FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, design review application of John Kennedy to erect two wall signs:
1) a 3 foot by 9 foot indirectly lit wall sign in the west gable end of 338 Dorset Street,
and 2) a I foot by 3 foot wall sign by the entry door of 338 Dorset Street.
On the 3rd of October, 2000, the South Burlington Development Review Board approved
the design review application of John Kennedy under Section 4 and Section 23 of the
South Burlington Sign Regulations based on the following findings:
�. This project consists of erecting two wall signs: 1) a 3 foot by 9 foot indirectly lit
wall sign in the west gable end of 338 Dorset Street, and 2) a I foot by 3 foot wall
sign by the entry door of 338 Dorset Street.
2. The owner of record is Edgar Welch.
3. Consistent Design: The building at 338 Dorset Street currently does not have wall
signs. The proposed signs will be the only signs on the building. The existing wall
signs on the property utilize a white background, and oval design, and are hand
painted. The proposed wall signs will use a white background and will be hand
painted wood signs
4. City Center Goals: The 3 sq. ft. sign will serve as a human scale sign. The 27 sq. ft.
sign will be mounted in the gable end of the building similar to one of the signs of the
Outback Steakhouse at 150 Dorset Street. While the sign does not promote a human
scale design, it is geared to the motorist and provides direction to those entering from
Dorset Street, similar in concept to those used by the Outback Steakhouse.
5. Color, Texture and Materials: The applicant proposed a white background sign with
red, blue, and gold lettering. The proposed sign therefore meets the three
predominant color requirement.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves the design review application #DR-00-20 of John Kennedy to erect two wall
signs: 1) a 3 foot by 9 foot indirectly lit wall sign in the west gable end of 338 Dorset
Street, and 2) a 1 foot by 3 foot wall sign by the entry door of 338 Dorset Street as
depicted on a one page set of plans, entitled "Macsphere", with a stamped received date
of 9/19/00, with the following stipulations:
This recommendation for approval of the proposed sign design is based solely
on the application's compliance with the design review criteria contained in
Section 4 of the South Burlington Sign Ordinance. The determination of
whether or not this application complies with all other requirements contained
in the sign ordinance shall be made by the Code Officer.
2. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
3. Section 23 of the Sign Ordinance requires that a master signage plan be
submitted for any lot within the Dorset Street/City Center Sign District. The
applicant must submit a master signage plan that includes the following:
a) Identify the location of all signs on the property on a site plan.
b) Identify all existing signs, the proposed two "Macsphere" signs, and
all previously approved signs that the applicant will install in a short
report detailing the signs size and proportions, the signable wall area,
the material of each sign, identify the colors and lettering style of each
sign, and the types of illumination of each sign.
c) Identify all illegal signs. The "Ice", "Gas", and "Sandwiches" sign
which is displayed on the cooler located in the barn were neither
approved by the Design Review Board or the Development Review
Board. Sign permits were never issued for these signs. The signs, as
displayed on the exterior of the buildings, are illegal signs.
4. Prior to obtaining a sign permit, all illegal signs, as identified in the Master
Signage Plan, must be either removed from the property or an application be
initiated to legitimize the illegal signs located at 340 Dorset Street.
