FINDINGS OF FACT & DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, application of Janet and David Desarno to
make parking and access modifications in order to provide access
between 344 Dorset Street and 35 San Remo Drive.
On the 23rd of August, 1994 the South Burlington Planning
Commission approved the request of Janet and David Desarno for site
plan review under Section 19.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This project consists of parking and access modifications to
two(2) adjacent lots owned by the applicant. The reason for these
modifications is to provide access between Dorset Street and San
Remo Drive. The Dorset Street property is used for retail use and
the San Remo Drive property is used for auto repair. The last
review of the Dorset Street property by the Planning Commission was
on 8/6/85 and no record can be found of a review of the San Remo
Drive property.
2. These properties located at 344 Dorset Street and 35 San Remo
Drive lie within Central District 2. They are bounded on the north
by Champlain Oil and Burlington Rent -All, on the south by Net
Result, on the west by Dorset Street and on the east by San Remo
Drive.
3. Access/circulation: Access to 344 Dorset Street is via a 30
foot curb cut on Dorset Street.
4. Access to 35 San Remo Drive is proposed to be by a 24 foot wide
curb cut located at the northeast corner of the property. This new
curb cut will be located immediately to the south of an existing
curb cut serving the property to the north. The two (2) adjoining
driveways will be separated by a median planting bed. An existing
20 foot curb cut at the southerly end of the property will be
eliminated.
Circulation is adequate.
5. Coverage/setbacks: 344 Dorset Street: Building coverage is
21% (maximum allowed is 40%). Overall coverage is 57% (maximum
allowed is 90%). 35 San Remo Drive: Building coverage is 20.3%
(maximum allowed is 40%). Overall coverage is 65% (maximum allowed
is 90%).
The building at 344 Dorset Street meets the building envelope
requirement and the building at 35 San Remo Drive does not meet the
building envelope requirement.
6. Parking: The property at 344 Dorset Street requires 13 parking
spaces and 13 spaces including one (1) handicapped space is being
provided.
The property at 35 San Remo Drive requires eight (8) parking spaces
and 19 spaces including one (1) handicapped space are being
provided.
7. Landscaping: There is no minimum landscaping requirement,
based on building costs, for this project. Applicant is proposing
to add an Arborvitae hedge on the north side of the building at 344
Dorset Street with an estimated value of $1688.
8. Lighting: Exterior lighting for 344 Dorset Street will consist
of the following:
--- four (4) fence mounted 75 watt metal halide lamps with cut off
luminaries.
--- 10 building mounted 75 watt metal halide lamps with cut off
luminaries.
Applicant should submit existing and proposed exterior lighting
details for 35 San Remo Drive.
9. Dumpsters: Screened dumpster areas are shown for both lots.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the site plan application of Janet and David
Desarno to make parking and access modifications in order to
provide access between 344 Dorset Street and 35 San Remo Drive, as
depicted on a plan entitled "344 Dorset St./35 San Remo Dr., So.
Burlington, Vermont, David Desarno Owner," prepared by Michael
Dugan, Architect, dated August 1, 1994, last revised 8/18/94, with
the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The plan shall be revised prior to issuance of a
zoning/building permit to show the changes listed below and shall
require approval of the City Planner. Three (3) copies of the
approved revised plan shall be submitted to the City Planner prior
to permit issuance.
a.) The plan shall be revised to show the median planting bed
not extending beyond the street r.o.w.
b.) The plan shall be revised to note that a depressed curb
will be used across the new curb cut.

c.) The plan shall be revised to show site drainage.
d) The plan shall be revised to accurately show landscaping
which has recently been installed.
3. Applicant shall submit existing and proposed exterior lighting
details for 35 San Remo Drive. All new exterior lighting shall
consist of downcasting shielded fixtures so as not to cast light
beyond the property line. Any new lighting or change in existing
lighting shall be approved by the City Planner prior to
installation.
4. This approval is conditioned on the applicant agreeing to
combine, in the future, the new access driveway on 35 San Remo
Drive with the existing driveway located on the adjacent property
to the north into one shared driveway with a maximum 36 foot wide
curb -cut on San Remo Drive. The two (2) driveways shall be
combined into one driveway at the time the property owner to the
north agrees to such combination. The final design of the shared
driveway shall be approved by the City Planner and City Engineer
prior to construction.
5. The applicant shall obtain a zoning/building permit within six
(6) months or this approval is null and void.
6. Any change to the site plan shall require approval by the South
Burlington Planning Commission.
