in Chittenden County, to establish my turning percentage. I counted total
traffic southbound and the amount of cars that turned into our Colonial Mart station
during the hours of 4:50 - 5:50 P.M., which is the best hour for peak traffic, As
you can see, the amount of cars increase dramatically at 5:35 P.M. by over 700, and
then fall off at 6:00 P.M., which reflects people going home from work. The percentage
of cars turning in during that hour was 30.
On March 18, I concentrated on the peak minutes of the previous day (5:35-6:05)
to see if my percentages were correct. However, this time the study included both
north and southbound traffic at the same time, and I monitored the cars turning into
the Getty station as well as the Colonial Mart. The percentage of cars turning in
at both locations in this case was 20.
On March 19, 1987, I counted traffic on Dorset St. at two different times,
11:40 - 11:55 A.M., to find out the numbers of cars per hour at that time, and again
between 4`55 - 6:00 P.M., to reflect the driving home traffic.
I project that the total turning movement of traffic northbound into our
facility will be 20 of the total hourly traffic, or 10 to 11 cars per hour at peak
times. I feel that the majority of the traffic southbound will not attempt to cross
traffic to pull into the station, and then wait to pull back onto Dorset St. southbound
again.

4) CONVERTED OFFICE/HATHAWAY-WEAVER, 1272 AIRPORT DRIVE
1. The proposed parking lot has several large healthy trees that
will have to be removed. Some should be saved especially the
ones behind the lilac shrubs and the red maple just behind the
building even if it means the loss of some parking spaces.
2. The contour of the existing land shall be maintained so as
not be alter the surface drainage. The excavation for the
parking lot shall be hauled from the site.
5) LARRY CARON, WILLISTON ROAD
1. The garage floor drains shall be connected to a grease and
grit trap and then to the sanitary sewer system, not to the storm
or footing drains.
7) CHAMPLAIN OIL, DORSET STREET
1. Any driveway lights and sign should be outside of the taking
limits for the Dorset Street reconstruction.
2. Garage floor drains shall be connected to a grease and grit
trap before connecting to the City sewer system.
3. A storm drainage plan shall be submitted.
8) BELTER INDUSTRIAL PARKS LOT #1 ADDITION, ETHAN ALLEN DRIVE
1. The proposed gravel drive should loop into the existing wide
driveway instead of another road opening or better yet access to
the addition be in the rear of the building.

permitted tripends allowed for this lot is 284 trips/peak hour
based on a + 5.8 acre lot. There is no ITE traffic data for
auto/body repair or used car sales, but the applicant estimates 18
tripends/peak hour. Using ITE data for new car sales and service
stations, this use does not exceed the overlay.
Sewer Allocation: A sewer allocation of 150 gallons per day
shall be obtained prior to permit.

6) SOUTH BURLINGTON FIRE STATION, #3 HOLMES ROAD
The City of South Burlington proposes to construct a 1 1/2 story,
50' x 70' fire sub -station (5250 square feet total) on a 22,100
square foot lot.
Access: Access is shown via a 40 foot wide driveway off Holmes
Road 'and a 24 foot wide driveway in the rear of the building to
access the back parking lot. This driveway has access on to a
private road off Holmes Road.
Parking: 10 parking spaces are shown. This is adequate.
Circulation: Circulation on the side is shown via two driveways
at the front (40 feet wide) and back (24 feet wide) side of the
lot and is adequate.
Landscaping: Landscaping is adequate
Traffic: Traffic generated by this project is not applicable due
to nature of service provided.
Sewer Allocation: A sewer allocation of 30 gallons per day shall
be obtained prior to permit.

7) CHAMPLAIN OIL COMPANY, 356 DORSET STREET
Tony Cairns of Champlain Oil Company proposes to construct a 1400
square foot service station building on a 17,500 square foot lot.
This lot is zoned C-2. Approximately 12 feet beyond the existing
r.o.w. will be taken with the widening of Dorset Street. Mr..
Cairns has applied for a variance to have both a convenience
store and a service station on this lot. It was tabled until
June 8. See Zoning Board minutes.

Access: Access is shown via two curb cuts on Dorset Street.
Each driveway is'15 feet in width and labeled one way, entrance
and exit. These proposed curb cuts do not match the model
proposed in the Dorset Street frontage study by T.J. Boyle &
Associates This study is only a recommendation for Dorset Street
and not law. The Zoning Board would not allow Mr. Cairns to have
his only access to this lot through the adjacent lot as the study
shows.
Parking: Parking for a service station is adequate.
Circulation: Site circulation is shown with a 20 foot wide
driveway by the sides of the building and between the pumps, and
a 24 foot wide drive in back adjacent to the parking. This is
adequate.
