FINDINGS OF FACT AND DECISION
STATE OF VERMONT

Re: Master signage permit application #DR 02-10 of Edgar Welch for approval of a master
signage plan, 338-340 Dorset Street
On the l"of October 2002, the South Burlington Development Review Board approved
the request of Edgar Welch seeking master signage approval under Section 8 of the South
Burlington Sign Ordinance, based on the following findings:
1) This project consists of requesting approval for a master signage plan for the 338-
340 Dorset Street. This project is being reviewed under the current Sign Ordinance
passed in June of this year. Many signs are already present on the site.
2) The owner of record is Edgar Welch.
3) This property at 338-340 Dorset Street lies within CD2 and Design Overlay
District 2. It is bounded on the north by Health South and a church, on the west by
Dorset Street, on the east by San Remo Drive, and on the south by another
commercial property.
DESIGN REVIEW CRITERIA/ MASTER SIGNAGE PLAN
Freestanding Sign
4) Sign Area: The master signage plan includes two freestanding sign 12'-6" in
height, and complies with the Section 9(b) (2) (i)-(iii), which permits two
freestanding signs on a lot with separate entrances off a public street. They have
approximately 21 square feet of signage area (maximum allowed is 32 sq ft).
5) Location of features: The locations of the freestanding signs are noted on the plan.
6) Color Scheme: The background of all signs on the freestanding sign (except the
address sign) is white. The accent colors (colors for text and graphics) for the
freestanding sign are not generally the same and are the choice of the tenant.
7) Lettering or Graphic Style: The lettering style is another feature which is up to the
tenant.
8) Lighting. ---The proposed lighting for the freestanding signs is 100 W shielded light
fixtures which cast light only on the sign itself. The signs are lit from above only, as
stated by the applicant, but the master signage plan states they are lit from above and
below. The committee requested the master signage plan be revised to list the proper
lighting techniques for the freestanding sign.
9) Material: All signs are constructed of plywood (marine grade) and will be
mounted on 6"x 6" pressure treated wood.
10) Shape: The freestanding sign accommodates seven (7) tenants. All are
rectangular.
WALL SIGNS
11) Location of features: The locations of all wall signs are shown in the enclosed
elevations, usually adjacent to an entrance to an establishment.
12) Shape: The shapes of all wall signs are oval.
13) Lighting: The applicant stated that only the wall sign at #338 is lit with
downcasting and shielded fixtures.
14)Letterm or Graphic SIyIe /Color Scheme: The master signage application does
not dictate the color scheme or font styling. The tenant is encouraged to use the
designated space to design their own logo.
15) Material: The signs are to be constructed of plywood (marine grade).
16) Computation of Maximums: Section 10 of the sign ordinance states the size of all
wall signs in a multi tenant building with a master signage plan shall be either
be"15% of the principal fagade of each building or 150 sq ft per building, which ever
is smaller"
17) The allowable sign area for #340 is 150 sq ft. The applicant is proposing 130 sq ft
total for all tenants. The applicant proposes 33 sq ft for building #338, and 46.875 sq
ft for building #339. This complies with the computation maximums.
18) Non -Conforming Signs: There is currently one sign on the property considered
non -conforming to the master signage plan, and it is the Coca -cola sign on the
freestanding sign.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves the master signage permit application #DR-02-10 of Edgar Welch seeking
approval for a master signage plan, as depicted on a twenty three (23) set of plans, page one
entitled "340 Dorset Street", with a date of 5/28/99, plus four page plan for #338 Dorset
Street, both prepared by John Kennedy, with the following stipulations:

1) All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2) This approval of the proposed master signage plan is based on the application's
compliance with the master signage permit criteria contained in Section 8 of the
South Burlington Sign Ordinance. The determination of whether or not this
application complies with all other requirements contained in the sign ordinance shall
be made by the Administrative Officer.
3) Any change or addition to signage at 338-340 Dorset Street shall require approval by
the South Burlington Design Review Committee.
4) The applicant is required to obtain approval from the Development Review Board.
5) The master signage plan shall be revised to reflect the lighting conditions as installed
on site.
6) The master signage plan shall be revised to indicate that all sign panels on the
freestanding sign shall be on a rectangular white background.

24 V.S.A. § 4471 and V.RC.P. 76, in writing, within 30 days of the date this decision is issued. The fee is
$150.00. If you fail to appeal this decision, your right to challenge this decision at some future time may be
lost because you waited too long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d)
(exclusivity of remedy; finality).
