Re: Findings of Fact, design review application of John Kennedy, agent for Edgar Welch,
to amend a previously approved planned unit development consisting of: 1) 12,980
square foot building used for retail use, 2) a 1,800 square foot building used for retail use,
3) 1,800 square foot accessory structure, and 4) one residential unit on the second floor of
the 12,980 square foot building, 338 & 340 Dorset Street. The amendment consists of 1)
replacing the siding of the 1,800 square foot building used for retail use with vinyl siding,
2) painting the roof of the 1,800 square foot building used for retail use, and 3) revising
entrance on the south fagade of the 1,800 square foot building used for retail use, 338
Dorset Street
On the 5th of September 2000, the South Burlington Development Review Board
approved the design review application of John Kennedy, agent for Edgar Welch, under
Section 24.1 of the South Burlington Zoning Regulations based on the following
findings:
1. This project consists of amending a previously approved planned unit development
consisting of. 1) 12,980 square foot building used for retail use, 2) a 1,800 square foot
building used for retail use, 3) 1,800 square foot accessory structure, and 4) one
residential unit on the second floor of the 12,980 square foot building, 338 & 340
Dorset Street. The amendment consists of. 1) replacing the siding of the 1,800 square
foot building used for retail use with vinyl siding, 2) painting the roof of the 1,800
square foot building used for retail use, and 3) revising entrance on the south fagade
of the 1,800 square foot building used for retail use, 338 Dorset Street.
2. This property located at 340 Dorset Street lies within the CD 2 District and Design
District 2. It is bounded on the north by a church and a mixed commercial/residential
building, on the east by San Remo Drive and a commercial building, on the west by
Dorset Street, and on the south by a commercial building.
3. Consistent Design: The building at 338 Dorset Street has not been substantially
renovated while the surrounding buildings have been. The applicant has proposed
siding the building to match the main building and accessory building at 340 Dorset
Street. The roof of 338 Dorset Street will also be painted to match the roof of 340
Dorset Street,
4. Materials: This property is located within Design District 2 which allows a wide variety
of both material and high quality man-made materials. The roof will is covered with a
standing seam 24 gauge metal roof. New siding will be applied to cover the metal
panels. The new siding will consist of "Norandex Sagebrush Super Premium Vinyl
Siding".
5. Colors and Textures: The color of the roof will be "New England Green", similar to the
"Hartford Green" color of the roof at 340 Dorset Street. The color of the siding will be
"Woodsman Select Gray" matching that of 340 Dorset Street.
6. Human Scale Design: The applicant has proposed covering over the existing garage
doors on the south side of the building with the vinyl siding and adding an entry door
to the fagade. This entry door will be a single panel door slightly off set from the
center of the fagade. The reduction of the door size will add a human scale design
element to a fagade that currently is defined by one window and garage doors. Staff
recommends that the door be required to have some glass as it will help penetrate that
fagade visually. A single panel door will result in the window at the western end of
the south fagade being the only point at which the building is visually penetrable on
the south fagade. This would create a solid wall which is contrary to human scale
design.
7. Roof as a Design Element: The only change proposed to the roof is to paint it a shade
of green that will match 340 Dorset Street. No roof top devices are proposed.
8. Orientation of Building to the Street: No changes are proposed to the building's
orientation to Dorset Street or San Remo Drive.
9. Landscape and Plantings: No additional landscaping is proposed.
10. HVAC: While the applicant has not proposed any roof top devices, two wall mounted
air conditioning units are proposed. One air conditioner is proposed in the middle of
the south fagade and one is proposed in the middle of the north fagade. Section
24.402 of the Zoning Ordinance requires that "such features shall be incorporated
within or designed as part of the building on the site, not added as an afterthought."
The Committee should decide if the air conditioners are adequately designed as part
of the building. Staff recommends that landscaping be added to visually shield the
units and prevent people from running into these building protrusions.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves the design review application #DR-00-18 of John Kennedy, agent for Edgar
Welch, to amend a previously approved planned unit development consisting of: 1)
12,980 square foot building used for retail use, 2) a 1,800 square foot building used for
retail use, 3) 1,800 square foot accessory structure, and 4) one residential unit on the
second floor of the 12,980 square foot building, 338 & 340 Dorset Street. The
amendment consists of. 1) replacing the siding of the 1,800 square foot building used for
retail use with vinyl siding, 2) painting the roof of the 1,800 square foot building used for
retail use, and 3) revising entrance on the south fagade of the 1,800 square foot building
used for retail use, as depicted on a six page set of plans, entitled "338 Dorset Street",
dated of 8/17/00, with the following stipulations:
All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. This recommendation for approval of the proposed addition is based on the
application's compliance with the design review criteria contained in Section
24 of the South Burlington Zoning Ordinance. The Code Officer shall make
the determination of whether or not this application complies with all other
requirements contained in the zoning ordinance.
3. This approval does not include the applicant's request for lighting and
landscaping for the buildings at 338 and 340 Dorset Street. No new lights are
approved for 338 Dorset Street.
4. The proposed door on the south fagade of 338 Dorset Street shall have a glass
design element.
5. The site plans shall be revised to show the changes listed below and shall
require approval of the Director of Planning & Zoning (hereinafter Director).
Three (3) copies of the approved revised site plans shall be submitted to the
Director prior to permit issuance.
a) The plans shall be revised to eliminate all lights from the elevations
and site plans as stipulated by condition three.
b) The elevations shall be revised to include a glass design element in the
door proposed for the south facade as stipulated by condition four.
6. A permanent Certificate of Occupancy for 338 Dorset Street may not be
issued until a landscaping plan for 338 and 340 Dorset Street is approved by
the Development Review Board and implemented.
7. No other changes are approved for this property. Any further changes to the
windows, doors, roof, siding, lighting, dumpsters, landscaping, or massing of
the property, other than those mentioned above, must be reviewed by the
Design Review Committee and Development Review Board prior to
alteration.
