FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Design review application #DR-02-07 of Fitzpatrick's Buick-GMC. The request is for approval of a master signage plan, including installation of one wall sign, 222 Dorset Street On the 2nd of July 2002, the South Burlington Development Review Board approved the request of Fitzpatrick's Buick-GMC for Master signage plan approval under Section 8 of the South Burlington Sign Ordinance based on the following findings: 1) This project consists of approval of a new master signage plan for 222 Dorset Street. The application is for approval of a master signage plan, including installation of one wall sign. 2) The owner of record is R W Realty. 3) This property is located within the Design and Central District 1 on a parcel bounded by single family residential lots on the north, Dorset Street on the west, the Associates in Orthopedic Surgery and a chiropractic office on the south, and undeveloped land on the east. Design Review Criteria Free standing Sian 4) The property may have one 32 square foot freestanding sign. There is an existing freestanding sign on the property. The existing freestanding sign is an internally lit sign measuring 16 square feet. It is mounted on a single 9 foot support. The colors are red and blue, with a white background. Under the current sign ordinance this sign is a non conforming sign under Section 21 (e). The applicant was made aware that under Section 24 (f), "on or before June 3, 2009 all non -conforming signs shall be removed or lawfully replaced... " Wall Sian 5) The applicant proposed one (1) new wall 66.5 square foot sign, to be mounted in the soffit area of the building above the showroom. The signable wall area is 80.5 square feet. The applicant provided scaled drawing of both the sign and plans drawn to scale of the proposed sign. The applicant provided color photographs, and information on size, color, font, material sign is to be constructed, and the method of attachment to the building Master Signage Plan 6) Location of Features: The locations of the proposed signs are noted in photographs, and a scaled plot plan of the lot, showing the location of buildings, parking lots, driveways and landscaped areas on such lot, including the locations of proposed and existing signage. 7) Color Scheme: The proposed wall sign calls a black, red, white, and blue, sign. with an additional flag graphic which is not on the existing freestanding sign. The applicant is encouraged to utilize three predominate colors. The photographs show the applicant is proposing white background, the name of the dealership in black and the trademark names Buick in blue and GMC in red. The flags reflect the same colors. The existing freestanding sign is red, white, and blue. 8) Lettering or Graphic Style: The lettering for all signs is a block sans serif font, and utilizes the trademark font of the make of automobiles sold at this dealership. 9) Lighting: The wall sign will not be lit other than possible lighting with pre- existing fixtures in the ground for building lighting. 10) The freestanding sign is internally lit. 11) Material: The proposed wall sign is to be constructed of a rigid material (exterior grad plywood or Gatorboard 5/8' to 3/4" thickness). The letters and flag logo will be cut separate and attached to the background piece, creating a layered three dimensional sign. 12) Shgpe: The applicant has shown the shape of the signs on the property of be rectangular. This is by necessity because the soffit area requires a rectangular shape. 13) The signs relate to each other in font choice only. The color choices are relatively the same (with the addition of black). It appears the flags are a new logo graphic included in the wall sign. The materials are different. 14) The purpose of a master signage plan is to create a standard for all signs on a property. Staff would like to know if the applicant intends for this application to represent the intentions for all future signs on the property, (with regard to sign material, construction, colors, fonts, and method of lighting). 15) Consent: The owner of the property signed the design review application. 2 DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approved design review application #DR-02-07 of Fitzpatrick's Buick-GMC, for a new master signage plan, and installation of one (1) wall sign on the western elevation of the Fitzpatrick showroom, as depicted in photographs submitted with an application dated May 7, 2002, page one (1) entitled "Fitzpatrick's Buick-GMC" prepared by Marty Fitzpatrick and John Patch, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) All future sign applications shall conform with the Master Signage Plan below: a) All signs on the property shall be construct of exterior grade plywood or Gatorboard and assembled of individual pieces (letters and the approved flag logo), creating a three dimensional effect. b) The colors, red, white, blue, and black, shall be the same as those shown in the photo (and in the required scaled drawing). c) The lighting of all signs shall consist of indirect illumination provided that the source of light shall concentrate the illumination on the sign to prevent glare. 3) The applicant shall obtain a sign permit pursuant to section Five of the Sign Ordinance prior to installation of the approved sign. 4) This approval of the proposed sign design is based solely on the application's compliance with the design review criteria contained in Section 8 of the South Burlington Sign Ordinance. The determination of whether or not this application complies with all other requirements contained in the sign ordinance shall be made by the Code Officer. If you fail to appeal this decision, your right to challenge this decision at some future time may be lost because you waited too long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d) (exclusivity of remedy; finality).
