Re: Findings of Fact, application of Roberta Kiehl to amend
condition #2 of the 7/11/89 approval for an office use which was
subsequently amended on 10/8/91, 337 Dorset Street.
On the 26th of January, 1993 the South Burlington Planning
Commission approved the request of Roberta Kiehl to amend a
condition of a previously approved site plan under Section 19.10 of
the South Burlington Zoning Regulations based on the following
findings:
1. The applicant received site plan approval from the Planning
Commission on July 11, 1989 to convert a single family dwelling to
an office. One of the conditions of approval required the
applicant to pave the parking lot by the end of the 1991
construction season which was the then estimated completion date of
the Dorset Street project. On October 8, 1991 the Planning
Commission amended this condition to pave the parking lot by the
end of the 1992 construction season due to the delayed Dorset
Street project.
2. The State agreed to pave the parking lot as part of the
agreement to sell the strip of land needed for widening. Since the
Dorset Street project is not yet complete, this paving has not been
completed. The applicant is now requesting that this condition be
amended to require the paving by the end of the 1993 construction
season. It is anticipated that the Dorset Street project will be
completed by this time. The timing of paving should be tied to
the completion of Dorset Street.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the request of Roberta Kiehl to amend condition
#2 of the 7/11/89 approval for an office use at 337 Dorset Street,
and which was subsequently amended on 10/8/91, to read as follows:
"Due to potential impacts of dust from a gravel parking lot on
adjoining residential uses, the applicant shall pave the parking
lot prior to completion of the Dorset Street widening project".

Re: Findings of Fact, request of Roberta Kiehl to amend condi-
tion #2 of the 7/11/89 approval for an office use, 337 Dorset
Street.
On the 8th of October, 1991 the South Burlington Planning
Commission approved the request of Roberta Kiehl to amend a
condition of a previous site plan review under Section 19.10 of
the South Burlington Zoning Regulations based on the following
findings:
The applicant received site plan approval from the Planning
Commission on July 11, 1989 to convert a single-family dwelling
to an office. one of the conditions of approval required the
applicant to pave the. parking lot by the end --)f the 1991 con-
struction season. The applicant is requesting that the Planning
Commission amend this condition and delay the implementation of
the requirement until the end of the 1992 construction season
since the State will be paving the lot as part of the Dorset
Street project.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Plan-
ning Commission approves the request of Roberta Kiehl to amend
condition #2 of the 7/11/89 approval for an office use at 337
Dorset Street to read as follows:
"Due to potential impacts of dust from a gravel parking lot on
adjoining residential uses, the applicant shall pave the parking
lot by the end of the 1992 construction season."

Re: Findings of Fact, application of Roberta A. Kiehl, to con-
vert an existing 1000 square foot, one story, single-family
dwelling to office use, 337 Dorset Street.
On the 11th of July 1989, the South Burlington Planning Commis-
sion approved the request of Roberta Kiehl for site plan approval
under Section 19.10 of the South Burlington Zoning Regulations
based on the following findings:
1. TRAFFIC ACCESS: Access is shown via a 20 foot wide curb cut
on Dorset Street.
2, CIRCULATION & PARKING: Circulation is limited to one side
(northern) and the rear (western) portions of the lot. The main
building entrance will be redirected to the rear and no longer
face Dorset Street. The parking lot will be in the rear. Aisle
and access widths are acceptable. The project requires 4 parking
spaces; 5 are approved.
3. LANDSCAPING & SCREENING: A six-foot high stockade fence
shall be installed along the northern property line from the
front of the building to the back property line. The plan shall
be revised to show this and shall be approved by the City Plan-
ner. The applicant shall pave the parking lot by the end of the
1991 construction season. Existing plantings are adequate.
4. OTHER: a) As long as commercial uses exist within the
structure, the structure and property will be subject to the
provisions for non -conforming structures set forth in the South
Burlington Zoning Regulations. b) Based on the expressed repre-
sentation of the applicant, the applicant shall allow connections
between her parking lot and parking lots on adjoining properties
as these properties develop. The applicant shall record an
access agreement to provide access to the adjoining properties to
the south and north. This agreement shall be written by the City
Attorney and reviewed and approved by the applicant and shall be
recorded prior to permit. c) The building permit shall be
obtained within 6 months or this approval is null and void.
