Section 8(e)(1) requires that the property owner of record be the primary permitee of a Master Signage Permit. The record owner of the property is Janet M. Desarno. Pursuant to Section 8 of the Sign Ordinance, a Master Signage Permit shall establish consistent design parameters for the property to ensure that all signage is in accordance with goals of the DS/CC Sign District. The Master Signage Permit shall specify size ranges and the graphic elements to be used to relate multiple signs to one another. The current application consists of a request for modification of two existing freestanding signs and one wall mounted sign, reflecting a change in company name. No color or structural changes to the existing signs are proposed. DESIGN REVIEW CRITERIA In reviewing an application for signage, the DRC and DRB shall consider the following: 344 Dorset Street Master Signage Permit DR-03-03 DRC April 28, 2003 Page 2 of 5 Consistent Design 2. The Master Signage Plan needs to be revised to include the awning sign and indicate details of any changes to the existing awning sign. Alternatively the signage on the awning could be removed. The design of a sign must be compatible and harmonious with the design of buildings on the subject property and nearby. The application shows one wall mounted sign on the rear of the structure and two free standing signs at the front and side of the subject property. The signs are white with red lettering. The building is white with red awnings. The awning over the main entrance contains signage identifying the company name with white lettering. Staff assumes that this sign will be changed to reflect the new company name, but the master signage plan does not include details of this. If the awning sign is to be maintained, the Master Signage Plan needs to be revised to include the awning sign and indicate details of any changes to the existing awning sign. Promotion of City Center Goals Signs within the DS/CC Sign District should be of high aesthetic quality and pedestrian oriented. Staff believes the signs are of high aesthetic quality oriented to both vehicular and pedestrian traffic. Therefore, Staff feels the sign is in keeping with DS/CC Sign District goals. Color & Texture A maximum of three colors is encouraged. The proposed signs include red text on white background. The existing additional awning sign may also be maintained. It contains white lettering on a red background. The sign texture is smooth, which is in keeping with the vinyl siding of the structure. Staff feels that the signs are compatible and harmonious with buildings in the vicinity. Materials Used The existing freestanding signs and wall sign are constructed of wood. The awning is canvas. The materials are appropriate and of adequate quality. FREE STANDING SIGNS Two free standing signs are proposed for the subject property. Pursuant to Section 9(a) of the Sign Ordinance, free standing signs shall be self supporting without the need for ancillary supports. The free standing signs comply with this requirement. Section 9(b) of the Sign Ordinance limits the number of free standing signs to two on a property with two approved access points onto public roads. In such cases the access points must be separated by more than 300 ft. as measured from centerline to centerline between the two entrances. In addition, the free standing signs must be located in the vicinity of the approved access points and visible to vehicles passing the approved entrances. The subject property has two approved access points, one on Dorset Street at the front of the property, and a second access point onto San Remo Drive shared with adjoining 344 Dorset Street Master Signage Permit DR-03-03 DRC April 28, 2003 Page 3 of 5 properties to the north and west. One free standing sign is adjacent to the Dorset Street access point. The second free standing sign is on the southerly side of the building. It is not near the rear access point because the rear access point does not fall on the subject property. Staff believes that the free standing signs are in keeping with the requirements of Section 9(b). 3. The Master Signage Plan should be revised to show the location of the free standing signs relative to lot lines and other lot features. Section 9(c) stipulates that the free standing signs shall be no closer than 5 ft. to any property line. In addition Section 9(h) stipulates that free standing signs along Dorset Street are to be located within a sign corridor that begins adjacent to the right-of-way and runs 16 ft. from the edge of the right-of-way toward the building face. The Master Signage Plan does not include a site drawing showing the locations of the free standing signs relative to lot lines or any information indicating the distance to lot lines. 4. The Master Signage Plan should be revised to include dimensional measurements of the support structures for the free standing signs. Pursuant to Section 9(e)(4), the total area of the support structure for the free standing signs on the subject property shall not exceed 150% of the area of each sign. Although it appears that the signs comply with this standard, the dimensions of the sign support structures are not provided. 5. Pursuant to Section 9(g)(2) of the Sign Ordinance, free standing signs shall have a base condition that is attractively maintained year round. Pursuant to Section 9(g)(2) of the Sign Ordinance, free standing signs shall have a base condition that is attractively maintained year round. Photographs submitted by the applicant show the front free standing sign is attractively landscaped with red and white flowering plants. The side free standing sign contains lawn at its base. 6. The Master Signage Plan must be revised to provide all dimensional parameters for each free standing sign. Pursuant to Section 9(h) of the Sign Ordinance, for lots in the DS/CC Sign District, the area of each free standing sign shall not exceed 32 sq. ft. The Master Signage Plan does not indicate the dimensions of the each entire sign, but only that part of each sign that bears the company name. There is additional signage bearing the site address for which dimensions should be provided. It appears that the free standing signs are less than 32 sq. ft., but the Master Signage Plan should be revised to indicate all dimensions of the signage. Pursuant to Section 9(h), free standing signs in the DS/CC Sign District shall not exceed 12 ft in height, measured from the average finished grade at the base of the sign to the highest portion of any point of the sign structure. The Master Signage Plan needs to be revised to provide dimensional measurements of the southerly and westerly facades and demonstrate compliance with Section 10(b)(1) of the Sign Ordinance. Section 10 of the Sign Ordinance governs the size and location of wall mounted signs. Pursuant to Section 10(b)(1) a wall mounted sign shall not exceed 5% of the area of the principal public facade or 100 sq. ft., whichever is smaller. In addition, pursuant to Section 10(b)(2), a wall sign may not exceed 15% of the area of the facade to which it is attached. The sign is 18" x 60", or 7.5 sq. ft. However, the Master Signage Plan does not indicate the dimension of the southerly principal facade or the dimensions of the westerly rear facade to which the sign is attached. Section 10(c) states that a wall mounted sign shall not project above or below the top of any first floor doorway unless permitted by the DRB. Based on the photographs submitted by the applicant, the sign is above the first floor pedestrian doorway. It is lower than the adjacent garage door, but staff believes this is appropriate and in keeping with the Section 10(c) standard. Pursuant to Section 10(d), a wall mounted sign shall not cover any opening or project beyond the top or end of any wall to which it is attached. Based on the photographs submitted by the applicant, it appears that the sign will not project over any opening or beyond the top or end of the front facade. 8. The Master Signage Plan should be revised to indicate the extent to which the sign will project from the facade in inches. Section 10(g) stipulates that a wall mounted sign shall not project from the wall in excess of 9". The application does not indicate the extent to which the sign will project from the facade. Table 10-1 limits to two (2) the number of wall mounted signs for a single tenant building with free standing or landscape feature signs. Again, only one wall mounted sign is proposed. GENERAL SIGN STANDARDS 9. Pursuant to Section 20, all signs shall be kept in good repair, and painted or cleaned as necessary to maintain a clean, safe, and orderly appearance. Section 20 of the Sign Ordinance requires signs to be of substantial and sturdy construction, kept in good repair, and painted or cleaned as necessary to maintain a clean, safe, and orderly appearance. The signs appear to be of substantial and sturdy construction. 10. The Master Signage Plan should be revised to include lighting specifications for all sign illumination fixtures. 11. No sign shall be left illuminated after midnight unless the premises are open for business after midnight, in which case no sign of any kind shall be left illuminated after the premises are closed for business. 344 Dorset Street Master Signage Permit DR-03-03 DRC April 28, 2003 Page 5 of 5 The free standing sign at the front of the lot is illuminated by at least one light. However, the Master Signage Plan does not include lighting specifications. Section 21(c) prohibits any sign to be illuminated past midnight unless the premises are open for business past midnight, in which case no sign may be illuminated past the close of business. RECOMMENDATION Based on the above review, I recommend that the DRC recommend that the DRB approve Master Signage Plan #DR-03-03, subject to the following conditions: 1. The Master Signage Permit must be issued to Janet M. Desarno by the DRB, prior to the issuance of the necessary individual sign permits for the property. 2. Pursuant to Section 20 of the Sign Ordinance, all signs shall be kept in good repair, and painted or cleaned as necessary to maintain a clean, safe, and orderly appearance. 3. No sign shall be left illuminated after midnight unless the premises are open for business after midnight, in which case no sign of any kind shall be left illuminated after the premises are closed for business. 4. Pursuant to Section 9(g)(2) of the Sign Ordinance, free standing signs shall have a base condition that is attractively maintained year round. 5. Prior to the issuance of the required individual sign permits, the following changes must be made to the Master Signage Plan: (a) The Master Signage Plan must be revised to include the awning sign and indicate details of any changes to the existing awning sign. Alternatively the Signage on the awning could be removed. (b) The Master Signage Plan must be revised to show the location of the free standing signs relative to lot lines and other lot features. (c) The Master Signage Plan must be revised to provide all dimensional parameters for each free standing sign. (d) The Master Signage Plan must be revised to include dimensional measurements of the support structures for the free standing signs. (e) The Master Signage Plan must be revised to provide dimensional measurements of the southerly and westerly facades and demonstrate compliance with Section 10(b)(1) of the Sign Ordinance. Mrs. Maher noted both the Democratic and Republican caucuses will be on 30 August when the Commission has a work session scheduled. Their main operation is at the Airport. This location would haveonly 1 or 2 cars for sale at any one time. 90% of the rental cars would be delivered to customers. He felt that at the peak, there would be 20 cars available for rental, most of which would be out with customers. They will not wash or service any cars at this location. This is the resubdivision of a 12 lot subdivision approved on 6/28/94 (minutes enclosed) . Access: No change in access proposed. Lot #10 is proposed to have frontage only on Hinesburg Road. This lot lies partially within the 200 foot buffer strip required along Hinesburg Road which prohibits access drives. Therefore, the applicant must provide access to lot #10 from Swift Street Extension. This alternate access must be shown on the final plat. Minimum lot size/frontage: The three (3) acre minimum lot size and eight (8) acre average lot size requirements will still be met. All lots will also meet the minimum frontage requirement of 200 feet. Buffer strip: Section 16.303 of the zoning regulations establishes an open space buffer strip, 200 feet in width, along Hinesburg Road. This buffer strip must be kept free of buildings, structures, parking facilities and access drives. Approximately one half of lot #10 lies within this buffer strip. Bechtel, City,Planner RE: August 6th Agenda Items DATE: August 2, 1935 2) EAST TERRACE, MULTI -FAMILY CONVERSION The City Attorney has verified that this project qualifies as a subdivision. According to our regulations multi -family projects qualify as major subdivisions. Multi -family is defined as three or more families (units). Although the ordinance calls for this to be treated as a major subdivision, (2 Public Hearings), the City Attorney has agreed that the Commission could rule it a minor subdivision since it is a conversion of an existing structure, it requires no new streets or public facilities, and it will have no increase in the building foot Orint. This qualification will allow the application to proceed with only one public hearing. The Commission should clearly state the reasons that this will be considered a minor subdivision in order to distinguish it from future multi -family developments that truly�shbuld be considered major subdivisions. There is no prior application for this lot in either the files or individual recollections. There was a proposed 4-unit DesLaurier Subdivision across the street that was denied by the Zoning Board in 1980. It was zoned C-1 at the time and a variance was needed for residential use. A sewer allocation will be needed for this 4-unit dwelling and will be charged the sewer fee. Nine parking spaces are required. Lanscaping should be shown for Final Plat. 3) PARK AND FLY The City has a $30,000 letter of credit from Mr. Gregory for the completion of the street and utlities. To date, the base is down. The letter of credit stated the street is to be completed by August 5, 1985. If it is not, we will act on the letter of credit. The stipulation of the Reprographics building on lot #1 required the street to be completed prior to occupancy. There is no reason not to act upon this site plan application as well in a similar fashion. 4) ROCKY'S CAR WASH Mr. Clayborne will be providing -traffic information prepared by Roger Dickinson of Fitzpartick-Llewellyn. (Enclosed) It was taken at the Essex Car Wash this past week. Erosion Control information is also expected. 5) NATIONAL CAR RENTAL, 344 DORSET STREET The applicant proposes to change the use of an existing building (formerly Climate Control) to a printing business and the National Car Rental business. The property is zoned C-2. The Zoning Board approved this for multiple uses. Parking : This requires one space for the auto sales and ten spaces for the printing office. Twenty spaces are existing. Access: Access is from the existing curb cut on Dorset Street. Ci lucr ation : Circulation is provided around the southern and western portions of the lot. Landscaping: The regulations require $150 in landscaping. The front: of the lot is grassed and has a number of shrubs in the front and pine trees on the northern side of the building. Credit should be given. Other: The property is traffic overlay zone 5. This 17,500 square foot lot permits 20 trips during the peak hour on the adjacent street. The applicant claims 10 trips per hour will be the peak traffic generation. Even if these 10 are generated during the Dorset Street peak they are well under the maximum allowed. Barry's Transmission, at lot #5 Gregory and Daughters Inudstrial Park. Mr. Ward stated it is in an industrial commercial zone. Under section 13.205 the "Transmission Shop" is a conditional use. The building proposed is 60' x 100' and the lot coverage is ?% building and a total of 221% which is well within the requirment. The only issue is the conditional use. Nr.Wood said they are using only half of the allocated water and sewer for that lot. He said they would have half of the allocated car trips per day. He said he feels it fits in with the character of the neighborhood. Mr. Dinklage was concerned about the oily water and transmission fluid. Mr. Wood said the oily water went into a grease trap before going to the sewer and the transmission fluid was put into steele drums and hauled away. Mr. Ward said Mr. Syzmanski will look at the grease trap before the appeal goes through site plan review. There was no one in the audience for or against the appeal. The appeal was granted on a unanimous vote. No-2 Appeal of Robert Mar uis and Dumont Brothers Appeal of Robert Marquis and Dumont Brothers seeking a variance from Section 13.10, request is for permission to remodel an existing non -conforming structure and occupy same as a single-family dwelling at 1936 Williston Road. Mr. Wand said the area is industrial commercial. The application has been changed from his appeal which was denied before. The second fllor has been eliminated. Mr. Marquis will stay within the 25% rule. The property is worth $?J,100. He will occupy the building as a residence. It has been abandoned for almost ten years so you can no longer grandfather the residential use. -z- ZONING BOARD OF ADJUSTMENT JULY 22, 1985 Mr. Marquis said the property next door will be for sale in 3 to 5 years. He thought he could use the building as an office if he had access to the guard -r d as an exit. He was denied this request and feels because of the denial he is proving hardship. (see attached letter) He said he is buying the property on speculation. Mr. Blais aid because the property has been abandoned he didn't feel it should become residential. It the property owners were stating they had a hardship this might be true but since Mr. Marquis has not bought the property yet there is no hardship. Mr..Dinklage said he felt granting this appeal. was not in the best interest of the City in the long run. The appeal was denied on a unanimous vote. No. 3 Appeal of Paul Choinere Appeal of Paul Choinere seeking approval from Section 13.202 conditional uses and Section 19.05 Multiple uses, request is for permission to construct a building 90' x 180' for boat storage in conjunction with existing buildings on a lot containing 3.6 acres d.b.a. Karine Collection, LTD, and P.J.'s Auto Billage, at 2073 Williston Road. Mr. Ward said Mr. Choinere is purchasing land from Dr. Brown. The driveway will be shared by the driving range approved earlier and the Marine business. Presently there are three buildings on the lot. P.J.'s Auto sale and rental, Marine Sales, and the third building is for boat repairs. The request is for a fourth building to be used for boat storage. Marine Sales and service is a conditional use. Under Section 19-05 any alteration, extension or other change to an existing conditional use has to be reviewed by the board. There is also the question of multiple use. With the new building the lot coverage will be 20.6% for buildings, the permitted is 30o. The total coverage will be 66%, the permitted is 70%. Mr. Dugan said it is just a storage building and has no impact on water and seweres. The only thing needed is fire protection and electricity. They have the approval of the fire chief. Because the building is set back from the road the height is less and the height is leagal. He said there would be little impact on traffic. Non one spoke from the audience for or against the appeal. He said the front parking would be for the tenant. There would be a maximum of 20 cars parked in the rear of the building. Mr. Dinklage made the motion that if passed the use be restricted to the automotive rental and related sales and printing and copying as warned. Mr. Guyette seconded the motion. All were in favor.
