HomeMy WebLinkAboutSP-90-0000 - Decision - 0340 Dorset StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Edgar and conversion of a 1,800 square foot building from use to retail use, 27 San Remo Drive. Bette Welch for equipment rental On the 4th of September 1990, the South Burlington Planning Commission approved the above referenced site plan under Section 19.10 of the South Burlington Zoning Regulations based upon the following findings: -1, Thia property is located in Central District 2. The lot has frontage on both Dorset Street and San Remo Drive. The property is presently developed with three (3) buildings which includes Burlington Rent -All, a garage/storage building and a vacant 1,800 square foot building adjacent to San Remo Drive (previously equipment rental business). The vacant building is proposed to be converted to an oriental grocery store. 2. Setback/Coverage: The building which is the subject of this site plan review does not meet the setback requirements for the district, it is therefore a noncomplying structure. No changes are proposed which would increase its degree of nonconformity. The lot is currently 91.6% covered by parking, driveways and buildings. The Central District Zoning Ordinance section 1.6042 allows a maximum coverage of 90%. 3. Access/circulation: The property is served by three (3) curb cuts, two are off Dorset Street and one is off San Remo Drive. The San Remo Drive curb cut is 20 feet in width, the southerly Dorset curb cut is 20 feet wide. There are no barriers to traf- fic passing through the property from San Remo Drive to Dorset Street. Vehicles can move freely from one street to the other. 4. Parking: The proposed use requires ten parking spaces and seven (7) spaces are being provided, including one (1) handi- capped space. Parallel parking spaces #5 and #6 on the plan should be lengthened to 22 feet to allow for adequate maneuvering room. The Zoning Regulations do not contain parking standards for equipment rental use. Based on observation, parking appears to be adequate for the Rent -All business. 5. Landscaping: The applicant indicates that he will not be making any improvements to the building, therefore, the minimum landscaping requirements would not apply. 1 6. Traffic: The parcel is located in Traffic Overlay zone 6 which allows 90 peak hour trips. It is estimated that the com- bined uses will generate 50 peak hour trips. 7. Other: A dumpster will be used by the proposed use. It is not proposed to be screened. DECISION & CONDITIONS Based upon the above findings, the South Burlington Planning Commission approves the site plan of Edgar and Bette Welch for conversion of a 1800 square foot building from equipment rental use to retail use as depicted on a 2-page set of plans, page 1 entitled "Proposed Retail Store at 27 San Remo Drive, Site Plan prepared by Fitzpatrick Design, and dated 8/18/90, subject to the following stipulations: 1. The plan shall be revised prior to occupancy of the building to show the following: a) Dumpster shall be adequately screened to the satisfac- tion of the City Planner. b) Parallel parking spaces at least 22 feet long. 2. Any new lighting shall be shown on a plan and submitted along with specifications to the City Planner for approval. New light- ing shall be downcast, shielded luminaire. 3. No trailers used for storage on this site. 4.
