HomeMy WebLinkAboutDR-05-03 - Decision - 0350 Dorset StreetCITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING & ZONING DEVELOPMENT REVIEW BOARD DAWSON DORSET STREET PROPERTIES, LLC 350 DORSET STREET DESIGN REVIEW APPLICATION #DR-05-03 FINDINGS OF FACT & DECISION Dawson Dorset Street Properties, LLC, hereafter referred to as the applicant, is requesting approval of a Master Signage Permit, so that future tenants are able to receive sign permits. Specifically, the applicant is seeking approval for the following colors: red, black, blue, yellow, and white. The Design Review Committee reviewed the subject application on April 25, 2005. The Development Review Board Reviewed the subject application on May 3, 2005. Tyler Dawson represented the applicant. Based on testimony given at the above mentioned meetings and on the plans and supporting materials contained in the document file for this application, the Design Review Committee finds and decides as follows: FINDINGS OF FACT 1. The applicant is requesting approval of a Master Signage Permit, so that future tenants are able to receive sign permits. Specifically, the applicant is seeking approval for the following colors: red, black, blue, yellow, and white. 2. Dawson Dorset Street Properties, LLC is the record owner of the property. 3. The Master Signage Permit application was reviewed under Section 6 Section 8 of the South Burlington Sign Ordinance. The subject property is located at 350 Dorset Street in the Dorset Street/City Center Sign District (DS/CC Sign District). Pursuant to Section 6 of the City of South Burlington Sign Ordinance, the erection, alteration, or relocation of any sign within this district shall require design review by the South Burlington Design Review Committee (DRC) and Development Review Board (DRB). Section 8 of the Sign Ordinance requires all property owners within the DS/CC Sign District to obtain a Master Signage Permit prior to the issuance of any individual sign permits for the subject property. Section 8(e)(1) requires that the property owner of record be the primary permitee of a Master Signage Permit. The record owner of the property is Dawson Dorset Street Properties, LLC. Pursuant to Section 8 of the Sign Ordinance, a Master Signage Permit shall establish consistent design parameters for the property to ensure that all signage is in accordance with goals of the DS/CC Sign District. The Master Signage Permit shall specify size ranges and the graphic elements to be used to relate multiple signs to one another. DESIGN REVIEW CRITERIA In reviewing an application for signage, the DRC and DRB shall consider the following: (a) Consistent Design The design of a sign must be compatible and harmonious with the design of buildings on the subject property and nearby. The proposed master signage permit will allow for signs that are compatible with the existing building and the surrounding buildings. (b) Promotion of City Center Goals Signs within the DS/CC Sign District should be of high aesthetic quality and pedestrian oriented. The proposed signage plan will encourage sings in compliance with this requirement (c) Color & Texture The applicant has requested approval for the following colors: red, black, blue, yellow, and white. The proposed color scheme does not strictly comply with the standard in Section 6(b)(3) of the Sign Ordinance that states, "The use of a maximum of three (3) predominant colors is encouraged to provide consistent foreground, text, and background color schemes However, staff feels that four (4) primary colors included in the master signage plan application (red, black, blue, and yellow) are adequate for the intended purposes of this requirement. The colors approved for this master signage permit shall be red, black, blue, yellow, and white. (d) Materials Used The materials of the proposed signs shall be of high -quality and compliment the building. Pursuant to Section 20 of the Sign Ordinance, all signs shall be of substantial and sturdy construction, kept in good repair, and painted or cleaned as necessary to maintain a clean, safe, and orderly appearance. (e) Wall Mounted Signs Section 10 of the Sign Ordinance governs the size and location of wall -mounted signs. Pursuant to Table 10-1 of the Sign Ordinance, a wall -mounted sign for a multi -tenant building or a multi -building lot with a master signage permit in any district and no freestanding or landscape sign shall not exceed 15% of the area of the facade to which it is attached or 100 sq. ft., whichever is smaller. The subject building has a public facade of 2,048 square feet, which yields a total signable wall area of 204.8 square feet. It is the responsibility of the property owner to allocated signable area for each of the tenants, but the total area of wall signs on the property shall not exceed 204.8 square feet. 2 Pursuant to Table 10-1 of the Sign Ordinance, all wall -mounted signs on the subject property shall not exceed 15% of the area of principal public fagade of each building. This criterion is being met. Section 10(c) states that a wall -mounted sign shall not project above the roof or parapet of the building nor below the top of any first floor doorway unless permitted through the design review approval process. This criterion is being met. Pursuant to Section 10(d), a wall -mounted sign shall not cover any opening or project beyond the top or end of any wall to which it is attached. This criterion is being met. Section 10(g) stipulates that a wall -mounted sign shall not project from the wall in excess of 9". This criterion is being met. (fl Freestanding Signs Section 9(h) states that free-standing signs along Dorset Street are to be located in a sign corridor that begins adjacent to the road Right -of -Way and runs sixteen (16) feet from the edge of the Right of Way toward the building face. In those instances where dimensions do not provide for a two (2) foot setback from the Right -of -Way before a sign support post can be located, it is permitted to erect a centered single pole mounted sign of which the road side edge of the sign is directly outside the R.O.W. line. The subject property has two (2) entrances approved by the DRB. Thus, they are permitted have two (2) freestanding sings. The freestanding sign along Dorset Street shall be located within the Dorset Street sign corridor described above. Section 9(h) states that free-standing signs in the Dorset Street/City Center District may not exceed thirty-two (32) square feet in overall dimensions and may be no higher than twelve (12) feet, measured from the average finished grade at the base of the sign to the highest point of any part of the sign structure. Each of the freestanding signs on this property shall be a maximum of 32 square feet and have a maximum height of 12 feet. / DECISION Motion by Mg 81ZIA cW FQ , seconded by C�� ��l %� to approve Design Review Application #DR-05-03 of Dawson Dorset Street Pr erties, LLC, subject to the following conditions: 1) The colors approved under this master signage permit are: red, black, blue, yellow, and white. 2) There shall be only one tonal value per color for all signs covered under this master signage permit. 3) There shall be a maximum of two typefaces per sign. 4) Box signs and channel letters are both permitted under this master signage permit. 5) Pursuant to Section 20 of the Sign Ordinance, all signs shall be of substantial and sturdy construction, kept in good repair, and painted or cleaned as necessary to maintain a clean, safe, and orderly appearance. 6) The total signable area for wall signs on the subject property shall be 204.8 square feet. 7) The property is approved for two (2) freestanding signs, each which shall be a maximum of 32 square feet in area and 12 feet in height. 8) Any change to the site plan shall require approval by the South Burlington Design Review Committee and Development Review Board.
